SITE PLAN APPLICATION #SP-18-10
FINDINGS OF FACT AND DECISION
LBCMT 2007-0 Dorset Street, LLC, hereafter referred to as the applicant, is seeking approval
to amend a previously approved plan for a 705,335 sq. ft. shopping center. The amendment
consists of: 1) reduce the number parking spaces, 2) widen parking area access drive, 3)
replacing landscaping removed to accommodate access drive modifications, 4) replacing
existing canopies with larger canopies, and 5) adding cart corals, 155 Dorset Street.
Based on the plans and materials contained in the document file for this application, the
Administrative Officer finds, concludes, and decides the following:
FINDINGS OF FACT
1) The applicant is seeking approval to amend a previously approved plan for a 705,335
shopping center. The amendment consists of: 1) reduce the number parking spaces, 2)
widen parking area access drive, 3) replacing landscaping removed to accommodate access
drive modifications, 4) replacing existing canopies with larger canopies, and 5) adding cart
corals, 155 Dorset Street.
2) The application was received on February 16, 2018.
3) The owner of record of the subject property is LBCMT 2007-C3 Dorset Street, LLC.
4) The subject property is located in the City Center Form Based Code, T-4 District.
5) The plan set submitted consists of a five (5) page set of plans, page one (1) is entitled
"Overall Site Plan Parking Lot Modifications University Mall", prepared by Summit
Engineering, Inc., and dated 2/15/18.
Section 14.06 of the South Burlington Land Development Regulations establishes the following
general review standards for all site plan applications:
Only the standards below are affected by this application. All other standards will continue to be
met.
Vehicle and Bicycle Parking
6) The applicant will comply with Section 13.14 of the LDRs to include the new type and
location for bicycle racks, to accommodate 50% of the requirement of 128 short-term bicycle
parking spaces by providing 64 bicycle parking spaces.

7) The site modifications result in the reduction of 149 parking spaces. The vehicular parking
requirement is 1,411 spaces and there will be 3,000 parking spaces available.
Landscaping
8) Three (3) trees will be removed to accommodate the widening of a 13 ft. drive to a 24 ft.
drive. The lost trees will be replaced in the parking lot islands with a value of $1,028. The
City Arborist in an email dated 2/20/18 indicated that the plans were acceptable.
Dumpsters
9) All dumpsters on the property will be screened on all four (4) sides. This should be clearly
noted on the plans.
Building Fagade Alterations
10) The building fagade for the new tenant will be altered but will not trigger the BES
requirements. The alterations will consist of: 1) painting and adding Stonewood "cask oak"
composite panels over the existing siding, and 2) replacing the two (2) existing canopies
with canopies of 66' X 8'-11" and 77'-4" X 8'-11".
Other
11) The building elevation plans include depictions of signs on the building. Since the Land
Development Regulations do not regulate signage, these sign depictions must be removed
from the elevation drawings.
DECISION
Based on the above Findings of Fact, the Administrative Officer herby approves site plan
application #SP-18-10 of LBCMT 2007-0 Dorset Street, LLC, subject to the following
conditions:
1. All previous approvals and stipulations which are not superseded by this approval will
remain in effect.
2. The applicant must obtain a zoning permit within six (6) months pursuant to Section 17.04
of the Land Development Regulations or this approval is null and void.
3. The plans must be revised to show the changes below and will require approval of the
Administrative Officer. Three (3) copies of the approved revised plans must be submitted to
the Administrative Officer prior to permit issuance.
a. The site plan must be revised to clearly note on the plans that all dumpsters will
be screened on all four (4) sides.

b. The building elevation plans must be revised to remove the depictions of signs on
the building.
4. The applicant must obtain a Certificate of Occupancy from the Administrative Officer prior to
use of the site modifications.
5. Prior to permit issuance, the applicant must post a $1,028 landscaping bond. This bond
must remain in full effect for three (3) years to assure that the landscaping has taken root
and has a good chance of survival.
6. Any change to the site plan will require approval by the South Burlington Development
Review Board or the Administrative Officer.

Appeal must be accompanied with a $233 filing fee and be filed within 15 days of the date of
this decision.
