SITE PLAN APPLICATION #SP-24-25 FINDINGS OF FACT AND DECISION Heritage Automotive Group, Inc., hereinafter referred to as the applicant, is seeking after-the-fact approval to amend a previously approved site plan for a 112,453 sq. ft. automotive dealership. The amendment consists of installing a concrete pad mounted transformer, amending the landscaping plan, and installing bike racks and their associated concrete pads, 1600 Shelburne Road. Based on the plans and materials contained in the document file for this application, the Administrative Officer finds, concludes, and decides the following: FINDINGS OF FACT 1. The applicant is seeking after-the-fact approval to amend a previously approved site plan for a 112,453 sq. ft. automotive dealership. The amendment consists of installing a concrete pad mounted transformer, amending the landscaping plan and installing bike racks and their associated concrete pads, 1600 Shelburne Road. 2. The owner of record of the subject property is Heritage Automotive Group, Inc. 3. The subject property is located in the Commercial 2 Zoning District, The Transit Overlay District, and Zone 3 of the Traffic Overlay District. The application was received on July 5, 2024.The plans submitted consist of the following: ZONING DISTRICT & DIMENSIONAL REQUIREMENTS Commercial 2 Zoning District Required Existing Proposed  Min. Unknown No change √ Criterion met SITE PLAN REVIEW STANDARDS Only the standards below are affected by this application. All other standards will continue to be met. 14.07 Disposal of Wastes Per Section 14.07.I, dumpsters “shall be accessible, secure and properly screened with opaque fencing to ensure that trash and debris do not escape the enclosure(s)”. The applicant has testified that the existing dumpster enclosure meets all applicable standards. The Administrative Officer finds this criterion met. The property has several buildings, totaling 112,453 square feet GFA, and therefore is required to provide short-term parking spaces for 22 bicycles. As per Section 13.03.B(1)(a), the applicant must meet at least 50% of the short-term bicycle parking requirement as part of the first Site Plan Amendment and meet 100% of that same requirement as part of any subsequent Site Plan Amendments. This is the first site plan amendment since the rule was implemented. As such, the applicant must provide 11 total short-term bicycle parking spaces to meet 50% of the total requirement. The applicant is proposing to install six inverted-U bike racks, providing 12 short-term bicycle parking spaces. The Administrative Office finds this criterion met and notes that the applicant must provide 10 additional bike parking spaces at the time of the next Site Plan application in order to fully meet the bike parking requirement. 13.04.I Landscape Maintenance Per Section 13.04.I, “All planting shown on an approved site plan shall be maintained by the property owner in a vigorous growing condition throughout the duration of the use”. The applicant is proposing to move five plants from a parking lot island that now contains a utility box associated with EV chargers to a more prominent location on the property. The Administrative Officer finds that this relocation of landscaping features does not reduce the value of the landscaping features provided on the property and is therefore an allowable modification of the previously approved landscaping plan. The Administrative Officer finds that the utility box is effectively screened from the public right of way by site topography, and therefore requires no specific or additional screening – as such, no fencing or landscaping is required to be installed. 13.04.B(7) Snow Storage Per Section 13.04(B)(7), “snow storage areas must be specified and located in an area that minimizes the potential for erosion and contaminated runoff into any adjacent or nearby surface water.” The snow storage areas are indicated on the site plan. The Administrative Officer finds this criterion met. 13.07 Exterior Lighting Per Section 13.07.A, exterior lighting “shall have such shielding as will direct the light downward and will prevent the source of light from being visible from any adjacent residential property or street”. There are no lighting impacts proposed as part of this application. Traffic Impacts The proposed site amendments will not constitute an increase in traffic generation, and therefore the proposed change of use does not generate any new traffic impacts. Water & Wastewater Allocation The proposed site amendments will not constitute an increase in wastewater generation, and therefore the proposed change of use does not require any additional wastewater allocation. DECISION Based on the above Findings of Fact, the Administrative Officer hereby approves site plan application #SP-24-25 of Heritage Automotive Group, Inc., subject to the following conditions: 1. All previous approvals and stipulations shall remain in full effect except as amended herein. #SP-24-25 - 3 – 2. This project shall be completed as shown on the plan submitted by the applicant and on file in the South Burlington Department of Planning and Zoning as conditioned herein. 3. The applicant must obtain a zoning permit within six (6) months from the date of this decision or this approval expires and is null and void. The applicant may submit a request for an extension to obtain a zoning permit under the terms outlined in Section 17.04 of the LDRs, but the request must be submitted prior to the expiration of this approval. 4. Any exterior lighting must be installed or shielded in such a manner as to conceal light sources and reflector surfaces from view beyond the perimeter of the area to be illuminated. 5. The applicant must continue to maintain the approved landscaping in a vigorous growing condition throughout the duration of the use. 6. Pursuant to Section 15.13(E) of the Land Development Regulations, any new utility lines, services, and service modifications must be underground. 7. The proposed project must adhere to standards for erosion control as set forth in Section 16.03 of the South Burlington Land Development Regulations. In addition, the grading plan must meet the standards set forth in Section 16.04 of the South Burlington Land Development Regulations. 8. All short-term bicycle parking spaces must adhere to the standards outlined in Section 13.03.B(2) of the Land Development Regulations. 9. The applicant shall obtain a Certificate of Occupancy from the Administrative Officer prior to the use of the new walkways and bike racks. 10. Any change to the site plan shall require approval by the South Burlington Administrative Officer or the Development Review Board, as allowed under the Land Development Regulations.
