Please note that these comments respond to the plan set provided to Planning & Zoning in mid-
June and distributed for review by MG on 7/10/24 and do not take into consideration the revised
plans provided by AR on 7/19/24.
Fire Marshal (Terry Francis):
No comments provided directly to MG as of 7/19/24, however, MG understands that the plans
provided 7/19 include a layout approved by Terry that provides emergency access to the rear of the
proposed building
Development Review Staff (Marla Keene & Marty Gillies) – finalized 7/15/2024:
- Identify how the street phasing plan approved in the most recent amendment for 112
Garden Street is being met/followed.
- Identify how the rooftop equipment is proposed to be screened.
- Provide an updated ‘recordable legal instrument’ that demonstrates concurrence of the
owner of Large Development Area Civic Space re: proposed off-site open space designation
- Confirm that the proposed on-site open space has not/will not be used for credit for any
other property in City Center.
- In the approval for 113 Garden Street, the residential units all included
o an entry number,
o a recessed light fixture,
o at least two feet of walkway width beyond the handle side of the door;
and Staff found that a street presence for those residential entries was provided by
o using a canopy over the entries,
o recessing the entries,
o providing windows immediately adjacent to the entrance.
Given that, compare the first-floor residential entries for the proposed building at 200
Garden Street to the approved first-floor residential entries for the approval building at
113 Garden Street.
- Identify how safe continuous pedestrian access from the common door in the building to
the off-site dumpster enclosure will be provided.
- Confirm that the safe continuous pedestrian access between 303 Market and the
community garden for 303 Market will be maintained.
- Identify what ‘specialty concrete’ means in the context of the landscaping budget and
identify where on the site it will be installed.
City Arborist (Craig Lambert) – provided 7/16/2024:
The landscape plan looks good overall. My only recommendation is that parking lot islands and
bump outs where trees are planted should be excavated and filled with planting soil to a depth of 2
feet to increase soil volume suitable to support tree growth.
Director of Public Works (Tom DiPietro) – provided 7/12/2024:
• The proposed project must be constructed in accordance with South Burlington DPW
Standards and Specifications.
• Any work in a City owned ROW requires the applicant to obtain a ROW permit before
proceeding. This includes requests to temporarily restrict on-street parking spaces to
facilitate construction.
• The contractor shall obtain final water and wastewater allocations prior to construction.
• The contractor shall obtain a wastewater connection permit prior to connecting to the
City's wastewater system.
• It appears that the project is proposing a temporary paved walk on Garden Street during
construction. This walk shall be in place prior to the start of construction and
maintained throughout construction. A C.O. should not be issued until the final new
paved path and concrete sidewalk are in place.
• Will pedestrians be required to cross Garden Street at the project location at any time,
or will they be able to continue along the south side of the street throughout
construction? If they will be required to cross, please provide a plan showing the
proposed location of this crossing and how it will be constructed.
• How will pedestrians safely cross through the parking lot on M4/M5 during
construction?
• Where/How will construction vehicles access the site during construction?
• Where will contractors park during construction?
• The contractor shall maintain any construction fencing so that is in good condition and
does not present a hazard or visual obstruction to vehicles or pedestrians.
• The contractor shall maintain all EPSC measures and sweep up any material tracked into
the road on a daily basis.
Deputy Director of Capital Projects (Erica Quallen) – provided 7/12/2024:
• There should be a ramp connecting the accessible parking space to the proposed 5’
sidewalk in the parking lot median. This would connect the hatched loading/unloading area
to the sidewalk.
• Please install an accessible parking sign at the end of that parking space.
• None of the entrances directly off Garden Street are accessible with ramps. Is there space
to provide a ramp to the main street-side entrance (second door in from the east) so people
needing a ramp don’t have to go around the building to the rear entrance?
Stormwater Superintendent (Marisa Rorabaugh) – provided 7/17/2024:
1. Staff notes that stormwater treatment for this development is provided by previously permited
and constructed stormwater treatment prac�ces, namely Gravel Wetland 1, Infiltra�on System
for Roo�op Runoff and Gravel Wetland 5. Sizing of these prac�ces accounted for development
on this lot, therefore no addi�onal treatment is required at this �me.
2. Civil Sheet 6, Erosion Preven�on & Sediment Control Plan:
a. The area of disturbance directly abuts two recently constructed parking lots that are, or
will be, in ac�ve use by residents. The applicant must ensure that sediment does not
leave the ac�ve site during construc�on and, if sediment is tracked offsite, promptly
clean it up. Staff recommends adding reference to these parking areas and adjoining
drives to the “sweeping paved areas” note. Staff addi�onally recommends adding a
requirement to clean up sediment that has been tracked on paved areas by the end of
the same business day in which the track-out occurs, as outlined in the stabilized
construc�on access sec�on of the Vermont DEC Low Risk Site Handbook (applicant
references this document on this sheet).
b. Stabilized construc�on access: staff recommends adding a requirement to maintain the
stabilized construc�on access as outlined in the Vermont DEC Low Risk Site Handbook.
c. Winter EPSC Plan Requirements: Sec�on 16.03.B.2 of the City’s Land Development
Regula�ons states that “Land shall not be le� exposed between October 15 and April
15”. Please update notes to reflect this requirement.
d. The Limits of Disturbance shown on the plan does not appear to encompass the en�rety
of the area that will be disturbed. Please indicate how the limits of disturbance and
access to the site will be demarcated and therefore controlled.
3. Civil Sheet 8, Details and Specifica�ons EPSC & Storm Details:
a. Stabilized construc�on exit detail, note 2: please clarify the �meline for clean up that is
referenced in this note. Addi�onally, please note that, as per the Vermont DEC Low Risk
Site Handbook, tracking any sediment off the ac�ve site and onto adjacent pavement
must be cleaned up in the same �meline as that which is tracked into the City right of
way (see stormwater comment 1a above).
