Re: Findings of Fact, application of University Mall Realty Trust
for reapproval to construct a new 5,000 square foot building for
retail use on the former "Gleason Parcel", University Mall, Dorset
Street.
On the 29th of November, 1994, the South Burlington Planning
Commission approved the request of University Mall Realty Trust for
revised final plat approval under Section 204 of the South
Burlington Subdivision Regulations based on the following findings:
1. This project consists of the following: 1) reapproval of a
5,000 square foot retail building on the so-called Gleason parcel
and, 2 ) approval for temporary green space at the proposed location
of the retail building until such time as it is constructed. The
5,000 square foot building was approved on 9/24/91 and its approval
expired on 9/24/94. This application is to comply with condition
#4 of the 8/10/93 approval which required the applicant to submit
a plan showing the "permanent use" of this portion of the U-Mall
property. The sketch plan was reviewed on October 11, 1994
2. This property, located on the west side of Dorset Street in
between the Janes & Jacobs building and Paquette's hair salon, lies
within the Cl District.
3. Access/circulation: Access to the site is via internal access
drives on the U-Mall property. No changes proposed.
Circulation is adequate.
4. Parking: The entire U-Mall property without the 5,000 square
foot building requires 2,699 parking spaces and with the building
requires 2,727 spaces. The temporary green space design will
result in 2,779 spaces available and 2763 spaces available with the
5,000 square foot building. In either case, there will be
sufficient parking. Sheets 2 and 3 should be revised to increase
the length of the parallel parking spaces to 22 feet.
5. Landscaping: The minimum landscaping requirement, based on
building costs, for the 5,000 square foot building is $5,550 which
is being met. The value of the landscaping for the temporary green
space design is $5190. When the retail building is constructed an
additional $1290 of landscaping will be planted for a total value
of $6480. All landscaping shown on sheet 2 of 3 should be planted
as part of the temporary green space phase.
6. Coverage/setbacks: Temporary green space design: Building

coverage is 23.8% (maximum allowed is 30%). Overall coverage is
69.6% (maximum allowed is 70%). Retail building design: Building
coverage is 24.0% (maximum allowed is 30%). Overall coverage is
69.7% (maximum allowed is 70%).
The retail building was previously approved to be 10 feet from the
Dorset Street r.o.w. No change proposed.
7. Sewer: The sewer allocation for the retail building is 80 gpd.
The applicant will be required to pay the per gallon fee prior to
permit.
8. Traffic: The TRANS/OP traffic report dated 2/4/91 indicated
that the proposed retail building would result in a net retail
square footage increase of 50 square feet due to the loss of
several buildings that were previously on the site. This results
in 0.4 to 0 additional trip ends during the P.M. peak hour.
9. Lighting: The retail building will have attached lights which
will be downcasting sharp cut-off wall pack type fixtures. Details
of these lights should be reviewed and approved by the City Planner
prior to issuance of a zoning/building permit for the building. No
lights are proposed as part of the temporary green space design.
10. Approval expiration: The applicant is requesting that this
approval be valid for five (5) years. Section 605 of the
subdivision regulations allows a Planning Commission approval to
remain in effect for a maximum of three (3) years. This approval
may be extended for up to two (2) additional years under certain
conditions.
DECISION & CONDITIONS
Based on the above Findings of Fact, the South Burlington Planning
Commission approves the revised final plat application of
University Mall Realty Trust for reapproval to construct a new
5,000 square foot building for retail use on the former "Gleason
Parcel", University Mall, Dorset Street. The proposal includes
changes to parking and landscaping in the vicinity of the new
building and a plan depicting proposed site conditions until such
time as the new building is constructed, as depicted on a three (3)
page set of plans, page one entitled "Overall Site Plan, University
Mall, Dorset Street, South Burlington", prepared by Pinkham
Engineering Associates, Inc., dated 9/15/94, last revised 11/15/94,
with the following stipulations:
1. All previous approvals and stipulations which are not
superseded by this approval shall remain in effect.
2. The final plat plans shall be revised as follows:

a. Sheets 2 and 3 shall be revised to increase the length of
parallel parking spaces to 22 feet.
3. The applicant shall post a $5190 landscape bond prior to
issuance of a zoning permit for the interim improvements shown on
Sheet 2 of 3. The bond shall remain in effect for three (3) years
to assure that the landscaping takes root and has a good chance of
surviving. All landscaping shown on sheet 2 of 3 shall be planted
as part of the interim improvement phase.
4. A sewer allocation of 80 gpd is approved. The applicant shall
pay the per gallon fee prior to the issuance of a zoning permit for
the retail building.
5. Any new exterior lighting or change in existing lighting shall
consist of downcasting shielded fixtures so as not to cast light
beyond the property line. Details of the building mounted lights
shall be reviewed and approved by the City Planner prior to the
issuance of a zoning permit for the retail building.
6. The final plat plans shall be recorded in the land records
within 90 days or this approval is null and void. The plan shall
be signed by the Planning Commission Chair or Clerk prior to
recording.
7. The interim improvements shown on Sheet 2 of 3 shall be
completed by May 1, 1995.
8. A zoning permit for the new retail building shall be obtained
within 3 years or the approval for the retail building shall be
null and void.
9. The applicant shall obtain a Certificate of
Occupancy/Compliance from the Administrative Officer prior to
occupancy of the new building.
10. Any change to the final plat plans shall require Planning
Commission approval.
