Re: Findings of Fact, application of University Mall Realty Trust to amend an approval consisting
of the following: 1) construct a 111,392 square foot GLA addition to the main University Mall
building, 2) construct a 990 space multi -level parking structure, and 3) acquire a 1.7 acre
adjoining parcel, raze a single family dwelling and construct a 15,469 square foot automotive
center, University Mall, 155 Dorset Street. The amendment consists of: 1) construct a 111,504
square foot GLA addition to the main building, 2) construct a 983 space parking structure, 3)
construct a 15,510 square foot automotive center, and 4) modifications to parking, circulation and
landscaping.
On the 28" day of April, 1998, the South Burlington Planning Commission approved the request
of University Mall Realty Trust for revised final plat approval under Section 204 of the South
Burlington Subdivision Regulations based on the following findings:
1. This project consists of amending an approval consisting of the following: 1) construct a
111,392 square foot GLA addition to the main University Mall building, 2) construct a 990 space
multi -level parking structure, and 3) acquire a 1.7 acre adjoining parcel, raze a single family
dwelling and construct a 15,469 square foot automotive center, University Mall, 155 Dorset
Street. The amendment consists of: 1) construct a 111,504 square foot GLA addition to the main
building, 2) construct a 983 space parking structure, 3) construct a 15,510 square foot
automotive center, and 4) modifications to parking, circulation and landscaping. The last
approval of this property was on 12/17/96.
2. Access/circulation: Access modifications include: 1) revising the alignment and width of the
new north entrance, and 2) closing the southerly access from the Hilson parking lot to the
automotive center.
3. A letter from Nancy Knox of Pinkham Engineering addressing the automotive center loading
was submitted. They conclude that there will not be a problem with loading and congestion since
there will be only 2-3 deliveries a week, and not on Saturdays.
4. Coverage/setbacks: Building coverage is 29.9% (maximum allowed is 30%). Overall
coverage is 68.7% (maximum allowed is 70%). Front yard coverage is 36.2% (maximum allowed
is 30%). This is the same as previously approved.
Setback requirements are being met.

5. Landscaping The minimum landscaping requirement, based on building costs, is $107,500
which is being met. The previously approved plan was $10,110 short of this requirement.
Additional landscaping was added to meet the minimum requirement.
6. Parking: The revised plan proposes to reduce the number of parking spaces by 33 spaces. The
12/7/96 approval granted a 223 space or 6.6% waiver. The current proposal requires a total of
3379 spaces and provides 3127 spaces which is a 252 space or 7.5% shortfall. This represents a
parking ratio of 5.1 spaces per 1000 square feet GLA. Staff felt this should be adequate.
DECISION & CONDITIONS
Based on the above Findings of Fact, the South Burlington Planning Commission approves the
final plat application of University Mall Realty Trust to amend an approval consisting of the
following: 1) construct a 111,392 square foot GLA addition to the main University Mall building,
2) construct a 990 space multi -level parking structure, and 3) acquire a 1.7 acre adjoining parcel,
raze a single family dwelling and construct a 15,469 square foot automotive center, University
Mall, 155 Dorset Street. The amendment consists of: 1) construct a 111,504 square foot GLA
addition to the main building, 2) construct a 983 space parking structure, 3) construct a 15,510
square foot automotive center, and 4) modifications to parking, circulation and landscaping, as
depicted on a 13 page set of plans, page one (1) entitled, "Overall Plan Sears Expansion
University Mall 155 Dorset Street South Burlington," prepared by Pinkham Engineering
Associates, Inc, dated 3/21/97, last revised 3/13/98, with the following stipulations:
1. All previous approvals and stipulations which are not superseded by this approval shall remain
in effect.
2. Pursuant to Section 26.256(b) of the zoning regulations, the Planning Commission approves a
total of 3127 parking spaces which represents a 252 space or 7.5% shortfall. It is the
Commission's opinion based on guidelines published by the Urban Land Institute and the
International Council of Shopping Centers that the proposed number of spaces will be adequate. .
3. Any change to the plat plans shall require approval by the South Burlington Planning
Commission.

4. The final plat plans (i.e., sheets 2 of 20, 6 of 20, 11 of 20 and 13 of 20) shall be recorded in the
land records within 90 days or this approval is null and void. The plans shall be signed by the
Planning Commission Chair or Clerk prior to recording.
