Re: Findings of Fact, application of University Mall Realty
Trust, c/o Finard Company for removal of three buildings (4200
square feet and 750 square feet in the Mall building) and con-
struction of a new 5,000 square foot building for retail use,
revision to the approved footprint of the main University Mall
building, and change in parking layout and circulation on the
University Mall property, Dorset Street.
On the 19th of February 1991, the South Burlington Planning
Commission approved the application of University Mall Realty
Trust, c/o Finard Company for preliminary plat approval under
Section 203 of the South Burlington Subdivision Regulations based
on the following findings:
1. This project consists of the construction of a 5,000 square
foot building for retail use on the so-called Gleason parcel.
This parcel presently has three (3) buildings which will be razed
prior to construction of the new building. This application also
involves revising the footprint of the U-Mall building. The
originally approved project allows a third department store to
be added to the building. The applicant is proposing to revise
the footprint of the department store addition. Square footage
would remain the same. This project also involves converting 750
square feet of leasable area in the U-Mall building to non -
leasable use (e.g., mechanical space).
2. This property is located in the Commercial 1 district and is
bounded on the north by a beauty salon, on the south by Jane &
Jacob Real Estate office, on the east by Dorset Street and on the
west by the Howard Bank and U-Mall parking.
3. Sketch plan was reviewed on December 11, 1990.
4. Access/circulation: Access to the building will be via the
two (2) main entrances to U-Mall and internal access drives.
There will be no curb cuts for this property from Dorset Street.
Internal traffic circulation pattern is acceptable.
5. Parking: Parking requirements for the U-Mall are calculated
at 5.3 spaces per 1,000 square feet of gross leasable area. On
this basis, the 5,000 square foot retail store will require an
additional 27 parking spaces. At Phase II build -out there will
be 2460 spaces plus the 27 spaces for this project to equal a
total of 2487 spaces. 346 compact spaces were previously ap-
proved and the plan shows 344 compact spaces or 13.8% of all
spaces.
Parking stall dimensions meet minimum requirements. The aisle
serving the double row of parking spaces on the westerly side of
the new building appears to be only 22 feet wide (the requirement
is 24 feet).
6. Setbacks/coverage: The proposed 5,000 square foot retail
building is proposed to be 10 feet from the new Dorset Street
r.o.w. line. The required setback is 50 feet. Under the PCD
provisions, the Planning Commission can modify the setback re-
quirements to allow the building at this location. The revised
department store addition will meet the setback requirement.
Building coverage will be 25.9% (maximum allowed is 30%). Over-
all coverage will be 70% (maximum allowed is 70%).
7. Landscaping: The landscaping requirement for the project is
$5550.00 and this will be met by the applicant. Additional land-
scaping will be planted adjacent to the northerly access to U-
Mall and around the new department store.
8. Lighting: The new building will have attached lights which
will be down -lit sharp cut-off wall pack type fixtures.
9. Sewer: The sewer allocation for this project is 80 gpd. A
$2.50 per gallon sewer allocation fee must be paid prior to per-
mit.
10. Traffic: The TRANS/OP traffic report dated February 4, 1991
indicates that since this project will result in a net retail
square footage increase of 50 square feet, only .4 to 0 addition-
al trips are expected during the P.M. peak hour.
11. Maurice Paquette, an abutting landowner, has an easement
with the applicant for ingress and egress onto the applicant's
property which is to take effect once Dorset Street is recon-
structed.
DECISION & CONDITIONS
Based upon the above Findings of Fact, the South Burlington
Planning Commission approves the Preliminary Plat application of
University Mall Realty Trust, c/o Finard Company for removal of
three buildings (4200 square feet and 750 square feet in the Mall
building) and construction of a new 5,000 square foot building
for retail use, revision to the approved footprint of the main
University Mall building, and change in parking layout and circu-
lation on the University Mall property , Dorset Street as depict-
ed on a 5 page set of plans, page one entitled "Site Plan, Glea-
son Parcel, University Mall, Dorset Street, South Burlington,
Vermont" prepared by Pinkham Engineering Associates, Inc. and
dated 11/12/90, last revised 1/15/91, with the following stipula-
tions:
1. Abandoned sewer services shall be capped with a manufactured
cap.
2. The applicant shall post a $5,550 3-year landscaping bond
prior to permit.
3. A sewer allocation of 80 gpd is granted for this project. A
$2.50 per gallon sewer allocation fee shall be paid prior to
permit.
4. The Commission approves 27 parking spaces for the 5,000
square foot retail building. This is based on 5.3 spaces per
1,000 square feet of gross leasable area.
5. Prior to Final Plat the survey plat shall be revised to show
the new Dorset Street right-of-way and the existing buildings as
presently constructed. The survey plat shall be stamped and
signed by a licensed surveyor.
6. The aisle serving the double row of parking spaces on the
westerly side of the new building shall be 24 feet in width
and this shall be shown on the final plans.
7. The Commission waives the 50 foot front yard setback require-
ment pursuant to Section 11.507 of the zoning regulations. The
Commission approves the new building with a 10 foot setback from
the new Dorset Street right-of-way.
8. The plans shall be revised prior to final plat to show 20
foot wide aisles for the existing compact car rows on the south-
erly side of Steinbach's.
9. The applicant shall submit plans to CCTA for review and com-
ments prior to Final Plat.
10. The plan shall be revised prior to final plat to show the
Paquette easement for future access over the University Mall
property.
11. The Final Plat shall be submitted within 12 months or this
approval is null and void.
