HomeMy WebLinkAboutSP-94-0000 - Decision - 0155 Dorset StreetFINDINGS OF FACT & DECISION STATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON Re: Findings of Fact, application of University Mall Reatly Trust for construction of a 1,097 square foot addition to the University Mall building, University Mall, 155 Dorset Street. On the loth of May, 1994 the South Burlington Planning Commission approved the request of University Mall Realty Trust for revised final plat approval under Section 204 of the South Burlington Subdivision Regulations based on the following findings: 1. The project consists of the construction of 1,097 square foot addition to the existing mall building. The sketch plan review was held on 3/8/94. This addition plus 4,149 square feet within the existing mall building is proposed to be used for a 154 seat standard restaurant. 2. Access/circulation: No changes proposed. 3. Coverage/setbacks: Building coverage is 24% (maximum allowed is 30%). Overall coverage is 69.8% (maximum allowed is 70%). Setback requirements are met. 4. Landscaping: The minimum landscaping requirement, based on building costs, is $1650 which is not being met. The proposed plantings, which include Juniper and Cranberrybush are $1400 short of the requirement. The plan should be revised to show additional landscaping in the green strip located between the Chittenden Bank drive -through area and the 14 space U-Mall parking area. Any plantings which do not fit in this area should be placed behind the mall building adjacent to the interstate r.o.w. A revised plan should be submitted showing these changes. 5. Parking: The minimum parking requirement based on gross leasable area is 2,726 parking spaces and 2,771 spaces are being provided. This is 45 spaces more than is required. 6. Traffic: ITE estimates that this addition will generate 3.6 additional vehicle trip ends during the P.M. peak hour. The applicant will be required to contribute $449 to the Williston Road Traffic Impact Fund - Area 1 based on the 3.6 additional vehicle trip ends expected to be generated by this project. 7. Lighting: Details of any additional exterior lighting should be submitted for review and approval by the City Planner. 1 8. Sewer: The additional sewer allocation needed is 409 gpd. The applicant will be required to pay the per gallon fee prior to permit. DECISION & CONDITIONS Based on the above Findings of Fact, the South Burlington Planning Commission approves the revised final plat application of University Mall Realty Trust for construction of a 1,097 square foot addition to the University Mall building, University Mall, 155 Dorset Street, as depicted on a two (2) page set of plans, page 1 entitled "Overall Site Plan University Mall, Dorset Street, South Burlington" prepared by Pinkham Engineering Associates, Inc., dated 6/7/93, with a last revision date of 4/12/94, with the following stipulations: 1. All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2. Prior to issuance of a zoning/building permit the applicant shall contribute $449 to the Williston Road Traffic Impact Fund - Area 1 based on the 3.6 additional vehicle trip ends expected to be generated by this project during the P.M. peak hour. 3. The Planning Commission approves a sewer allocation of 409 gpd. The applicant shall pay the per gallon fee prior to issuance of a zoning/building permit. 4. The landscaping plan (sheet 2 of 2) shall be revised prior to issuance of a zoning/building permit to show the change listed below and shall require approval of the City Planner. Three copies of the approved revised plan shall be submitted to the City Planner prior to permit issuance. a) The site plan shall be revised to show $1400 of additional landscaping in the green strip located between the Chittenden Bank drive -through area and the 14 space U-Mall parking area. Any plantings which do not fit in this area shall be placed behind the mall building adjacent to the interstate r.o.w. in a location approved by the City Planner. 5. Prior to issuance of a zoning/building permit, the applicant shall post a $1,650 landscaping bond. The bond shall remain in effect for 3 years to assure that the landscaping takes root and has a good chance of surviving. 6. All new exterior lighting shall be downcasting and shielded and shall not cast light beyond the property lines. Prior to issuance of a zoning/building permit for the new addition, the applicant shall submit for approval by the City Planner details of all exterior lighting to be installed on and in the vicinity of the new 2 addition. Any future change in existing or new lighting anywhere on the entire University Mall property shall be approved by the City Planner prior to installation. 7. The applicant shall obtain a Certificate of Occupancy from the Administrative Officer prior to use of the new addition. 8. Any changes to the final plat plans shall require Planning Commission approval. 9. The final plat plans shall be recorded in the South Burlington land records within 90 days or this approval is null and void.
