There will be probably a very small fenced -in area in the back to put such
things as packing cases until they are taken away. Everything else will be
inside.
Mr. Bolton said there had been a mess there for quite some time; old motors
kicking around. He said he expected to still have a mortgage on it so he
would definitely have an interest; with his buildings right next door he
would like to see this in decent condition too and this would be definitely
ahead of what has been there for the last six or seven years.
Mr. Bolton added that Bill Yilgour's father has a large tire business, the
same set-up, over in New York State, a really successful operation, so Bill
is not going to be struggling alone.
There was no further support and no opposition.
The Board voted unanimously to approve the request according to the plan
posted on the bulletin board and with the stipulation that there be no
equipment outside.
No. 3. APPEAL OF RUPERT & PHYLLIS KINGSLEY

Appeal of Rupert & Phyllis Kingsley seeking a variance- from Section 6.00,
Permitted uses of the South Burlington Zoning Regulations. Request is for
permission to operate a day nursery allowing for care of up to 12 children
which is an increase from a variance granted November 1, 19?2, at 4 Deane
Street.
Mr. Ward stated this was just a re -warning; he had nothing new to present
other than was presented last week. He said he had notified the neighbors
and Mrs. Yingsley had been requested by the Board at the last meeting to
bring in additional information and to submit something in writing from
her neighbors If they were favorable to the operation.
Mrs. Kingsley submitted her license to operate conditioned on the require-
ments of the State Fire Marshall being fulfilled; these requirements had
been read at the previous meeting. Also submitted were letters from several
neighbors stating they had no objection to the day nursery's expansion.
Mr. Sylvester asked if any of the children of these neighbors attended her
school, and Mrs. Kingsley replied she used to have some of them.
Chairman Myette said he was concerned about the impact of a variance of
this kind. He asked if there was any other evidence.
Mr. Kingsley said he had received a permit to do the work and he hoped it
had not run out. Mr. Ward explained the permit runs for six months.
Asked about the oglibation to have one other employee, Mrs. Yingsley said
the State insists on that if she has 12 children. With any more than 5,
she said, she would have to have someone to help her so she might as well
have the 12. The limit used to be 10 for one person but not any more,
Mr. Yartineau was concerned about this day nursery exceeding the limits of
a home occupation.
Mr. 'Ward explained it was never uarned as a home occupation but as a use
variance.
Mr. Myette, saying he was still concerned over the traffic impact, suggested
a stipulation that this request be reviewed in 12 months, if granted. He
then explained that it was customary for the Zoning Board In an unusual
situation to ask the Zoning Administrator to ronitor a particular use for

a year, with the variance expiring a year from the date granted, and the
applicant comes back in and 'the performance is reviewed, whether the
neighbors have any concern, etc.
It was noted the day nursery could not operate anyway without meeting the
State criteria; this would be governed by the State.
The Board voted 3 to 1 to approve this appeal with the stipulation that
the operation is to be reviewed when the variance expires at the end of
12 months.
Chairman Myette suggested to Mrs. Kingsley that she contact Mr. Ward at
least a month ahead of time in order that he could review the situation.

It was moved by Mr. Sylvester that the Minutes of July 19, 1976, be
approved subject to the following correction:
In the stipulation on page 3,the last three words "to be vacated" are to
be stricken and the following is to be added: if the Board determines at
the exp1ra ii2n date -that any appeal filed at that time to continue the
variance should be denied.
Seconded by Mr. Read and voted unanimously.

Appeal of Rupert & Phyllis Kingsley seeking a variance from Section
6.1o, Use regulations of the South Burlington Zoning Ordinance. Request
is for permission to operate a day nursery from a single family dwelling
unit, at 4 Deane Street.
Mr. Ward said that the area is zoned Residential District P. The request
is to operate a day nursery for 6 - 8 children depending on approval
of the state. The house is a ranch type, 241 x 38' or 912 square feet
and a detached garage of 240 squpre feet. The lot is 1001 x 701 and
is a corner lot. No construction or remodeling will be involved.
Mrs. Kingsley presented pictures of the driveway, the basement room
in case the state would allow her to use it and the proposed upstairs
room which she is planning on using. The upstairs room is 121 x 121
in size.

Mr. Myette asked the ages of the children.
Mrs. Kingsley said according to the state law she can only take 2
children under the age of 3 and the rest will be 3 or 4 years old.
Mr. Myette asked how she entertained the children.
Mrs. Kingsley said she has been running a nursery school in Burlington
since 1963 so is experienced with children.
Mr. Poger asked the hours the nursery would operate. He wondered if
they would be 8 - 4 or 9 - 5.
Mrs. Kingsley said it would be at the time the parents had to go to
work which would be between 8 and She said she furnishes the snacks
and lunches.
Mr. Poger asked if she had equipment she used for entertaining the
children. Mrs. King�;ley said she did. She also commented that there
were 2 exits from the room she is proposing to use.
Mr. Martineau asked if she planned to take the childfen outside to
play in the summer.
Mrs. Kinla,sley said yes that she would take them outside.
Mr. Poger asked if the outside play would be limited to the back yard.
Mrs. Kingsley said yes they would most of the time and that the back
yard had a fence and hedge so it was well screened from the neighbors.
Mrs. Kingsley presented the Foard with a list of neighbors that do
not object to the nursery school. The list of names i!� filed with and
made a part of these minutes.
Mr. Sylvester asked Mrs. Kingsley if she would have help. Mrs.Kingsley
aaid she did presently in Burlington and is planning on having one
person help here*

Mr. Myette asked if they had purchased the house yet.
Mrs. Kingsley said yes, but they have not move in as yet.
Mr. Myette asked how the state determines the number of children
allowed.
Mrs. Kingsley said they went by the square footage of the area to be
used so she did not feel they would allow her more than 8 children.
Presently in Burlington she has about 12.
Mr. Martineau asked about a hardship and if they needed the supplemental
income.
Mrs. KinFsley said she has always preferred to be with the children,
but supposed she could get a job outside her home. She said she likes
to be home when her children come home from school.
No further support or opposition. Poard recessed for discussion.
Mrs. Kingsley was asked what differs a nursery school from just baby-
sitting. She said you can take 2 families children and baby sit, but

if you take more than 2 familienchildren you are considered a nursery
sdhool and must get -a permit.
The school is operated Monday thru Friday all year around except on
her vacation.
Mr. Myette said the Board was considering a stipulation of 5 children
and said they could come back in the future to request expansion if
they found the state would allow more than 5 children. He said he wo-ald
not guarantee an expansion would be approved.
Board voted unanimously in favor of granting the variance with the
stipulation that a maximum of 5 children be allowed.

APPEAL #2 OF ARTHUR & JOYCE DAIGNAULT
Appeal of Arthur & Joyce Daignault seeking a variance from Section
6.110, Yard requirement of the South Purlington Zoning Ordinance.
Request is for permission to construct a two car attached garage,
221 x 251 in size, to within two and one half (2*) feet of the westerly
side yard, at 22 Imperial Drive.
Mr. Ward said it was Residential District B and he is requesting an
attached 2 car garage to an existing raised ranch. Mr. Ward stated
that Mr. Daignault is going to build a 201 x 251 garage instead of a
221 x 251 garage which would make the side yard 1+� feet instead of
2� feet. The required side yard for an attached garage is 15 feet.
The present garage will be converted into a family room.
Mr. Daignault said there is a very sharp turn to get into the present
garage. The front of the proposed garage sets behind the back of the
neighboring house. There will be approximately 60 feet from the street
to the front of the proposed garage. It will be finished with the same
materials au the house. He said he will blacktop the driveway and it
will remain in the same location. There is a fence with low bush,-s along
the lot line. There will be no windows on the westerly side of the
garage. The door on the present garage will be removed.
No further support or opposition. Board discussed the appeal.
Board voted unanimously in favor of granting the variance for a 201 x
251 garage.

Mr. William Duff explained that they had made 4 major changes to the
plan. They have moved the building back from 60 feet to 75 feet, go
feet is required; they have dropped from 120 parking spaces to 102
spaces; the trees in the front have been moved back in case of an
extra lane being constructed and they h�ave changed the location and
size of the entrance from East Terrace.
Mr. Myette asked if Bill Szymanski had looked over the site.
Mr. Ward said yes that he would rather the entrance be on East Terrace
than have it on Williston Road.
Mr. Myette asked if they would consider opening up a cut at the end
of the lot to join with the Gaynes parking lot of about 20 feet.
Mr. Duff said yes as far as he knew.
It was decided that the parking will have to be rewarned as a variance
of F cars is needed.
Mr. Myette said they could vote on the set -back.
Mr. Sylvester suggested waiting and voting on it all at once.
Mr. Myette said if they at least voted on the set -back he would be
assured of an affirmative answer.
The Poard decided to give an affirmative concensus and wait until the
parking variance is rewarned and at the same time will rewarn the set-
back for 75 feet instead of the original 60 feet.

Re: Conversion of Basement for Day Care Home
Dear Mr. & Mrs. Kingsley:

This is to confirm meeting and discussion of necessary requirements to move your
present day care service to basement area of your home, with you on Feb. 19, 1976.
#1 - Furnace shall need to be enclosed in a room of its own. You have
already protected the ceiling area over furnace. New walls, which are
not of masonry shall be covered on each side of studding with one
layer of 5/8 inch Fire Coded Sheetrock. Door, to swing inward to
furnace area, can be a "B" label fire door or a 1 3/4 inch solid core
door, you shall need to cover door, on furnace side, with one layer
of 5/8 inch Fire Coded Sheetrock and over this one layer of 28 gauge
galvanized sheetmetal. Cover door frame jamb and stops with same
sheetmetal so it will be continuous. Put a self -closer to door or a
bolt and eye so will always be closed.
You also shall need to consider providing an ample amount of oxygen
for proper exhaust and combustion of furnace. This can be achieved
by installing a fire damper which is automatic, along lower part of
wall or you may install a metal louver, providing you install some
metal guides on furnace side and hold in suspension a piece of 5/8 inch
Fire Coded Sheetrock over and above this grille or louver, by a
weighted line and a fusible link. The fusible link shall be centered
at ceiling level over face of furnace.
I also recommend that you cover ceiling of this enclosure with same
rated sheetrock, to give you a longer element of time, for your own
safety as well.
#2 - Area which will be used for a lavatory shall have walls, which are
not of masonry covered with 5/8 inch Fire Coded Sheetrock. Ceiling area
shall also need to have same rated sheetrock. Have ceiling as near as
possible to head opening of entrance access. As explained you can not
put a full door on this opening. If privacy is desired you may utilize
a cafe style arrangement.

#3 - A second means of egress from this level to the exterior shall be
necessary. Door shall be at least 36 inches wide and as near
80 inches in height as permissible, with sill above. Suggest door
swing outward onto a foyer of about 44 inches square. Door would be
required to swing out if you ever go over 12 children. Door may be
of your choice, however, it would be well to consider one which has
some large lites of glass. If you decide to swing door out, equip
door with a self -closing device and panic hardware or a schoolhouse
lockset.
The necessary steps to grade shall be at least 2 X 10 finished
dimension lumber and at least 36 inches in length. Construct same
as near a 45' degree angle as possible. Risers are not required but
have space between treads be no more than 7 1/2 inches. Hand rail
to accommodate children on each side shall also be needed. Overhead
protection is recommended but.not required if kept clear of winter
elements.
#4 - Furnish on 5� A.B.C. Dry Chemical or CO2 type extinguisher for this
area and hang on proper bracket so top of unit is no higher than
64 inches from finished floor. Perhaps it could be near door opening
to store room area, whereby it would be handy for that area as well.
#5 - Paint ceiling area of activity room with Fire Retardant Paint.
Suggest using, for any other painting, other than for masonry.
#6 - Installation of any carpeting and necessary padding shall be no
greater than that of a Class "C" Fire Hazard Classification.
Curtains and/or draperies are not recommended, however, if you
decide to do so, material shall be fire retardant or treated to be
flame resistant.
#7 - Waste containers to be of metal with metal covers applied or those
which have tight metal sides and self -closing metal tops.
#8 - Door at first level leading to basement area shall be rehung so not
"fo swing out over the stairs. Cover this door on basement side with
one layer of 3/8 inch plywood. Equip with a self -closer so it will
always be closed.
I believe this is all of that which we discussed and mutually agreed upon. If you
have any questions or changes please let me know. Also all will need to be done
before beginning on lower level.
