FINDINGS OF FACT AND DECISION

Re: Findings of Fact, final plat application of University Mall Realty Trust to amend an approval
consisting of : 1)constructing a 111, 504 square foot GLA addition to the main University Mall
building, 2) constructing a 983 space multi -level parking structure, and 3) constructing a 15, 510
square foot automotive repair structure, 155 Dorset Street. The amendment consists of minor
site modifications to parking, access, and coverage.
On the 2nd day of November, 1999, the South Burlington Development Review Board approved
the final plat application of University Mall Realty Trust under Section 204 of the South
Burlington Subdivision Regulations based on the following findings:
1. This project consists of amending an approval consisting of : 1)constructing a 111, 504 square
foot GLA addition to the main University Mall building, 2) constructing a 983 space multi -level
parking structure, and 3) constructing a 15, 510 square foot automotive repair structure, 155
Dorset Street. The amendment consists of minor site modifications to the parking layout and
green space areas.
2. The record owner of this property is University Mall Realty Trust.
3. Pam: The applicant is proposing to remove seven (7) spaces along the east side of the main
drive through the area west of Dorset Street, add three (3) spaces further south along the east
side of the main drive through the area west of Dorset Street, and add two (2) spaces newt to a
new piece of green space north of the northwest corner of the Sears store. This results in two (2)
spaces fewer than previously approved.
4. Access/circulation: The applicant is proposing to close the existing entrance along the east side
of the main drive through the area west of Dorset Street. The applicant is proposing to remove a
curb further north along that drive to provide access.
The applicant is proposing to add three 3' curb breaks along the east side of the main drive
through the area west of Dorset Street. These breaks are being installed to facilitate drainage to
the west side of this drive, where the closest catch basins are located.
Access to the Paquette parcel from the Mall parking lot is not being affected.
The elimination of a section of the proposed curbed "island" along the east side of the drive

parallel to Dorset Street will facilitate circulation between the Janes & Jacob property and the
access points to Dorset Street.
Proposed changes to the parking layout west of the Jacob parcel will improve circulation in this
area.
5. Coverage: An area of green space near the northwest entrance has been eliminated. Drainage
considerations prevent the construction of a raised curbed green space in this area. The applicant
is proposing to convert an area of pavement northwest of the Sears store to green space to
maintain the existing amount of green space in the CO District.
DECISION AND CONDITIONS
Based on the above Findings of Fact, the South Burlington Development Review Board approved
the final plat application of University Mall Realty Trust to amend an approval consisting of the
following: 1) construct a 983 space parking structure, 2) construct a 111,504 square foot GLA
addition to the main building, and 3) construct a 15,510 square foot automotive center. The
amendment consists of minor site modifications to the parking layout and green space areas, 155
Dorset Street, as depicted on a three (3) page set of plans, page one (1) entitled, "Overall Plan
Sears Expansion University Mall 155 Dorset Street South Burlington," prepared by Pinkham
Engineering Associates, Inc., dated 3/21/97, last revised on 9/1/99, with the following
stipulations.
1) All previous approvals and stipulations which are not superseded by this approval shall remain
in effect.
2) Any change to the final plat plans shall require approval of the South Burlington Development
Review Board.
3) The Development Review Board, pursuant to Section 26.256(h) of the zoning regulations,
approves a two parking space waiver and approves a total of 3125 parking spaces.
4) The final plat plans (sheets 2 of 20, 6 of 20 and 11 of 20) shall be recorded in the South
Burlington land records within 90 days or this approval is null and void. The Development
Review Board Chair or Clerk shall sign the plans prior to recording.
