HomeMy WebLinkAboutDR-01-10 - Decision - 0150 Dorset Streetet C"r ,_�' #DR-oi-io FINDINGS OF FACT & DECISION STATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON Re: Findings of Fact, Design Review application #DR-oi-io of Dorset Square Associates to amend a previously approved 54,48o sq. ft. shopping center with four (4) buildings. The amendment consists of installing four additional windows and relocating an entrance on the north facade of the southern wing of the main building, i5o Dorset Street. On the 4th day of September zooi, the South Burlington Development Review Board approved the request of Dorset Square Associates for design review approval under Section 24.30 of the South Burlington Zoning Regulations based on the following findings: i. The owner of record of this property is Dorset Square Associates. z. This project consists of amending a previously approved 54,48o sq. ft. shopping center with four (4) buildings. The amendment consists of installing four additional windows and relocating an entrance on the north fagade of the southern wing of the main building, i5o Dorset Street. The Design Review Committee last approved storefront modifications for this property on June 25, zooi. 3. This property located at i5o Dorset Street lies within the Ci and CD1 Districts. It is bounded on the north by Market Street and several retail establishments, on the east by Dorset Street and the several small residences that have been converted to office use, on the south by the undeveloped land and several single-family residences, and on the west by a restaurant. 4. Consistent Consistent Design: The proposed door and windows on the north facade of the south wing will create a larger storefront on the north fagade. The area of the north facade to be affected currently has four windows. The proposed storefront will occupy an area in the center of the facade and will create greater visual penetration through the building. The proposed materials, colors, and dimensions of the door and window will be similar to those currently present on the building. The proposed alterations are consistent with the design of the building. Staff had no problem with the proposed storefront and did not recommend any further improvements, as this was a minor alteration to an existing building. Page #z 5. Materials Used: The new door and window will utilize single panes with metal frames to match the existing storefront currently present in the shopping center. Any patching to the siding will be done to match the existing siding. 6. Colors and Textures: The window and door will have bonze colored frames to match the adjacent storefronts. Any touch up painting that will need to be done to the siding will be done with blue paint to match the existing. 7. Windows & Doors: Four windows will be added to the north fagade of the south wing. This is a fa-ade that currently only has one entrance, for a restaurant, on the western corner of the building. The introduction of a new door and window will create a storefront on the eastern edge and balance the fagade. The new storefront will also increase the amount of see -through glass on the facade. Increased levels of see -through glass are encouraged in the Zoning Regulations as it is thought to promote pedestrian activity. 8. Human Scale Design: The four bays are proposed to be added to the building will increase the degree to which the building is of a "human scale". More bays and undulations break up the mass of a building. This makes the building less imposing and more approachable. 9. Roof as Design Element: No changes are proposed to the roof. io. Orient Buildings to Public Streets: The proposed windows will increase the communication between the building and the street. The addition of the windows and door reconstruction will present a more inviting facade to both pedestrians and automobilists entering the shopping center from Dorset Street or Market Street. Currently, the north fagade of this wing has two storefronts, one on the east end and one on the south end. It was staff's position that the proposed work is acceptable and no further windows or doors should be required as this was a minor renovation of an existing building. ii. Conceal Rooftop Devices: No new rooftop devices are proposed. 12. Landscape and Plantings: No changes to the present landscaping are proposed. 13. Efficient and Effective Circulation: No changes to the parking layout are proposed. The new storefront will not result in any changes to the sidewalk along the building. 14. Outdoor Lighting: No changes are proposed to the existing lighting. No new lighting fixtures are requested. 15. Special Features: None proposed. 16. The City Center Design Review Committee reviewed this proposal at their 8/28/oi meeting. The Design Review Committee recommended that the Board approve the application. Page #3 DECISION & CONDITIONS Based on the above Findings of Fact, the South Burlington Development Review Board approves Design Review application #DR-oi-to of Dorset Square Associates to amend a previously approved 54,48o sq. ft. shopping center with four (4) additional windows and relocating an entrance on the north facade of the southern wing of the main building, 158 Dorset Street, as depicted on a two (z) page set of plans, page one (i) entitled "Dorset Square Mall Dorset Street South Burlington, Vermont", prepared by Michael Dugan, Architects, with a stamped received dated of August 13, zooi, with the following stipulations: i. This approval of the proposed addition is based on the application's compliance with the design review criteria contained in Section 24 of the South Burlington Zoning Ordinance. The determination of whether or not this application complies with all other requirements contained in the zoning ordinance shall be made by the Administrative Officer. z. The applicant shall obtain a zoning permit within six (6) months pursuant to Section 27.302 of the zoning regulations or this approval is null and void. 3. The applicant shall obtain a Certificate of Occupancy/Compliance from the Administrative Officer prior to occupancy of the new store. 4. Any change to the site plan shall require approval by the South Burlington Design Review Committe Chair/C4erk South Burli on Development Review Boar Date �-5' 0 Please note: You have the right to appeal this decision to the Vermont Environmental Court, pursuant to 24 V.S.A. 4471 and V.R.C.P. 76, in writing, within 3o days of the date this decision is issued. The fee is $i5o.00. If you fail to appeal this decision, your right to challenge this decision at some future time may be lost because you waited too long. You will be bound by the decision, pursuant to 24 V.S.A. 4472 (d) (exclusivity of remedy finality).
