HomeMy WebLinkAboutSP-09-15 - Decision - 0222 Dorset Street#SP-09-15 CITY OF SOUTH BURLINGTON DEPARTMENT OF PLANNING AND ZONING ELI LESSER -GOLDSMITH - 222 DORSET STREET SITE PLAN APPLICATION #SP-09-15 FINDINGS OF FACT AND DECISION Eli Lesser -Goldsmith, hereafter referred to as the applicant, is seeking approval for a site plan to amend a previously approved plan for 33,733 sq. ft. office building with 31,951 sq. ft. (including mezzanine) of retail food establishment use and 2,382 sq.ft. of short- order restaurant use. The amendment consists of extending the expiration date for storage of construction materials, 222 Dorset Street. The Development Review Board held a public hearing on March 3, 2009. The applicant was represented by Katy Lesser. Based on testimony provided at the above mentioned public hearing and the plans and supporting materials contained in the document file for this application, the Development Review Board finds, concludes, and decides the following: FINDINGS OF FACT 1. The applicant is seeking approval for a site plan to amend a previously approved plan for 33,733 sq. ft. office building with 31,951 sq. ft. (including mezzanine) of retail food establishment use and 2,382 sq.ft. of short-order restaurant use. The amendment consists of extending the expiration date for storage of construction materials, 222 Dorset Street. 2. The application was received on February 10, 2009. 4. The owner of record of the subject property is Patrick Malone 5. The subject property is located in the Central District 1 Zoning District. 6. No additional plans were submitted. The applicant received approval on August 19, 2008 (#SP-08-67) to temporarily store bollards to the east of the building as a result of ongoing construction. These bollards were approved as part of the same August decision to be used for parking stops on site. However, given the timing of the previous application at the end of the construction season, the site's parking lot has not received a final coat of asphalt or related striping. It would be impractical to install the bollards before the parking area is complete. Given these limitations, the Board supports a six month extension of the storage of these bollards. This should provide ample time to finish the parking area. This storage shall be limited to the bollards. All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2. This project shall be completed as shown on the plans submitted by the applicant and on file in the south Burlington Department of Planning and Zoning. 3. The temporary storage area proposed to the east of the building shall be limited to the parking bollards and shall expire after six months from the date of this approval. 4. Any change to the site plan shall require approval by the South Burlington Development Review Board or the Administrative Officer.
