HomeMy WebLinkAboutDR-02-08 - Decision - 0150 Dorset Street# DR-02-08 FINDINGS OF FACT AND DECISION STATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON Re: Design Review Application #DR-02-08 of Michael Dugan to amend a previously approved 54,480 square foot retail center in four (4) buildings. The amendment consists constructing a storefront in the northern facade of the southern wing, between Clay's and State Farm Insurance, 150 Dorset Street. On the P of September 2002, the South Burlington Development Review Board approved the request of Dorset Square Associates seeking design review approval under Section 24.30 of the South Burlington Zoning Regulations based on the following findings: 1) This project consists of amending a previously approved 54,480 square foot shopping center in four (4) buildings. The amendment consists constructing a storefront on the northern fagade of the southern wing, between Clay's and State Farm Insurance, 150 Dorset Street. The Design Review Committee last approved storefront modifications for Clay's and State Farm Insurance on January 28, 2002. 2) The owner of record is Dorset Square Associates. 3) This property located at 150 Dorset Street lies within the Design District 1 and Central District 1. It is bounded on the north by Market Street, on the east by Dorset Street, on the south by the undeveloped land and several single-family residences, and on the east by a restaurant. 4) Consistent Design: The proposed additional door and windows on the northern fagade of the south wing are similar to what was originally approved for Clay's on 1 /28/2002. The addition of a storefront continues to open up the northern fagade to create a pedestrian friendly atmosphere. The materials, colors, and dimensions of the proposed storefront are the same as the windows and doors currently present on the building. The proposed alterations are consistent with the design of the building. Staff had no issues with the proposed storefront and did not recommend any further improvements with regards to design. 5) Materials Used: Each section of the new windows is a divide, large pane of glass with metal frames to match the existing storefronts present in the shopping center. The doors consist of a single pane of glass and match existing doors. 6) Colors and Textures: The window and door will have bronze colored frames to match the adjacent storefronts. Any touch up painting that will be with blue paint to match the existing siding. 7) Windows & Doors: The additional storefront creates a better balance across the north facing faVade. The creation of storefronts within the retail center is encouraged in the Zoning Regulations as it is thought to promote pedestrian activity. 8) Human Scale Design More bays and undulations break up the mass of a building and give it a visual interest which may promote pedestrian activity. 9) Roof as a Design Element: No proposed changes to the roof. 10) Orient Buildings to Public Streets: The windows increase dialog with the pedestrian walkway. The addition of the windows and doors present a more inviting fagade to both pedestrians and automobilists entering the shopping center from Dorset Street. 11) Conceal Rooftop Devices: None proposed. 12) Landscape and Plantings: None proposed. 13) Efficient and Effective Circulation: No proposed changes to the parking layout. The storefronts and change in window construction do not result in any changes to the sidewalk along the building. 14) Outdoor Lighting: No proposed changes to the existing lighting. 15) Special Features: None proposed. DECISION AND CONDITIONS Based on the above Findings of Fact, the South Burlington Development Review Board approves design review application #DR- 02-08 of Michael Dugan to amend a previously approved 54,480 square foot shopping center with four (4) buildings. The amendment consists of constructing a storefront in the northern fagade of the southern wing, as depicted on a two (2) page plan, page one entitled "Dorset Square Mall Dorset Street South Burlington, Vermont", prepared by Michael Dugan AIA, with a revised date of 8/15/2002, with the following stipulations: 1. All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2. The applicant shall obtain a zoning permit within six (6) months pursuant to Section 27.302 of the zoning regulations or this approval is null and void. 2 3. The applicant shall obtain a Certificate of Occupancy/Compliance from the Administrative officer prior to the use of the space. 4. This approval of the proposed addition is based on the application's compliance with the design review criteria contained in Section 24 of the South Burlington Zoning Ordinance. The determination of whether or not this application complies with all other requirements contained in the zoning ordinance shall be made by the Administrative Officer. 5. Any change to the site plan shall require approval by the South Burlington Development Review Board.
