HomeMy WebLinkAboutSP-07-27 - Decision - 0196 Dorset Street#S P-07-27 CITY OF SOUTH BURLINGTON DEPARTMENT OF PLANNING AND ZONING LAWRENCE STEVENS — 196 DORSET STREET SITE PLAN APPLICATION #SP-07-27 FINDINGS OF FACT AND DECISION Lawrence Stevens, hereafter referred to as the applicant, is seeking approval to convert 80 sq. ft. of a single family dwelling into office use, 196 Dorset Street. The Development Review Board held a public hearing on Tuesday June 5, 2007. The applicant was present at the meeting. Based on testimony provided at the above mentioned public hearing and the plans and supporting materials contained in the document file for this application, the Development Review Board finds, concludes, and decides the following. - FINDINGS OF FACT 1. The applicant is seeking approval to convert 80 sq. ft. of a single family dwelling into office use, 196 Dorset Street. 2. The owner of record of the subject property is Patrick Malone. 3. The subject property is located in the Central District 1 (CD1) Zoning District. 4. The plan submitted is entitled, "Plot Plan 196 Dorset Street", prepared by D. Forgays, and dated 4/25/07. Zoning District & Dimensional Requirements: The general intent of the building setbacks in the Central District is to require all buildings to front on to public streets and to require that parking facilities are located in the center of the blocks to the greatest extent practicable, occupy only minimal frontage on public streets, and are thoroughly screened from view from public streets and rights -of -way. This criterion is generally met. Parking The applicant is proposing to convert 80 square feet of the existing 928 square feet singly family dwelling to office use. 848 square feet will remain as residential use. The site will require three (3) parking spaces. Space for four (4) vehicles are provided. The parking spaces are of adequate width. However, at least one space should be marked for handicapped parking with an accessible aisle of at least 5 feet. 23 feet will be needed to provide for two parking spaces and an accessible aisle. Only 21 feet are - 1 - #SP-07-27 provided. The plan should be revised to show adequate parking width for two parking spaces and one five foot accessible aisle. Other The applicant is depicting a bicycle rack and snow storage areas. Design Review Overlay District -Zone 1 Additionally, the Board should consider if the application shall be subject to Section 11.01(D)(1)(g) of the Land Development Regulatons which states that "for applications involving a change of use with no construction, relocation, enlargement or alteration subject to review, other than a change of use, the Development Review Board may require design improvement in accordance with these regulations to the exterior of the building, the costs of which do not exceed $7,000 or 10% of the assessed value of the building, whichever is greater." The Design Review Committee discussed this issue at its meeting on May 21, 2007 and unanimously agreed that the applicant should be required only to paint the building at this time. The Board understands that the applicant has already painted the building. /� DECISION Motion by ���� ��(� 06WJ� seconded by A�,���/�L� to approve Site Plan Application #SP-07-27 of Lawrence Stevens, subject to the following conditions: 1) All previous approvals and stipulations which are not superseded by this application shall remain in effect. 2) This project shall be completed as shown on the plans submitted by the applicant and on file in the South Burlington Department of Planning and Zoning. 3) The plan shall be revised to show the changes below and shall require approval of the Administrative Officer. Three (3) copies of the approved revised plans shall be submitted to the Administrative Officer prior to permit issuance. a) The site plan shall be revised to show adequate width for the required parking spaces in conformance with Table 13-8 of the South Burlington Land Development Regulations, including a five foot wide handicapped accessible aisle. 4) The applicant shall obtain a zoning permit within (6) months pursuant to Section 17.04 of the Land Development Regulations or this approval is null and void. 5) The applicant shall obtain a Certificate of Occupancy/Compliance from the Administrative Officer prior to using the building for general office use. -2- #S P-07-27 6) Any change to the site plan shall require approval by the South Burlington Development Review Board or the Administrative Officer. However, the master sign permit considered herein is limited to overall design criteria. The code officer shall ensure that these criteria are met when issuing individual sign permits for the property. Section 9(h) states that free-standing signs in the Dorset Street/City Center District may not exceed thirty-two (32) square feet in overall dimensions and may be no higher than twelve (12) feet, measured from the average finished grade at the base of the sign to the highest point of any part of the sign structure. The proposed freestanding sign is in compliance with this requirement. However, the master sign permit considered herein is limited to overall design criteria. The code officer shall ensure that these criteria are met when issuing individual sign permits for the property. This project shall be completed as shown on the plans submitted by the applicant and on file in the South Burlington Department of Planning and Zoning. 3. A Master Signage Permit shall be issued for the property at 196 Dorset Street by the DRB, prior to the issuance of any individual sign permit for the property. 4. The applicant shall obtain a sign permit before the sign is erected. 5. All free standing signs shall be composed of aluminite. The post materials shall be either aluminum or shall be painted white wood. 6. All signs on the property shall be limited to a white background with blue lettering and flesh toned graphics. 7. Lighting shall be limited to ground spot lighting. In no case shall such lighting obstruct or distract pedestrian or vehicular traffic. 8. The applicant shall ensure continued landscaping of the base of the freestanding sign. Landscaping surrounding the freestanding signs shall be kept trimmed and neat and shall not obscure the text of the signs. 9. All signs shall be kept in good repair; #DR-07-03 10. Any change to the site plan shall require approval by the South Burlington Department of Planning and Zoning or the Administrative Officer.
