BOARD OF CIVIL AUTHORITY 6 AUGUST 2014
The South Burlington Board of Civil Authority held a meeting on Wednesday, 6 August 2014, at 6:30 p.m., in the
Conference Room, City Hall, 575 Dorset Street.
Members Present: P. Taylor, Chair; H. Riehle, P. Nowak, C. Shaw, B. Nowak, M. Emery, A. Clift, Sen. M. Sirotkin, P.
Picard, P. Benner, T. Harrington
Also Present: T. Leblanc, Assessor; B. Monaghan, attorney for the BCA
1. Agenda Review:
Members agreed to postpone Agenda items #5-9 as the City Clerk could not be present at this meeting.
2. Comments & Questions from the public not related to Agenda items:
No issues were raised.
3. Minutes of 23 July 2014:
Ms. Emery moved to approve the Minutes of 23 July 2014 as written. Ms. Riehle seconded. Motion passed
unanimously.
4. Hear Appeals - continuation of assessment appeal hearing:
A. City of Burlington - Airport
Mr. Taylor advised that the BCA has retained attorney Brian Monaghan. He suggested the Board enter
deliberative session with attorney Monaghan. Ms. Nowak moved the Board enter deliberative session. Ms. Riehle
seconded. Motion passed unanimously.
When open session resumed, Mr. Leblanc was sworn in.
Ms. Clift disclosed that she is involved in a lawsuit with the City of Burlington over another issue and did not feel it
would bias her in the issue before the Board of Civil Authority. Board members had no concerns with Ms. Clift
continuing to serve during this appeal.
Mr. Monaghan presented the BCA with a stipulation related to this appeal, dated August 6, 2014, signed by the
cities of Burlington and South Burlington.
Mr. Leblanc then provided an overview of the Airport properties. He noted there are more than 100 properties,
some of which have been combined into larger parcels for tax purposes. There is a final value for each of these
combined parcels. There have also been 8 to 10 residential properties added since last April 2013.

Mr. Leblanc said the City of Burlington is appealing every Airport property they own. The City of Burlington had
provided no alternate values for these properties during the grievance hearing to his office which is why that
appeal was denied.
Members then accepted the Assessor’s information which contained the NEMRC parcel data and Cama reports
which were then labeled as Exhibits A through U as presented by Mr. Leblanc.
Ms. Harrington moved to close the hearing. Ms. Clift seconded. Motion passed unanimously.
Ms. Nowak then moved that the Board meet in deliberative session on the City of Burlington assessment appeal.
Ms. Harrington seconded. Motion passed unanimously.
Following the deliberative session, members agreed to meet again on 12 August at 6:30 p.m. to hear the items
related to the August 26th primary election removed from tonight’s agenda.
As there was no further business to come before the Board, Ms. Riehle moved to adjourn. Ms. Nowak seconded.
The motion passed unanimously, and the meeting was adjourned at 7:47 p.m.
