DESIGN REVIEW APPLICATION #DR-14-09
200 DORSET STREET, 59 GARDEN STREET AND 222 DORSET STREET
Design review application #DR-14-09 of Malone Dorset Street Properties, LLC for after -the -fact
approval of architectural alterations to both buildings and proposed alterations to paint vent stacks,
200 & 222 Dorset Street and 59 Garden Street.
The Development Review Board held a public hearing on October 7, 2014. Paul Simon represented
the applicant.
Based on testimony provided at the above mentioned public hearing and the plans and supporting
materials contained in the document file for this application, the Development Review Board finds,
concludes, and decides the following:
FINDINGS OF FACT
1. The applicant seeks after -the -fact approval of architectural alterations to both buildings and
proposed alterations to paint vent stacks, 200 & 222 Dorset Street and 59 Garden Street.
2. The application was received on September 15, 2014.
3. The owner of record of the subject property is Malone Dorset Street Properties, LLC.
4. The subject property is located in Design District 1 of the City Center Design Review Overlay
Districts.
5. The plan submitted is a two (2) page set of plans, page one (1) is entitled, "Trader Joe's
Building — Elevations", dated May 8, 2014, and prepared by Freeman -French -Freeman
architects.
6. The below listed changes were made without DRB approval and consequently were not issued
a Certificate of Occupancy. This application is to bring the buildings into compliance.
Trader Joe's (200 Dorset Street):
---the installation of exhaust pipes, Knox Box, Strobe, two service light fixtures, key box,
security light, fire department connection and an intake vent.
---Also, the plans do not show electric and gas meters.
---The applicant is also seeking approval to add bollards near the northwest corner of
the building.

Pier 1 (59 Garden Street):
---the installation of Knox Box, Strobe, two security lights, a security sensor, an exhaust
vent, a fire department connection and an equipment vent.
---Also, the plans do not show electric and gas meters nor hose bib locations.
---Finally, the south window was removed and the soldier brick course is missing on the
east elevation.
7. The applicant also sought approval to:
Trader Joe's (200 Dorset Street):
---to paint three stainless steel vent pipes a charcoal color to match the building's
exterior trim work.
Healthy Living (222 Dorset Street):
---to paint a ventilation stack pipe a rust color to match the building's rooftop screening
and railing.
DESIGN REVIEW CRITERIA
Pursuant to Section 11.01 F of the Land Development Regulations, the proposed project shall
meet the following standards:
(1) Building Design
(a) Consistent design. Building design shall promote a consistent organization of
major elements; and decorative parts must relate to the character of the design. All
sides of a building shall be designed so that they are compatible in terms of material,
window treatments, architectural accents, cornice/parapet design, etc. In Design
Districts 1 and 3, the design of a building should consider the design features of other
structures in the area so as not to be harshly discordinate with other nearby buildings.
The Board finds that design for the east elevation of the Pier 1 building is incompatible
with the other sides of the building due to the removal of a window. The applicant is
directed to install the window as was originally approved by the Board.
The Board finds that the applicant is not required to install a soldier course along the
east side of the building.
(b) Materials used. High quality, attractive materials shall be used on all
buildings. Natural, indigenous materials of stone and masonry are highly encouraged,
if not required. Specific requirements for each Design District are as follows....

(c) Colors and textures used. The color and texture of the building shall be
harmonious with the building itself and with other buildings on the site and nearby.
Colors naturally occurring from building materials and other traditional, subdued
colors are encouraged. More than three (3) predominant colors are discouraged.

(d) Windows and doors. Window and door treatment (i.e., the arrangement of
windows and doors into a pattern) shall be a careful response to the buildings interior
organization as well as the features of the building site. The treatment of windows
and doors shall be in a manner that creates a rhythm that gives necessary order and
unity to the facade, yet avoids monotony. In Design Districts 1 and 2, for sides of
buildings that front or face a public street, existing or planned, the majority of the first
floor's facade area shall consist of see -through glass in order to promote pedestrian
activity, however, the windows and/or doors should be of a human scale so as to
welcome, not overwhelm, the pedestrian.

(e) Use of "human -scaled" design elements. Larger buildings shall incorporate the
use of design elements, such as pilasters, colored or textured bands, or window and
door treatments, in order to reduce the larger building's apparent overall size and,
therefore, avoid a large or long monotonous appearance.
(f) Roofs as a design element.

(g) Orient buildings to the public street.

(h) Conceal rooftop devices. Rooftop mechanical equipment and appurtenances to
be used in the operation or maintenance of a structure shall be arranged so as to
minimize visibility from any point at or below the roof level of the subject structure.
Such features, in excess of one foot in height, shall be either enclosed by outer building
walls or parapets, or grouped and screened in a suitable manner, or designed in
themselves so that they are balanced and integrated with respect to the design and
materials of the building.
The Board finds that the three installed ventilation pipes at Trader Joe's and the one
ventilation pipe at Healthy Living are balanced and integrated with respect to the design
and materials of the building. The Board finds that these should remain as unpainted
stainless steel with no screening requirement. This decision supersedes a previous
requirement to screen the vent pipe at 222 Dorset Street with trees.
(i) Promote energy efficiency.

11.02 Site Design for City Center Design Review District
B. Integrate special features with the design. Storage areas, machinery and
equipment installation, service areas, truck loading areas, garbage and refuse
collection areas, utility connections, meters and structures, mailboxes, and similar
accessory structures shall be positioned in such a way to minimize visibility from the
public street, existing or planned. Such features shall be incorporated within or
designed as part of the building on the site, not added as an afterthought. HVAC

equipment should not be pad mounted at grade. Utility connections shall be installed
underground and utilities shall co -exist to the greatest extent possible.
With regards to the requested after -the -fact modifications at Trader Joe's noted above,
the Board finds them acceptable but also finds that additional minor improvements are
needed to minimize visibility from the street.
Specifically, the Board finds that the installation of exhaust pipes, Knox Box, Strobe, two
service light fixtures, key box, security light, fire department connection and an intake
vent are consistent with the original design approval for the building, and consistent
with these design standards.
The Board also finds that the applicant shall add the proposed bollards near the
northwest corner of the building.
Additionally, the Board finds that the gas piping and gas meter on the northwest corner
of the building shall be painted to match the color of the siding and that the gas
regulator shall be moved to the north side of the building so that it does not face Dorset
Street. Additionally, the Board finds that the gas metering shall be screened from view
from Dorset Street with a fence similar to the fence surrounding the service area.
With regards to the requested after -the -fact modifications at Pier 1, specifically, the
Board finds that the installation of Knox Box, Strobe, two security lights, a security
sensor, an exhaust vent, a fire department connection and an equipment vent are
consistent with the original design approval for the building, and consistent with these
design standards.
The Board also finds that to minimize visibility from the street the gas piping along the
bottom of the east wall shall be painted the same color as the siding.
The Board finds that the applicant shall revised the plans to show electric and gas
meters at Trader Joe's and to show electric and gas meters and hose bib locations at
Pier 1.

Motion by Bill Miller, seconded by Jennifer Smith, to approve Design Review application #DR-14-
09 of Patrick Malone subject to the following conditions:
1. All previous approvals and stipulations which are not superseded by this approval shall
remain in effect.
2. The vent pipes on both the 200 & 222 Dorset Street buildings are not to be painted but left
in their metallic color.

3. The plans shall be revised to show the changes below and shall require approval of the
Administrative Officer. Three (3) copies of the approved revised plans shall be submitted to
the Administrative Officer prior to permit issuance. The plans shall be revised to show:
a. For Trader's Joe's (200 Dorset Street), the installation of the bollards, the
alteration of the gas regulator location, the painting, to match the background
color, and screening of the gas meter and piping and the final location of gas
meters and electric meters.
b. For Pier 1(59 Garden Street), the installation of the originally proposed window
along the east side of the building, the painting of the gas meter and piping
along the bottom of the east wall to match the color of the background and the
final location of gas meters and electric meters and hose bib locations.
4. The applicant shall obtain a zoning permit within six (6) months pursuant to Section 17.04 of
the Land Development Regulations or this approval is null and void.
5. The applicant shall obtain a Certificate of Occupancy from the Administrative Officer prior to
use or occupancy of the approved building modifications.
6. Any further change to the architectural or site plans shall require approval by the South
Burlington Development Review Board or the Administrative Officer.
