FINDINGS OF FACT AND DECISION
STATE OF VERMONT
COUNTY OF CHITTENDEN
CITY OF SOUTH BURLINGTON
RE: Findings of Fact, site plan application #SP-01-85 of 120 Kimball Avenue,LLC to
amend a previously approved site plan for a 27,616 square foot general office building.
The amendment consists of installation of a 12 foot by 7 foot transformer and associated
landscaping at 120 Kimball Avenue.
On the 56'day of November,the Director of Planning&Zoning approved the site plan
application of 120 Kimball,LLC under Section 26.10(b) of the South Burlington Zoning
Regulations,based on the following findings:
1. This project consists of a site plan application to amend a previously approved site
plan for a 27,616 square foot general office building. The amendment consists of
installing a 12 foot by 7 foot (84 square feet) transformer and associated
landscaping at 120 Kimball Avenue.
2. The owner of record is 120 Kimball Avenue,LLC.
3. This property is located within the IC-Mixed Industrial Commercial District.
4. Access/circulation/parking: No changes to access and circulation will result.
5. Coverage/setbacks: The installation of the transformer will result in an additional
84 square feet of impervious coverage. This is a negligible(less than 0.5%)increase
in the overall coverage of 35.0%.The maximum for the IC district is 70.0%.
Coverage requirements are therefore met. All setback requirements are met.
6. Landscaping: The plans submitted indicate a hedge of 22 Dark American
Arborvitae of two to three feet to be installed around the transformer.
DECISION AND CONDITIONS
Based on the above Findings of Face,the South Burlington Director of Planning and
Zoning approves site plan application#SP-01-85 of 120 Kimball Avenue,LLC to amend a
previously approved site plan for a 27,616 square foot general office building. The
amendment consists of The amendment consists of installation of a 12 foot by 7 foot
transformer and associated landscaping at 120 Kimball Avenue,as depicted on a set of
plans entitled "110-120 Kimball LLC,Kimball Avenue, S. Burlington,Vt., Certificate of
Occupancy Site Plan," prepared by Trudell Consulting Engineers,dated 9/12/00 and with
a date received notation of October 8,2001,with the following stipulations:
1. All previous approvals and stipulations that are not superseded by this approval
shall remain in effect.
2. Landscaping as indicated around the transformer on the plans shall be installed
prior to issuance of a Certificate of Occupancy/Compliance for the property.
3. The applicant shall obtain a zoning permit within six (6) months of the date of this
decision,pursuant to Section 27.302 of the Zoning Regulations,or this approval is
null and void.
4. The applicant shall obtain a Certificate of Occupancy/Compliance from the
Administrative Officer.
5. Any change to the approved site plan shall require approval of the South
Burlington Development Review Board.
