HomeMy WebLinkAboutSD-00-15 - Decision - 0001 0003 0005 Dorset Street#SD-00-15 FINDINGS OF FACT AND DECISION STATE OF VERMONT COUNTY OF CHITTENDEN CITY OF SOUTH BURLINGTON Re: Findings of Fact, final plat application of the John Larkin to amend a previously approved final plat for a planned unit development consisting of constructing an addition to an existing hotel building and a new 71 room hotel building on a site developed with an 89 room hotel and 275 seat restaurant, 1 Dorset Street. On the 18th of April, 2000, the South Burlington Development Review Board approved the final plat application of John Larkin under Section 204 of the South Burlington Subdivision Regulations based on the following findings: 1. This project will amend a previously approved final plat of John Larkin for a planned unit development consisting of constructing an addition to an existing hotel building and a new 71 room hotel building on a site developed with an 89 room hotel and 275 seat restaurant approved on January 4, 2000. The amendment consists of 1) modifying the footprint of the new hotel building, and 2) parking and landscaping modifications. 2. The owner of record is John Larkin. 3. The property located at 1 Dorset Street lies within the C 1 and C.O. District. It is bounded on the north by Williston Road, on the west by I-89 ramp, on the east by Dorset Street, and on the south by the University Mall. 4. Coverage/setbacks: Phase l: Building coverage is now 22.5% as compared to the previously approved 22.3% (maximum allowed is 30%). Overall coverage is slightly higher than previously approved (63.1%) at 64.4% (maximum allowed is 70%). Front yard coverage is unchanged at 55.4% (the previously approved application reduced the front yard coverage from 67.41/o to 55.4% which is still above the maximum allowed 30%). Phase 2: The proposed building coverage is slightly higher at 21.8% (was 21.7%) but still below the maximum of 30%. Overall coverage has increased from 63.4% to 64.7% (maximum allowed is 70%). Front yard coverage is unchanged at 55.4% (the previously approved application reduced the front yard coverage from 67.4% to 55.4% which is still above the maximum allowed 30%). 5. Landscaping: The applicant has proposed to remove an existing hedge along the University Mall boundary. It was recommended that the applicant plant a similar 8-foot to 10 foot high evergreen hedge No Text along the property boundary to provide screening between the two properties. DECISION AND CONDITIONS Based on the above Findings of Fact, the South Burlington Development Review Board approves final plat application #SD-00-15 of John Larkin to amend a planned unit development consisting of constructing an addition to an existing hotel building and a new 71 room hotel building on a site developed with an 89 room hotel and a 275 seat restaurant. The amendment consists of 1) modifying the footprint of the new hotel building, and 2) parking and landscaping modifications, 1 Dorset Street, as depicted on a three (3) page set of plans, page one (1) entitled, "Howard Johnson's South Burlington Vermont Site Plan, Phase 1", prepared by Llewellyn - Howley, Inc., dated 7/13/99, last revised on 2/29/00, with the following stipulations: 1. All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2. The plat plans shall be revised to show the changes listed below and shall require approval of the Director of Planning & Zoning (hereinafter Director). Four (4) copies of the approved revised plat plans shall be submitted to the Director prior to recording: a) The final plat plan (sheet 3 of 7) shall be revised to show similar screening as presently exists between the new parking area and the University Mall property line. Said plan and revision shall be subject to staff approval 3. Any change to the final plat plans shall require approval by the South Burlington Development Review Board. 4. The final plat plans (sheet 1 and 2 of 7) shall be recorded within 90 days or this approval is null and void. The plans shall be signed by the Board Chair or Clerk prior to recording. J1 !
