HomeMy WebLinkAboutSP-98-0000 - Decision - 0150 Dorset StreetFINDINGS OF FACT & DECISION STATE OF VERMONT 5 - �6 0 6D COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON Re: Findings of Fact, application of Dorset Square Associates to amend a planned unit development consisting of a 54,480 square foot shopping center (52,840 g.l.a.), 150 Dorset Street. The amendment consists of revisions to the parking layout. On the 24' day of November, 1998, the South Burlington Planning Commission approved the request of Dorset Square Associates for revised final plat approval under Section 204 of the South Burlington Subdivision Regulations based on the following findings: 1. This project consists of amending a planned unit development consisting of a 54,480 square foot shopping center (52,840 g.l.a.). The amendment consists of revising the parking layout to reduce the number of spaces by 11 spaces. The plan being revised was approved on 6/9/92 . 2. This property located at 150 Dorset Street lies within the C1 District. It is bounded on the north by Market Street, on the east by a restaurant, on the north an auto dealership and a residence, and on the west by Dorset Street. 3. Parking: A total of 265 spaces are required and 251 spaces are available which represents a 14 space or 5.3% shortfall. The reason for this request is that the parking plan approved on 6/9/98 showing 262 spaces was not implemented as approved. The lot was striped to provide 248 spaces and it is proposed to add three (3) more spaces for a total of 251 spaces. In addition, the gross leasable area provided to staff for the last review was incorrect. The correct g.l.a. is 52,840 square feet. The revised g.l.a. reduces the requirement from 273 spaces to 265 spaces. The 6/9/98 approval included an l l space or 4% waiver. The current request is for a 14 space or 5.3% waiver. Staff did not have a problem with granting the request. DECISION & CONDITIONS Based on the above Findings of Fact, the South Burlington Planning Commission approves the final plat application of Dorset Square Associates to amend a planned unit development consisting of a 54,480 square foot shopping center (52,840 g.l.a.), 150 Dorset Street. The amendment consists of revisions to the parking layout, as depicted on a plat entitled, "Dorset Square South Burlington, Vermont Record Drawing," prepared by O'Leary -Burke Civil Associates, PLC, dated 10/15/98, last revised on 11/12/98, with the following stipulations: 1. All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2. Pursuant to Section 26.256(b) of the zoning regulations, the Commission approves a total of 251 spaces which represents a 14 space or 5.3% waiver. It is the Commission's opinion that 251 spaces will be adequate. 3. Any change to the final plat plan shall require approval by the South Burlington Planning Commission. 4. The final plat plan shall be recorded in the land records within 90 days or this approval is null and void. The plan shall be signed by the Planning Commission Chair or Clerk prior to recording.
