Hi Brian,
I came to the site at 223 Highland Terrace and inspected the rain garden on Monday, August 5th, 2024, and found
that it matched the approved plan associated with final plat approval SD-21-21. Condition of Approval #20 of that
approval requires that the applicant provide a surety for this rain garden and specifies that the “surety shall be
released three (3) years after construction of the rain garden to ensure the plants have been established and have
a good chance of survival, subject to review and approval of the Zoning Administrator”.
The surety in question was created on 9/2/2022, and a copy of that agreement is linked here: https://sbvt-

That surety can be released no sooner than August 5th, 2027, which will be exactly three years from the date that
the Zoning Administrator found that the rain garden was constructed in accordance with the approved plan.
