Hi Marla:
High-level comments.
- Applicant is proposing a Conservation PUD to include a ~1.9 acre development parcel including ~1 acre of
land within the SEQ-NRT and ~0.9 acres in the SEQ-NRP District. Approximately 0.8 acres of the
development parcel, located within the SEQ-NRT subdistrict, is proposed as the building envelope. These
figures are estimated because the applicant has not provided a breakdown.
- Pursuant to Section 15.C.02E(1), PUDs are prohibited in the SEQ-NRP District except for designation as
Conservation land within the Conservation PUD. Furthermore, while limited subdivision is allowable within
the SEQ-NRP district, per 9.12B(2), where the portion of a 15+ acre lot located in a non-NRP SEQ
subdistrict is suƯicient to accommodate at least three dwelling units or lots, no subdivisions of land are
permitted within the NRP District (Except as subdivision and Conveyance to the City of South Burlington or
to a qualified land trust as open space per 9.12 A)
- StaƯ recommends the Board review and provide guidance on whether portion of the property within the
SEQ-NRT District is “Seved by municipal water & sewer” as defined in Act 47. Water and sewer lines
presently serve Windswept Lane. Further, on August 5, 2024 the City Council is holding a public hearing on
the establishment of water and sewer service districts to that will define “areas served” for Act 47
purposes. The portion of the subject parcel within the SEQ_NRT district is WITHIN both the water and
sewer service area.
- Assuming the portion of the subject parcel is within the water and sewer service area, that entire area
(assuming no hazards) is granted an allowance of at least 5 dwelling units per acre under Act 47, and is
granted the right to constrict a 4-plex of the same size lot as a single family home under H 687.
- Based on the above, staƯ considers the inclusion of land within the SEQ-NRP district in the development
lot is not allowable.
- StaƯ, further, considers the carve-out to the Conservation PUD to be unnecessary to allow the SEQ-NRT
portion of the parcel to be developed. As parcel area outside the SEQ-NRP totals less than 4 acres, the
parcel is not required to be a PUD of any type. As noted above, the applicant may construct up to 5
dwellings per acre if it is an area served by water and sewer, and in doing so has no obligation to conserve
land within the Conservation PUD.

Hi folks,
The Ruggieros have submitted two sketch plan application to subdivide their lots. This email pertains to the REAR
lot.
The proposal is to subdivide the existing lot for the purpose of developing the smaller lot (for their kids, I guess?)
and then trading the remaining lands to the City of South Burlington, though they haven’t “oƯicially” stated either
of these things in this application. They also want to reconfigure the west end of Autumn Hill Road to be shorter
(remove the wetland crossing) and use the easement to connect to Windswept Ln. I think there are gong to be
some questions about access and how their proposal fits with the rules about private roads. The Board will review
this application on Aug 6. Please provide comments by Friday July 26.

undeveloped lot into two lots of 17.6 acres (Lot 1) and 1.9 acres (Lot 2) and reconfigure an existing private road
