Re: Findings of Fact, revised final plat application of University
Mall Realty Trust for: 1) change in parking and circulation, and
2) boundary line adjustment involving 1,300 square feet of land
between University Mall Realty Trust and Peter and Vilma Jacob.
On the 28th of April, 1992 the South Burlington Planning Commission
approved the request of University Mall Realty Trust for revised
final plat under Section 204 of the South Burlington Subdivision
Regulations based on the following findings:
1. This revised final plat amendment is for a boundary line
adjustment between U-Mall and Peter and Vilma Jacob. U-Mall
proposes to transfer to Mr. & Mrs. Jacob a .16 acre parcel
adjoining their property to the north and west. Mr. & Mrs. Jacob
propose to transfer a .13 acre parcel which serves as the southerly
entrance to the mall to U-Mall. This amendment is to also make
some parking and circulation changes in front of the new J.C.
Penney building.
2. Access/circulation: There will be no access or circulation
changes as a result of the boundary adjustment.
3. Circulation will be changed due to the revised parking layout
in front of the J.C. Penney building. The primary purpose for the
change is to improve pedestrian access through the parking lot.
The Fire Chief has requested that the access drive in front of
Steinbach's be opened to facilitate emergency access and the
applicant has revised the plans accordingly. This access is 13
feet wide. The applicant has indicated that this drive will be
blocked with a movable barricade.
4. Coverage/setbacks for U-Mall property: Building coverage is
26% (maximum allowed is 30%. Overall coverage is 69.8% (maximum
allowed is 70%).
5. Coverage/setbacks for Jacob property: Current coverage
percentages for the Jacob property will not be affected by this
land swap since the parcels being exchanged are almost identical in
size.
6. The building on the Jacob property currently meets the side
yard setback of 15 feet along the southerly boundary. This
proposal will reduce this setback to only three (3) feet. This
reduction is prohibited under Section 18.114 of the zoning
regulations. However, the Planning Commission may modify this
setback requirement under Section 11.507 of the zoning regulations
since this adjustment is associated with the U-Mall PCD.
7. Frontage: The Jacob property currently has 131.68 feet of
frontage along Dorset Street and this proposal will reduce the
frontage to 126.9 feet. The minimum frontage requirement is 200
feet. The Planning Commission may modify this requirement under
Section 11.507 of the zoning regulations since this is associated
with the U-Mall PCD.
8. Parking: The revised parking changes and the opening of the
access drive in front of Steinbach's result in the loss of seven
(7) parking spaces overall. Total parking provided is now 2468
spaces. Compact car spaces have been reduced from 346 spaces to
329 spaces. This impact of 7 fewer spaces will be negligible.
9. All parking stall dimensions and aisle width requirements are
being met.
DECISION & CONDITIONS
Based on the above Findings of Fact, the Planning Commission
approves the revised final plat application of University Mall
Realty Trust for: 1) change in parking and circulation, and 2)
boundary line adjustment involving 1,300 square feet of land as
depicted on a two (2) page plat, page one entitled "Survey Plat,
University Mall, Dorset Street, South Burlington, Vermont",
prepared by Pinkham Engineering Associates and dated 8/13/91, last
revised 4/1/92, and a two (2) page set of engineering plans, page
one entitled "Site Plan, University Mall, Dorset Street, South
Burlington, Vermont", prepared by Pinkham Engineering Associates
and dated 11/12/90, last revised 3/20/92, with the following
stipulations:
1. All previous approvals and stipulations not superseded by this
approval shall remain in effect.
2. As expressly represented by the applicant, a movable barrier
shall be installed in the 13 foot wide access near Steinbach. The
type and appearance of the barrier shall be approved by the City
Planner and Fire Chief prior to installation.
3. The revised final plat and engineering drawings shall be
recorded in the South Burlington land records within 90 days or
this approval is null and void.
