FINDINGS OF FACT AND DECISION
STATE OF VERMONT

Re: Findings of Fact, final plat and Design Review applications of Dorset Square
Associates to amend a previously approved final plat.
On the 18th of April, 2000, the South Burlington Development Review Board approved
the request of Dorset Square Associates for final plat approval under Section 204 of the
South Burlington Subdivision Regulations and Design Review approval under Section 24
of the Zoning Regulations based on the following findings:
The project consists of an amending a previously approved final plat to: 1) construct
mechanical platforms on the south facade of the building, 2) add a five foot wide
landscaping berm to the west fagade of the building, 3) alter doors and windows on
the north and west facades, and 4) remove current wall signage and erect two new
wall signs. The project will convert the former Softhome portion of the Dorset
Square Shopping area to an Outback Steak House. The final plat for this property was
approved by the Development Review Board on March 21, 2000.
2. The owners of record are the Dorset Square Associates.
3. This property located at 150 Dorset Street and lies within the C 1 and CD 1 Districts. It is
bounded on the north by Market Street and several retail establishments, on the east by
Dorset Street and the several small residences that have been converted to office use, on
the south by the undeveloped land and several single-family residences, and on the west
by a restaurant.
4. Access: A five foot wide landscaping berm will be added to the west fagade of the
building, thereby decreasing a 40 foot access drive to 35 feet. A service drive 24 feet in
width is located around the rear of the building. The applicant wishes to install the
proposed mechanical platforms along the south fagade of the shopping center and
thereby decrease the width of the drive along the rear of the building from 24 feet to
17.5 feet. Section 26.254 of the South Burlington Zoning Regulations require that
access drives be a minimum of 20 feet in width or a minimum of 10 feet if the drive is
designated for one-way traffic. It was suggested that the drive be demarcated as a
one-way access.
5. Design Review: The City Center Design Review Committee reviewed this proposal at
their 3/27/00 meeting and recommended that the Board approve the application with
the following stipulations:
a) The recommendation for approval of the proposed addition is based on the
application's compliance with the design review criteria contained in Section
24 of the South Burlington Zoning Ordinance. The determination of whether
or not this application complies with all other requirements contained in the
zoning ordinance shall be made by the Code Officer.
b) The recommendation for approval of the proposed sign design was based on
the application's compliance with the design review criteria contained in
Section 4 of the South Burlington Sign Ordinance. The determination of
whether or not this application complies with all other requirements contained
in the sign ordinance shall be made by the Code Officer.
c) The plans shall be revised to show the signable wall area.
d) The applicant shall obtain a sign permit from the Code Officer within six (6)
months of this approval or this approval is null and void.
e) Any change to the sign design shall require approval of the Development
Review Board.
DECISION AND CONDITIONS
Based on the above Findings of Fact, the South Burlington Development Review Board
approves final plat application #SD-00-18 and design review application #DR-00-05 of
Dorset Square Associates to amend a previously approved planned unit development
consisting of a 54,480 square foot shopping center with four (4) buildings. The amendment
consists of: 1) the construction of a mechanical platform on the south side of the building
resulting in the reduction in width of an access driveway, 2) door and window alterations on
the north and west facades, and 3) removal of current wall signage and the erection of two
new wall signs, 150 Dorset Street, as depicted on a 10 page set of plans, page one(1)
entitled, "Dorset Square South Burlington, Vermont Proposed Site Plan," prepared by
O'Leary - Burke Civil Associates, PLC, dated 7/23/98, last revised on 4/6/00, with the
following stipulations:
1) All previous approvals and stipulations which are not superseded by this approval shall
remain in effect.
2) The plat plans shall be revised to show the changes below and shall require approval of
the Director of Planning & Zoning. Four (4) copies of the approved revised plat plans shall
be submitted to the Director of Planning_& Zoning prior to recording.
a) The final plat plans shall be revised to show the signable wall area.
b) The final plat plans shall be revised to show typical sewer and water installation
details.
3) This approval of the proposed addition is based on the application's compliance with the
design review criteria contained in Section 24 of the South Burlington Zoning Ordinance.
The determination of whether or not this application complies with all other requirements
contained in the zoning ordinance shall be made by the Administrative Officer.
4) This approval of the proposed sign design is based on the application's compliance with
the design review criteria contained in Section 4 of the South Burlington Sign Ordinance.
The determination of whether or not this application complies with all other requirements
contained in the sign ordinance shall be made by the Code Officer.
5) The applicant shall obtain a sign permit from the Code Officer within six (6) months of
this approval or this approval is null and void.
6) Prior to issuance of a zoning permit, the applicant shall post a $2500 landscape bond.
The bond shall remain in effect for three (3) years to assure that the landscaping takes root
and has a good chance of surviving.
7) The restaurant portion of the building shall be sprinklered.
8) Any change to the final plat plans or sign design shall require approval by the South
Burlington Development Review Board.
9) The final plat plan (sheet 1) shall be recorded in the land records within 90 days or this
approval is null and void. The plan shall be signed by the Board Chair or Clerk prior to
recording.
