Re: Findings of Fact, application of Chittenden Bank for
relocation of a 900 square foot drive -up canopy, construction of a
200 square foot entrance vestibule, and 200 square foot drive -up
window to an existing drive -up bank facility, 55 Dorset Street.
On the 13th of April, 1993 the South Burlington Planning Commission
approved the request of Chittenden Bank for a site plan review
under Section 19.10 of the South Burlington Zoning Regulations
based on the following findings:
1. This project consists of the relocation of a 900 square foot
drive -up canopy, construction of a 200 square foot entrance
vestibule and a 200 square foot drive -up window to an existing
drive -up bank facility. These changes are being made as a result
of the Dorset Street reconstruction and the loss of one (1) curb
cut.
2. A variance was granted by the Zoning Board of Adjustment on
3/22/93 to allow the canopy to encroach into the rear setback.
3. This property located at 55 Dorset Street lies within the Cl
District. It is bounded on the north by the access road to the
Park Construction site and Howard Johnson's motel and restaurant,
on the west by the Park Construction site, on the south by the
University Mall parking area and on the east by Dorset Street.
4. Access/circulation: The property currently has two (2) curb
cuts. The northerly curb cut will be closed as part of the Dorset
Street reconstruction project and the southerly curb cut will be
widened to 35 feet. The remaining curb cut will access Dorset
Street at the signalized intersection opposite the access to 100
Dorset Street and will have one (1) ingress lane and two (2) egress
lanes.
Circulation will be one-way around the building and is adequate.
5. Coverage/setbacks: Building coverage is 8.1% (maximum allowed
is 30%). Overall coverage is 78% (maximum allowed is 70%). Front
yard coverage is 60.3% (maximum allowed is 30%).
6. Overall and front yard coverages are being exceeded. The
r.o.w. taking and the elimination of a curb cut are primarily
responsible for this problem. The Dorset Street reconstruction
plans showed the new access drive along the front of the property.
Exceeding front yard coverage and overall coverage was approved as
part of the reconstruction plans.

7. The building is a noncomplying structure since it does not meet
the front yard setback and the new canopy does not meet the rear
yard setback. This is also a noncomplying use since drive-in banks
are only allowed as part of PCD's. The Zoning Board of Adjustment
granted a variance on 3/22/93 to allow the canopy to encroach into
the rear setback.
8. The proposed alterations are subject to Section 19.002 of the
zoning regulations and can not exceed 25% of the fair market value
of the property. The applicant has indicated that the alterations
will cost $325,000 which would require a fair market value of $1.3
million.
9. Parking: A total of 25 parking spaces are required and 28
spaces including one (1) handicapped space are shown on the plan.
10. Landscaping: The landscaping requirement for this project is
$7,650 which is being met. Plantings will include Littleleaf
Linden and Yews. Staff recommended that landscaping be provided in
the northeast corner of the property to better screen the drive -up
stacking area from Dorset Street.
11. Traffic: This property is within Traffic Overlay Zone 4 which
would allow a maximum of 26 vehicle trip ends (vte's) during the
P.M. peak hour. Based on I.T.E. the property currently generates
164 vte's which will not change as a result of the proposed
alterations.
12. Lighting: Exterior lighting will consist of the following:
-- five (5) 100 watt high pressure sodium lamps on 12 foot poles
with cutoff luminaries.
--- three (3) 75 watt metal halide lamps for sign lighting.
--- four (4) 100 watt metal halide recessed canopy lights.
--- one (1) 100 watt metal halide light in vestibule.
--- four (40 20 watt florescent lights for security cameras.
13. Other:
--- dumpster will be screened with six (6) foot stockade fence.
--- a pedestrian access is being provided between this parking lot
and the U-Mall parking lot to the south.
DECISION & CONDITIONS
Based on the above Findings of Fact, the South Burlington Planning
Commission approves the site plan application of Chittenden Bank
for relocation of a 900 square foot drive -up canopy and
construction of a 200 square foot entrance vestibule as depicted on
a plan entitled "Chittenden Bank, Dorset Street, South Burlington,
Circulation Revisions", prepared by Colin P. Lindberg and dated
12/8/92, last revised 3/22/93, with the following stipulations:

1. All previous approvals and stipulations which are not
superseded by this approval shall remain in effect.
2. The applicant shall post a $7,650 landscaping bond prior to
issuance of a zoning/building permit. The bond shall remain
in effect for three (3) years to assure that the planted
landscaping has taken root and has a good chance of surviving.
3. The plan shall be revised prior to issuance of a
zoning/building permit to show additional landscaping in the
northeast corner of the property to better screen the drive -
through service area from Dorset Street. The revised plan
shall require approval by the City Planner.
4. All exterior lighting shall be downcasting and shielded and
shall not cast light beyond the property line. Any change in
existing lighting or new lighting shall be approved by the
City Planner prior to installation.
5. This site plan approval shall not be construed as approval to
alter a noncomplying structure. The decision of whether or
not to approve an alteration to a noncomplying structure shall
be made by the Zoning Administrator in accordance with section
19.002 of the zoning regulations.
6. The applicant shall obtain a zoning/building permit within six
(6) months or this approval is null and void.
7. The applicant shall obtain a Certificate of Occupancy from the
Administrative Officer prior to use of the new drive -through
service area and canopy.
8. Any changes to the site plan shall require Planning Commission
approval.
