FINDINGS OF FACT AND DECISION
STATE OF VERMONT
COUNTY OF CHITTENDEN
CITY OF SOUTH BURLINGTON
Re: Findings of Fact, design review application #DR-02-16 of Michael Dugan to amend a
previously approved 54,480 square foot retail center in three (3) buildings. The
amendment consists renovating a storefront on the southern fagade of the northern wing,
between a vacant retail space and the proposed Citi Financial location, 150 Dorset Street.
On the 5 h of November 2002, the South Burlington Development Review Board
approved the request of Michael Dugan seeking design review approval under Section
24.20 of the South Burlington Zoning Regulations, based on the following findings:
1) This project consists of amending a previously approved 54,480 square foot
shopping center (The Blue Mall) in three (3) buildings. The amendment consists
reconstructing a storefront (L. A. Weight Loss") on the southern fagade of the
northern building, between a vacant retail space and the proposed "Citi
Financial", 150 Dorset Street. The Design Review Committee last approved
storefront modifications for "Pro Nails" (now "Tropical Nails & Tan") on
September 3, 2002.
2) The owner of record is Dorset Square Associates.
3) Consistent Design: The proposed renovations on the southern fagade of the
northern building are the similar to previous approvals for the Blue Mall.
The materials, colors, and dimensions of the proposed storefront are similar to
windows and doors currently present on the building (across the parking lot). The
proposed alterations create greater consistency throughout the complex of
buildings.
4) Materials Used: Each section of the new windows is a divided, large pane of glass
with metal frames to match the existing storefronts present in the shopping center.
The doors consist of an undivided pane of glass to match existing doors.
5) Colors and Textures: The window and door will have bronze colored frames to
match the adjacent storefronts. Any touch up painting will be done with blue
paint to match the existing siding.
6) Windows & Doors: The enlarged glass storefront proposed for "L.A. Weight
Loss" on the south facing facade strives towards unifying the Blue Mall. Large
see through storefronts within the City Center Design Review Overlay District is
encouraged in the Zoning Regulations as it may promote pedestrian activity.
The elevations for "L.A. Weight Loss" show five (5) proposed windows, which
appear to be different widths. The applicant should be prepared to justify the
different widths of the proposed windows.
7) Human Scale Design: The enlarged glass storefront continues to open up the
premier elevations at the Blue Mall. The see through glass storefront creates a
more pedestrian friendly atmosphere and allows greater visual access to the
activities within the business establishment.
8) Roof as a Design Element: No proposed changes to the roof.
9) Orient Buildings to Public Streets: The proposed additional windows increase the
dialog with the pedestrian walkway. The larger windows and door compose a
more inviting fagade to both pedestrians and vehicular traffic entering the
shopping center from Dorset Street.
10) Conceal Rooftop Devices: None proposed.
11) Landscape and Plantings: None proposed.
12) Efficient and Effective Circulation: No proposed changes to the parking layout.
The storefronts and change in window construction do not result in any changes
to the sidewalk along the building.
13) Outdoor Lighting: No proposed changes to the existing lighting.
14) Special Features: None proposed.
DECISION AND CONDITIONS
Based on the above Findings of Fact, the South Burlington Development Review Board
approves design review application #DR-02-16 of Michael Dugan to amend a previously
approved 54,480 square foot shopping center in three (3) buildings. The amendment
consists of renovating a storefront (L. A. Weight Loss") on the southern facade of the
northern building, between a vacant retail space and the proposed "Citi Financial", 150
Dorset Street, as depicted on a two (2) page plan, page one entitled "Dorset Square Mall
Dorset Street South Burlington, Vermont", prepared by Michael Dugan AIA, dated 12/1/97,
with a revised date of 10/29/2002, with the following stipulations:
1. All previous approvals and stipulations which are not superseded by this approval shall
remain in effect.

2. This approval of the proposed renovation is based on the application's compliance
with the design review criteria contained in Section 24 of the South Burlington
Zoning Ordinance. The determination of whether or not this application complies
with all other requirements contained in the zoning ordinance shall be made by the
Administrative Officer.
3. Any change to the site plan or elevations shall require approval by the South Burlington
Development Review Board.
4. The elevations shall be revised to show uniformity of size not to exceed two different
window widths, one window width being the same as the standard for "Citi Financial".
5. A Certificate of Occupancy/Compliance shall be obtained prior to occupancy of the
storefront.

lost because you waited too long. You will be bound by the decision, pursuant to 24 V S.A. § 4472(d)
(exclusivity of remedy; finality).
