HomeMy WebLinkAboutSP-16-71 - Decision - 0001 Dorset Street#SP-16-71 CITY OF SOUTH BURLINGTON DEPARTMENT OF PLANNING AND ZONING TMC NE, LLC — 1 DORSET STREET SITE PLAN APPLICATION #SP-16-71 FINDINGS OF FACT AND DECISION TMC NE, LLC, hereinafter referred to as the applicant, is seeking after -the -fact approval to amend a previously approved plan for a 71 room hotel (Comfort Suites), an 89 room hotel (Homewood Suites) and an 11,242 sq. ft. retail building. The amendment consists of adding an electrical transformer with associated landscaping, 1 Dorset Street. Based on the plans and materials contained in the document file for this application, the Administrative Officer finds, concludes, and decides the following: FINDINGS OF FACT 1. TMC NE, LLC, hereinafter referred to as the applicant, is seeking after -the -fact approval to amend a previously approved plan for a 71 room hotel (Comfort Suites), an 89 room hotel (Homewood Suites) and an 11,242 sq. ft. retail building. The amendment consists of adding an electrical transformer with associated landscaping, 1 Dorset Street. 2. The owners of record of the subject property are Larkin Family Partnership & Vermont CVS Pharmacy, LLC. 3. The subject property is located in the Form Based Code — T4 Zoning District. 4. The application was received on October 12, 2016. 5. The plan submitted consists of a three (3) page set of plans, page one (1) is entitled "CVS Pharmacy 1 Dorset Street - South Burlington, VT 05403". prepared by Trudell Consulting Engineers et al, dated 11/20/15, and last revised on 10/04/16. DIMENSIONAL REQUIREMENTS 6. The proposal will increase the overall coverage from 70.4% or 172,130 sq. ft. to 172,218 sq. ft., an increase of 88 sq. ft. or 0.036%. This amount of increase does not trigger the requirement for the identification of approvable open space under Section 8.11 (F) (2) of the LDRs. 7. Setback requirements will not be affected by this application. SITE PLAN REVIEW STANDARDS - 1 — #SP-16-71 Section 14.06 of the South Burlington Land Development Regulations establishes the following general review standards for all site plan applications: Only the standards below are affected by this application. All other standards will continue to be met. Utility Cabinets (4) There shall be sufficient landscaping with evergreens of sufficient height and density to screen effectively the facility from surrounding prqperty� Landscaping may allow for the use of any doors so long as the door - side of the units are not visible from an existing or planned public street. The applicant is proposing to add 15 4-5' Dark American Arborvitae plants to screen the utility cabinet, This provision is being met. Landscaping 8. The applicant is proposing to add 15 4'-5' Dark American Arborvitae plants to screen the utility cabinet. 9. The City Arborist in an email dated 10/14/16 to staff indicated that the plans were acceptable. DECISION Based on the above Findings of Fact, the Administrative Officer herby approves site plan application #SP-16-71 of TIVIC NE, LLC, subject to the following conditions: 1. All previous approvals and stipulations which are not superseded by this approval will remain in effect. 2. This project must be completed as shown on the plan and shall be on file in the South Burlington Department of Planning and Zoning. 3. The applicant must obtain a zoning permit within six (6) months pursuant to Section 17.04 of the Land Development Regulations or this approval is null and void. 4. Prior to issuance of a zoning permit, the applicant must submit to the Administrative Officer a final set of project plans as approved in digital (PDF) format. 5. The applicant must obtain a Certificate of Occupancy from the Administrative Officer upon completion of installing the new landscaping. -2— #SP-1 6-71 6.
