HomeMy WebLinkAboutSP-10-64 - Decision - 0155 Dorset Street#SP-10-64 CITY OF SOUTH BURLINGTON DEPARTMENT OF PLANNING AND ZONING UNIVERSITY MALL, LLC —155 DORSET STREET SITE PLAN APPLICATION #SP-10-64 FINDINGS OF FACT AND DECISION University Mall, LLC, c/o Finard Properties, LLC, hereafter referred to as the applicant, is seeking site plan approval to amend a previously approved plan for a 705,000 sq. ft. shopping center. The amendment consists of installing two (2) shopping cart corrals, 155 Dorset Street. The Development Review Board held a public hearing on Tuesday, October 19, 2010. Sheila McIntyre represented the applicant. Based on testimony provided at the above mentioned public hearing and the plans and supporting materials contained in the document file for this application, the Development Review Board finds, concludes, and decides the following: FINDINGS OF FACT 1. The applicant is seeking site plan approval to amend a previously approved plan for 705,000 sq. ft. shopping center, 155 Dorset Street. The amendment consists of adding two (2) shopping cart corrals. 2. The application was received on September 9, 2010. 3. The owner of record of the subject property is University Mall, LLC. 4. The subject property is located in the C1 Zoning District. 5. The plan submitted is entitled, "Overall Site Plan Hannaford University Mall 155 Dorset Street South Burlington, Vermont," prepared by Summit Engineering, Inc., dated 8/26/10. General Review Standards (Section 14.06) The applicant is requesting approval to remove a total of two parking spaces to construct two cart corrals north of the Hannaford grocery store. No changes in dimensional coverage are proposed. Overall coverage exceeds the limit for the district, but is unchanged with the application; building coverage is within the limits of the district. According to Table 13-1 of the Land Development Regulations, the subject property requires 5.5 parking spaces per 1,000 SF of GLA, or 3,403 spaces for the 618,605 SF of GLA. All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2. This project shall be completed as shown on the plans submitted by the applicant and on file in the South Burlington Department of Planning and Zoning. 3. The Board grants an additional two (2) parking space waiver, for a total waiver of 250 spaces, which represents a 7.4 % shortfall resulting in 3,153 spaces being provided. 4. The applicant shall obtain a zoning permit within six (6) months pursuant to Section 17.04 of the Land Development Regulations or this approval is null and void. 5. The applicant shall obtain a Certificate of Occupancy from the Administrative Officer prior to the use of the cart corrals. 6. Any change to the site plan shall require approval by the South Burlington Development Review Board or the Administrative Officer.
