STITZEL June 23, 1980 Richard Ward, Zoning Administrator City of South Burlington 1175 Williston Road South Burlington, Vermont 05401 Re: Barnes Variance Request Dear Dick: 1775 WILLISTON ROAD TELEPHONE (802) 863-2857 In response to your questions regarding the above, please be advised that it is my opinion that Mr. Barnes is not entitled to the relief requested. My reasons for this conclusion are as follows: As I understand the basic facts, Mr. Barnes owns an approximately one acre parcel of land, with two residences thereon, located in the Airport Industrial District. He is presently seeking, in the form of a variance request, either permission to operate a parking lot on this land, or clarification of any preexisting rights which he might have to maintain a parking lot on this land. As a starting point, Section 11.15 of the ordinance would appear to preclude the establishment of a parking lot as a second use on the lot. In addition, a parking lot does not appear as a speci- fied permitted use or as a conditional use in Sections 9.00 and 9.10 of the ordinance. Barring any other factors, viewing the application as a new item results in a conclusion that the relief requested is not allowed under the ordinance. Mr. Barnes relies on a zone change granted by the Town of South Burlington's Selectmen in June, 1961, for his authority to operate the proposed parking lot. Several factors combine to indicate that this reliance is not well founded. The 1961 zone change was confined to the rear 100 feet by 132 feet of the lot. Any portion of the proposed use which exceeds the rear 100 feet of the lot is not supported by this prior zone change claim. In addition, as shown by documents introduced by Mr. Barnes, the zone change was related to the use of that portion Richard Ward, Zoning Administrator Page 2 June 23, 1980 of the lot as a car rental operation. Since the car rental use never commenced, the inquiry must be directed as to whether any use was made of this portion of the lot pursuant to the zone change and prior to and during the subsequent period when the area was rezoned to Airport Industrial. It appears that Mr. Barnes has been using portions of the front part of the lot to occasionally park cars. However, it does not appear that the rear portion was used to park cars. (I am advised that this rear portion of the lot is presently being cultivated.) In order to take any benefit from a claim of a vested right, the use must have attached to the rear 100 feet of the lot pursuant to the zone change. Since this does not appear to be the case, reliance on this theory does not provide support for the requested relief. Since reliance upon a vested right theory or a non -conforming use theory is not well founded, the analysis must proceed as one for a new use. As to this approach, the preceding paragraphs of this letter indicate that the requested relief is not available. If you have any questions, or if I may be of any assistance, please let me know. In preparing our opinion for the Board of Adjustment, it would be useful to have the benefits of your thoughts and research on the following issues. Since I understand that Attorney Joseph McNeil is in- volved in this application, representing the City of Burlington, I am sending him a copy of this letter, and suggesting that he also comment on the issues, should he be so inclined. If the request is viewed as the commencement of a new use, the following issues arise: (a) Is a parking lot a permitted or conditional use within the airport industrial district; (b) Can the requested use comply with the area, density and dimensional requirements of §11.00 of the ordinance; and (c) Would the institution of the new use be barred by §11.15 of the ordinance? If the proposed use is viewed as a continuation, on a vested right or related theory, the following issues arise: (a) Was the 1961 zone change equivalent to the issuance of a permit; (b) Was this zone change specifically limited to the then proposed car rental use; (c) If there did arise a prior nonconforming user, should it be limited to the actual scope of the user, with the present proposal viewed as an expansion of a prior non- conforming use; yyw, Allen Overton, Esq. I understand from Mr. Ward, the Zoning Administrator, that this matter has been placed on the agenda for June 23, 1980 meeting.
