Mr. Goddette said the proposed use is a fire station which is allowed in this district and it will not affect existing facilities. (b) The character of the area affected. Mr. Goddette said the essential character of the area will not be.affected. (c) Traffic on road and highways in the vicinity. Mr. Goddette said this has no affect on traffic and roads. (d) Bylaws then in affect. Mr. Goddette said this will not affect bylaws. (e) Utilization of renewable energy resources. Mr. Goddette said this does not affect the general public and welfare of the community. Mr. Blais said that's the minimum height that you can get. Mr. Goddette replied yes. Mr. Goddette said if any of you gentlemen would like to get a tour of the building I would be happy to show it to you. This will be in operation within a week or so. Appeal granted 4 - 0 with 1 abstention. No. 3 Appeal of Tvaate Properties d.b.a. Econo Lode Appeal of Tygate Properties d.b.a. Econo Lodge seeking approval from Section 19.35 Filling with earth products, request is for permission to fill an area containing approximately 33,000 square feet to a maximum depth of 25 feet, located to the rear of the Econo Lodge, 1176 Williston Road. Mr. Ward said area is C-1 District. Section 19.35 Filling with earth products - approval necessary by Zoning Board subject to Section 19.352. Area in question approximately 33,000 square feet to rear of Econo Lodge to a maximum depth of 25 feet. See memo enclosed from Bill Szymanski. Mr. Krassner stated that he reviewed the plan today and felt the appeal was not properly warned. He felt the filling was encroaching into the Conservation - Open Space District. Mr. Ward stated that he inspected the site and discussed the request to fill the area with Bill Szymanski. The Conversation - Open Space District is defined as a 50 foot setback from the centerline of the streams or at an eight foot contour above the low water mark. Mr. Ward stated that he feels the request is properly warned and felt that this -4- was not the proper time to challenge the warning. If Mr. Krassner wishes he should appeal the administrative decision. After review of the prevailing sections from the zoning regulation, the Chairman ruled that the appeal has been properly warned. Mr. Lamphere explained the whole property from the sketch and there was some discussion as to the location where the fill would be going. Mr. Condos asked if the trees would be removed from this area and Mr. Lamphere replied they would be. Mr. Graf asked why they were filling this area and Mr. Lamphere said for parking but I don't know their long terms plans. Mr. Krassner said I think that there should be an appeal for a variance to fill the RCO. Mr. Blais said under 19.35 Removal of or Filling with Earth Products. In any district, except when incidental to or in connection with the construction of a building on the same lot, shall be permitted only on approval of the Board of Adjustment after public notice and public hearing. Mr. Ward said filling with earth products has always been before this board in any district. Bill doesn't consider that part of the Conservation District. Mr. Condos asked presently the area that's to be filled is what. Mr. Ward said it's a man made drainage way. Mr. Condos said I need clarification. Mr. Ward said there is no flat area in the bottom of a ravine. Mr. Lamphere said all it does is continue the slope of the drainage in that area - the only water in that stream is from the parking lot. At the present time there are catch basins where the majority of the drainage goes. Mr. Grasson said is it that the Conservation zone is only 8' up or is it the 50' from the center line of the stream. Mr. Ward said the idea is not to block the drainage way - will have at least a 40' swat through the ravine. Mr. Blais said I don't have any problem with the warning - I think this appeal can be heard. Mr. Boehm said how about bringing it back 50'. Mr. Lamphere said it's better to continue the slopes and keep them together - it makes the slopes continuous. Mr. Boehm asked what's the slope. Mr. Lamphere said I don't have a scale but we're picking up 25' in about 60' approximately. Mr. Boehm moved that if we approve this appeal that we stipulate that they move the bottom toe of the fill 50' horizontally from the center line of the minor stream. This was seconded by Mr. Condos and voted aye. Mr. Blais read the following memo dated June 17, 1988 from Mr. Szymanski. I. A two car garage partly within the fill area is not shown on the plan. 2. Only clean fill shall be used. That does not include trees, stumps, wood or demolition waste. 3. Erosion protection shall be used during construction. 4. The filled slope shall be top soiled and seeded. Mr. Condos moved that if this is approved that it follow Bill Szymanski's memo dated June 17, 1988.
