HomeMy WebLinkAboutSP-91-0001 - Decision - 0155 Dorset StreetFINDINGS OF FACT & DECISION STATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON Re: Findings of Fact, application of University Mall Realty Trust, c/o Finard Company for removal of three buildings (4200 square feet and 750 square feet in the Mall building) and con- struction of a new 5,000 square foot building for retail use, revision to the approved footprint of the main University Mall building, and change in parking layout and circulation on the University Mall property, Dorset Street. On the 24th of September, 1991, the South Burlington Planning Commission approved the application of University Mall Realty Trust, c/o Finard Company for Final Plat approval under Section 204 of the South Burlington Subdivision Regulations based on the following findings: 1. This project consists of the construction of a new 5,000 square foot building for retail use on the so-called Gleason parcel. This parcel presently has three (3) buildings which will be razed prior to construction of the new building. This appli- cation also involves revising the footprint of the U-Mall build- ing. The originally approved project allows a third department store to be added to the building. The applicant is proposing to revise the footprint of the department store addition. Square footage would remain the same. This project also involves con- verting 750 square feet of leasable area in the U-Mall building to non -leasable use (e.g., mechanical space). 2. The Gleason property is located in the Commercial 1 District and is bounded on the north by a beauty salon, on the south by Jane & Jacob Real Estate office, on the east by Dorset Street and on the west by the Howard Bank and U-Mall parking. 3. Preliminary Plat approval was granted on February 19, 1991. 4. Access/circulation: Access to the building will be via the two (2) main entrances to U-Mall and internal access drive. There will be no curb cuts for this property from Dorset Street. 5. Parking: Parking requirements for the U-Mall are calculated at 5.3 spaces per 1,000 square feet of gross leasable area. On this basis, the 5,000 square foot retail store will require an additional 27 parking spaces. At Phase II build -out there will be 2452 spaces plus the 27 spaces for this project to equal a total of 2479 spaces. 346 compact spaces were previously ap- proved and the plan shows 344 compact spaces or 13.8% of all spaces. Parking stall and aisle width requirements meet minimum requirements. Eight (8) parking spaces were lost as a result of the improvements for CCTA and the Paquette easement. 6. Setbacks/coverage: The proposed 5,000 square foot retail building will be 10 feet from the new Dorset Street right -of way. This reduced setback was approved by the Planning Commission at preliminary plat approval. Building coverage will be 25.9% (maximum allowed is 30%). Over- all coverage will be 70% (Maximum allowed is 70%). 7. Landscaping: The landscaping requirement for the project is $5550.00 and this will be met by the applicant. Additional landscaping will be planted adjacent to the northerly access to U-Mall and around the new department store. 8. Lighting: The new building will have attached lights which will be down -lit sharp cut-off wall pack type fixtures. 9. Sewer: The sewer allocation for this project is 80 gpd. A $2.50 gallon sewer allocation fee must be paid prior to permit. 10. Traffic: The TRANS/OP -traffic report dated February 4, 1991 indicates that since this project will result in a net retail square footage increase of 50 square feet, only .4 to 0 addition- al trips are expected during the P.M. peak hour. Maurice Paquette, an abutting landowner, has an easement with the applicant for ingress and egress onto the applicant's property which is to take effect once Dorset Street is reconstructed. This easement is referred to in note #7 on sheet 2 of 2. DECISION & CONDITIONS Based on the above Findings of Fact, the South Burlington Plan- ning Commission approves the revised final plat application of University Mall Realty Trust for: 1) removal of three buildings and construction of a new 5,000 square foot building for retail use, (2) revision to the approved footprint of the main Univer- sity Mall building, and (3) change in parking layout and circula- tion on the University Mall property as depicted on a two (2) page survey plat entitled "Survey Plat, University Mall, Dorset Street, South Burlington, Vermont," prepared by Pinkham Engineer- ing and dated 8/13/91, and a five (5) page set of engineering drawings, page one entitled, "Site Plan, University Mall, Dorset Street, South Burlington, Vermont", prepared by Pinkham Engineer- ing and dated 11/12/90, last revised 9/20/91, with the following stipulations: 1. Abandoned sewer services shall be capped with a manufactured cap. 2. The applicant shall post a $5,550, 3-year landscaping bond prior to permit. 3. A sewer allocation of 80 gpd is granted for this project. A $2.50 per gallon sewer allocation fee shall be paid prior to permit. 4. The Commission approves 27 parking spaces for this 5,000 square foot retail building. This is based on 5.3 spaces per 1,000 square feet of gross leasable area. 5. The Commission waives the 50 foot front yard setback require- ments pursuant to Section 11.507 of the zoning regulations. The Commission approves the new building with a 10 foot setback from the new Dorset Street right-of-way. 6. All site lighting shall be downcasting, shielded lumanaire and shall not cast light beyond the property line. 7. In order to improve the appearance of the main entrance drive (north entrance) and be consistent with the aesthtetic quality of the Dorset Street improvement project, the plan shall be revised prior to recording to show 18 spaces removed in the parking area immediately south of the entrance drive and the area converted to landscaped green space. The 18 spaces shall be moved to the area behind the Paquette property. This change shall be approved by the Planner. 8. Sheet 1 of the engineering plans shall be revised to indicate a total of 2479 parking spaces. This reflects the 8 spaces lost to the new CCTA bus route. 9. The Revised final plat and engineering drawings shall be recorded in the South Burlington land records within 90 days or this approval is null and void. Chairman oZr'!
