DESIGN REVIEW APPLICATION #DR-09-01
FINDINGS OF FACT AND DECISION
Eli Lesser -Goldsmith, hereafter referred to as the applicant, is requesting design review
approval for the exterior modifications to a property within Design District 2 of the City
Center Design Review Overlay District.
The Development Review Board held a public hearing on February 17, 2009. The
applicant was represented by Katy Lesser.
Based on testimony provided at the above mentioned public hearing and the plans and
supporting materials contained in the document file for this application, the Development
Review Board finds, concludes, and decides the following:
FINDINGS OF FACT
1. The applicant is requesting design review approval for the exterior modifications to a
property within Design District 2 of the City Center Design Review Overlay District.
2. The application was received on January 29, 2009.
4. The owner of record of the subject property is Eli Lesser -Goldsmith
5. The subject property is located in the CD1 Zoning District.
6. The plan submitted is entitled "Malone Propertes Healthy Living Natural Foods
Market, 222 Dorset Street Renovations, South Burlington, Vermont.," prepared by A.
Ginsburg Architects, dated April 2, 2007, last revised on January 22, 2009.
7. The applicant is proposing to install a new roof vent to service a new range hood in
the cooking classroom. The applicant has been working with staff to install the roof vent
in a manner that will be accessible, yet properly concealed as it sits very closely to the
Dorset Street right of way.
8. The applicant has submitted a drawing which includes five potted evergreen shrubs.
The applicant has also submitted a detailed cut sheet of the shrub, arborvitae, specified
to be at least 2 feet wide and 3.5 feet tall.
9. The full set of standards for review are not included as the request is fairly basic and
the only applicable standards are related to aesthetics.

DECISION

approve Design Review Applicat on #DR-09-01 of Eli Lesser -Goldsmith subject to the
following conditions:
1. All previous approvals and stipulations which are not superseded by this approval
shall remain in effect.
2. This project shall be completed as shown on the plans submitted by the applicant and
on file in the South Burlington Department of Planning and Zoning.
4. The applicant shall obtain a zoning permit within six (6) months pursuant to Section
17.04 of the Land Development Regulations or this approval is null and void.
5. Any change to the plans shall require approval by the South Burlington Development
Review Board or the Administrative Officer.
