Re: Findings of Fact, application of Roger Schibani and Mery Brown to amend a previously
approved planned unit development consisting of a 54,480 square foot shopping center with four (4)
buildings, 150 Dorset Street. The amendment consists of adding a 5' x 18' refrigeration unit, 2)
construction of a gable entrance to the westerly side of the main building, and 3) changes to the
parking and circulation layout.
On the 9' day of June, 1998, the South Burlington Planning Commission approved the request of
Roger Schibani and Mery Brown for revised final plat approval under Section 204 of the South
Burlington Subdivision Regulations based on the following findings:
1. This project consists of amending a previously approved planned unit development consisting of
a 54,480 square foot shopping center with four (4) buildings. The amendment consists of adding a
5' x 18' refrigeration unit within a one-way drive and adding a 15' x 60' covered entrance. The ZBA
on 4/27/98 approved a request from the applicant for a variance for the refrigeration unit. The ZBA
on 6/8/98 approved a request for a variance for the covered entrance. The sketch plan was reviewed
on 4/28/98.
2. This property located at 150 Dorset Street lies within the C 1 District. It is bounded on the north
by Market Street, on the east by a restaurant, on the north an auto dealership and a residence, and
on the west by Dorset Street.
3. Access/circulation: Access is provided by a 34 foot curb cut on Dorset Street and two (2) 20 foot
curb cuts on Market Street. No changes to these accesses are proposed . The proposal is to place
a 5' x 18' refrigeration unit within a one-way access drive which is 24 feet wide. The proposal would
reduce its width to 19 feet which is adequate for a one-way drive. Section 26.254 of the zoning
regulations allows a one-way drive to be a minimum of 10 feet in width.
Circulation on the site is adequate.
4. Coverage/setbacks: Building coverage is 22% (maximum allowed is 40%). Overall coverage is
72% maximum allowed is 90%).
5. Three (3) of the four (4) buildings are not located within the required building envelope area. The
proposed refrigeration unit and the covered entrance are proposed to be placed outside of the
required building envelope area. The ZBA on 4/27/98 approved a request for a variance from the
setback requirements for the refrigeration unit and approved a request for a variance for the covered
entrance on 6/8/98.

6. Floor Area Ratio (F.A.R.): The F.A.R. is .44 (maximum allowed is 0.8)
7. Landscaping_ The minimum landscaping requirement, based on building costs is $375 which is
being met. Proposed plantings include an Arborvitae and Juniper hedge to screen the dumpster
storage area from Market Street.
8. Traffic: No additional traffic is expected.
9. Dumpsters: The dumpsters located at the northeast corner of the main building will be relocated
to the northeast corner of the property. These dumpsters will be screened by a stockade fence and
an evergreen hedge to provide additional screening from Market Street.
10. Parking: A total of 273 spaces are required and 262 spaces are available including seven (7)
handicapped spaces and a bike rack. This is an I 1 space or 4% parking waiver. Staff had no problem
with the granting of the waiver. The parking layout was revised since sketch plan and now meets the
area and dimension requirements.
11. Sewer: No additonal sewer allocation needed.
12. Lighting_ Existing exterior lights consist of the following:
— seven (7) building mounted lights (three (3) different type of fixtures.
two (2) pole mounted lantern type fixtures.
— twenty five (25) single and three (3) double lights mounted on poles with downcasting
shielded fixtures.
— four (4) pole mounted floodlights which the applicant has agreed to remove.
13. Other:
the portable warehouse behind Bed and Bath has been removed.
DECISION & CONDITIONS
Based on the above Findings of Fact, the South Burlington Planning Commission approves the final
plat application of Roger Schibani and Mery Brown to amend a previously approved planned unit
development consisting of a 54,480 square foot shopping center with four (4) buildings, 150 Dorset
Street. The amendment consists of adding a 5' x 18' refrigeration unit, 2) construction of a gable
entrance to the westerly side of the main building, and 3) changes to the parking and circulation
layout, as depicted on a four (4) page set of plans, page one (1) entitled, "Dorset Square South
Burlington, Vermont Revised Site Plan," prepared by Lamoureux, Dickinson & O'Leary Consulting
Engineers, Inc., dated 3/27/98, last revised on 5/29/98, with the following stipulations:

1. All previous approvals and stipulations which are not superseded by this approval shall remain in
effect.
2. Prior to issuance of a zoning permit, the applicant shall post a $375 landscape bond. The bond
shall remain in effect for three (3) years to assure that the landscaping takes root and has a good
chance of surviving.
3. Any new exterior lighting shall consist of downcasting shielded fixtures so as not to cast light
beyond the property line. Any change in lighting shall be approved by the City Planner prior to
installation. The existing flood lights shall be removed.
4. For the purpose of calculating road impact fees under the South Burlington Impact Fee Ordinance,
the Planning Commission estimates that the refrigeration unit and gable entrance will generate zero
(0) additional vehicle trip ends during the P.M. peak hour.
5. Any change to the final plat plan shall require approval by the South Burlington Planning
Commission.
6. The final plat plan shall be recorded in the land records within 90 days or this approval is null and
void. The plan shall be signed by the Planning Commission Chair or Clerk prior to recording.
7. As expressly represented by the applicant, the overhead wires serving the parking lot lights shall
be moved underground.
