FINDINGS OF FACT AND DECISION
STATE OF VERMONT
COUNTY OF CHITTENDEN
CITY OF SOUTH BURLINGTON
Re: Findings of Fact, final plat application #SD-01-32 of John Larkin to amend a previously
approved planned unit development consisting of. 1) an 89 room hotel, 2) a 71 room hotel
building, and 3) a 275 seat restaurant. The amendment consists of adding additional landscaping
as required by Act 250, 1 Dorset Street.
On the 1 Oth of July, 2001, the South Burlington Development Review Board approved the final plat
application of John Larkin under Section 204 of the South Burlington Subdivision Regulations based
on the following findings:
1. This project consists of a final plat application to amend a previously approved planned unit
development consisting of: 1) an 89 room hotel, 2) a 71 room hotel building, and 3) a 275 seat
restaurant. The amendment consists of adding additional landscaping as required by Act 250, 1
Dorset Street.
2. The owner of record is John Larkin.
3. The property located at 1 Dorset Street lies within the C 1 and C.O. District. It is bounded on the north
by Williston Road, on the west by I-89 ramp, on the east by Dorset Street, and on the south by the
University Mall,
4. The applicant proposed adding 22 Austrian Pine trees, 8 American Cranberry bushes, and 8 Lilac trees
to comply with conditions imposed by Act 250 approval. The majority of the plantings are proposed
along the edge of the property that borders the Interstate within the Conservation & Open Space District.
No changes were proposed to access, circulation, or coverages.
DECISION AND CONDITIONS
Based on the above Findings of Fact, the South Burlington Development Review Board approves
final plat application #SD-01-32 of John Larkin to amend a previously approved planned unit
development consisting of. 1) an 89 room hotel, 2) a 71 room hotel building, and 3) a 275 seat
restaurant. The amendment consists of adding additional landscaping as required by Act 250, 1
Dorset Street, as depicted on a one (1) page set of plans entitled, "Howard Johnson's South
Burlington Vermont Landscape Plan", prepared by Llewellyn -Howley, Inc., dated 1/26/00, last
revised on 5/16/01, with the following stipulations:
All previous approvals and stipulations which are not superseded by this approval shall remain in
effect.
2. Any change to the final plat plan shall require approval by the South Burlington Development
Review Board.

§ 4471 and V.R. C.P. 76, in writing, within 30 days of the date this decision is issued. The fee is $150.00. If you fail
to appeal this decision, your right to challenge this decision at some future time may be lost because you waited too
long. You will be bound by the decision, pursuant to 24 V.S.A. § 4472(d) (exclusivity of remedy; finality).
