FINDINGS OF FACT & DECISION
STATE OF VERMONT

CITY OF SOUTH BURLINGTON
Re: Findings of Fact, Design Review application #DR-oi-ii of Dorset Square
Associates to amend a master signage plan. The amendment consists of. i) replacing
a blank blue existing 4' z i/z" by i' 3/4" panel on the free-standing sign with a blue
with white lettered "Clay's" sign panel, and z) adding a iz foot by 4 foot red internally
illuminated cut-out letter "Clay's" wall sign to the north fagade of the southern wing
of the main building, i5o Dorset Street.
On the 4th Day of September zoos the South Burlington Development Review Board
approved the request of Dorset Square Associates for design review approval under
Section 24.30 of the South Burlington Zoning Regulations based on the following
findings:
i. The owner of record of this property is Dorset Square Associates.
z. This project consists of amending a master signage plan. The amendment
consists of. i) replacing a blank blue existing 4' z i/z" by i' 3/4" panel on the
free-standing sign with a blue with white lettered "Clay's" sign panel, and z)
adding a iz foot by 4 foot red internally illuminated cut-out letter "Clay's" wall
sign to the north fa-ade of the southern wing of the main building, 15o Dorset
Street. The Design Review Committee last approved the master signage plan
for this property at the September 25, z000 meeting.
3. This property located at i5o Dorset Street lies within the CDI District. It is
bounded on the north by Market Street and several retail establishments, on
the east by Dorset Street and the several small residences that have been
converted to office use, on the south by the undeveloped land and several
single-family residences, and on the west by a restaurant.
4. Design Review Criteria:
Consistent Design: The proposed wall sign will be visually compatible with
other internally lit signs in the shopping center. Most of the other businesses
utilize wall signs that are internally lit cut out letters or cabinet signs. The
color, graphic style, and proportions are similar to those used in adjacent signs
such as the "Outback Steakhouse". The free-standing sign panel will have a
blue background with white lettering to match the existing sign panels.

5. City Center Goals: The wall sign will be located in the soffit area of the
building facade facing the parking area along Dorset Street. All of the
adjacent signs located in the shopping center are in the same general soffit
area. None project above the roof or parapet of the building or below the top of
any first floor doorway. The proposed free-standing sign panel will be located
along Dorset Street just off the sidewalk.
6. Color, Texture, and Materials: The wall sign will be internally lit red cutout
letters that employ a plastic or luxan material. The adjacent storefront, the
Outback Steakhouse, has a very similar red, internally lit, cut-out letter wall
sign. The free-standing sign panel will have a blue background to match the
existing blue represented on the sign with white lettering and will employ a
plastic or luxan material.
7. Additional Sign Ordinance Criteria:
Location of Features: The locations of the proposed signs are noted on the plan
submitted.
8. Computation of Maximums: The applicant has submitted information on the
maximum allowable size for each of the signs, the size and number of the
signs proposed.
9. Color Scheme: A variety of colors are utilized in signs on the property on the
north fagade of the south wing of the main building, red cut-out letter wall
signs are predominate. The proposed wall sign will conform with the existing
signs on this fagade. The free-standing sign utilized a blue background with
white lettering and a small amount of red trim. The proposed sign panel will
utilize a blue background with white lettering.
io. Lettering or Graphic Style: The majority of the wall signs utilize cut out block
or script lettering. The proposed wall sign will utilize cut-out lettering. The
free-standing sign utilized block lettering.
ii. Lighting: The signs on this property utilize internal illumination. The free-
standing sign is indirectly illuminated.
iz. Location of Signs on Buildings: The majority of the wall signs are located over
the storefronts below the roof line.
13. Material: The majority of the wall signs employ a plastic or luxan material.
14. Sign Proportions: All proposed signs meet the dimensional requirements.
15. Consent: The owner of the property signed the design review application
submitted.
16. Existing Signs Not Conforming: None.
17. The City Center Design Review Committee reviewed this proposal at their
8/28/oi meeting. The Design Review Committee recommended that the
Board approve the application.

DECISION & CONDITIONS
Based on the above Findings of Fact, the South Burlington Development Review
Board approves Design Review Application #DR-oi-ii of Dorset Square Associates to
amend a master signage plan. The amendment consists of: i) replacing a blank blue
existing 4' z 1/2" by 1' 3/4" panel on the free-standing sign with a blue with white
lettered "Clay's" sign panel, and z) adding 12 foot by 4 foot red internally illuminated
cut-out letter "Clay's" wall sign to the north facade of the southern wing of the main
building, 15o Dorset Street, as depicted on a three (3) page set of plans, page one (1)
entitled "Dorset Square South Burlington, Vermont", prepared by O'Leary -Burke
Civil Associates, PLC, with a stamped received date of August zz, zool with the
following stipulations:
1. All previous approvals and stipulations which are not superseded by this
approval shall remain in effect.
z. This approval of the proposed sign design is based solely on the application's
compliance with the design review criteria contained in Section 4 of the South
Burlington Sign Ordinance. The determination of whether or not this
application complies with all other requirements contained in the sign
ordinance shall be made by the Code Officer.
3. The applicant shall obtain a sign permit pursuant to Section Five of the Sign
Ordinance or this approval is null and void.
4. Any change to the master signage plan shall require review by the South
Burlington Design Review Committee.
5. The applicant shall be aware that future amendments to the master signage
plan will require the plan be updated to better address the master signage plan
requirements in S ion 23 if the Sign Ordinance.

too long. You will be bound by the decision, pursuant to 24 V.S.A. 4472 (d)
(exclusivity of remedy finality).
