Findinas of Fact, Conclusions of Law& Order
This matter came before the South Burlington Zoning Board of Adjustment on November 23, 1998 by
application of the National Weather Service, Robert Bell agent, also Robert McEwing, Airport Engineer
for installation of a thirteen (13) foot satellite dish at a height of thirty nine feet seven inches (39.7) on
the Airport Terminal, 1200 Airport Drive according to plans submitted. The Board of Adjustment finds
as follows:
I ) Area in question is zoned Airport District.
2) Section 25.113 Height of structures (flat roof structures) allows a maximum height of thirty-five
(35) feet. Antennas and communication towers which exceed the maximum height require
conditional use approval.
3) The proposed satellite dish is for receiving only, therefore, no transmitting to interfere with
aircraft.
4) This equipment also provides information to aircraft regarding weather conditions.
5) Evidence presented demonstrates that the proposed satellite will not be visible and in all other
aspects creates no adverse affects.
6) No adverse impacts on municipal facilities, highway or other bylaws in effect.
