I have attached a plat, an enlarged site plan showing the relocation, an overall plan of Technology Park for orientation, and atypical section. The reason for this request is due to the installation of three Green Mountain Power (GMP) electric vaults (aka MTC cabinets) which are located along Community Drive in front of the new building being constructed known as Parcel B (formerly Lot 7). These above ground MTC cabinets are located approximately 2 feet outside the existing right-of-way. GMP designed, and inadvertently installed these closer than the required five foot setback to a property line or right -of way, as required under the current South Burlington Land Development Regulations. Since the utility lines have been installed and activated, relocating these large structures would be extremely difficult and time consuming, as well as very expensive. Since the building is close to completion, Technology Park will need to apply for a Certificate of Occupancy soon. We have been told by the Planning & Zoning Sta$'that a Certificate of Occupancy will not be issued if the electric vaults don't comply with the City regulations. After reviewing all the options, and discussing it with Planning Staff as well as Department of Public Works, it was decided a simple and minor adjustment to the right -of --way was an acceptable solution. We are respectfully requesting the City Council approve this relocation, which involves equal portions of a very small amount of land that would be transferred (quit claimed) between Technology Park Partners and the City of South Burlington. The existing roadway (Community Drive) would remain where it is, but a portion of the right-of-way would shift west approximately three feet. You suggested we submit this information to you today (7/18/07), so you could forward it to Steve Stitzel, the City's attorney. Would you please notify us if you are not able to send this information onto Mr. Stitzel, and we will provide him with copies of this letter and the plans directly? P.O.
