PRESENTATION PROCEEDURES
FOR
APPELLANTS TO THE SOUTH BURLINGTON ZONING BOARD OF ADJUSTMENT
The Zoning Board Adjustment is a quasi-judicial body empowered to
hear appeals to the Zoning regulations. These regulations have the force
an effect of law. It is the responsibility of you, the petitioner to
present your documented arguments as -to why the Board should grant a
variance in your case: The Board has little discretionary power and each
of the following five criteria must be met before the Board can grant a
variance. Not one - three or four but all five of the following facts must
be found by the Board before a variance cane granted. Please come
prepared to present all the facts necessary for the Board to make an
objective and intelligent decision. (Refer to Sec. 4468 of the Planning and
Development Act of 1969 for further clarification).
1. That there are unique physical circumstances or conditions,
including irregularity, narrowness, or shallowness of lot size or shape,
or exceptional topographical or other physical conditions peculiar to the
particular property, and that the unnecessary hardship is due to such
conditions, and not the circumstances or conditions generally created by
the provisions of the zoning regulations in the neighborhood or district in
which the property is located;
2. That because of such physical circumstances or conditions, there
is no possibility that the property can be developed in strict conformity
with the provisions of the zoning regulations and that the authorization of
a variance is therefore necessary to enable the reasonable use of the
property;
3. That such unnecessary hardship has not been created by the
appellant;
4. That the variance, if authorized, will not alter the
essential character of the neighborhood or district in which the property
is located, nor substantially or permanently impair the appropriate use
or development of adjacent property, nor be detrimental to the public
welfare; and
5. That the variance, if authorized, will represent the minimum
variance that will afford relief and will represent the least
modification possible of the zoning regulations and of the plan.

We the undersigned wish to voice our opposition to the
proposed variance from Section 9.10 Permitted uses of the South
Burlington Regulations requested by Mei King and Jack Yuen, Sun
Cha Tift, agent as stated in your letter of 4/28/92 to the
adjacent property owners of 1153 Airport Drive South Burlington,
Vermont for the following reasons:
1. This side of Airport Drive is zoned for residential
buildings only. We believe that to permit a business to operate
in this zone would weaken the intent of the zoning restrictions
now in place. It would then become more difficult to keep other
businesses from receiving variances and thereby change the
present zoning from residential to commercial.
2. The proposed lot size is to small to build a single
family house based on current requirements. To permit the
operation of a beauty salon in conjunction with a single-family
dwelling is not reasonable.
3. Parking will be a problem with a small lot size. A
visit to your office shows the requested variance would expand
the present driveway north to Mr & Mrs Barber's property line.
The individual requesting Mr & Mrs Barber's agreement to support
this variance stated to them that the customers would park on the
street across from the building. Traffic on Airport Drive at the
times that commercial aircraft are arriving and leaving is now
very heavy and it is difficult to get in or out of our drive
ways. The addition of on street parking will make matters worse.
Since there is little enforcement of the one hour parking on
Airport Drive. we can expect repeated violation of the parking
ordinance since many reasons exist for visits over one hour.
The owner might request that their customers use the drive, but
they has little control over where the customers will park since
they do not want to lose the customer. Our fears that at some
future time they will obtain a variance to pave over the whole
back yard similar to the beauty salon on Patchen Road next to
O'Brien's Park.
4. Kelly Brown request for a beauty salon in her residence
was turned down because South Burlington does not recognize hair
dressing as an IN —HOME occupation nor does it allow mix use of a
home for living and business in a residential area. Other hair
dressers have told me this same fact.

previous approval for this variance since we believe we
were mislead on the parking situation planned for this
business. We never received notice from the South
`Burlington Zoning Administrator as our neighbors.
