DEVELOPMENT REVIEW BOARD 2 OCTOBER 2018 The South Burlington Development Review Board held a regular meeting on Tuesday, 2 October 2018, at 7:00 p.m. in the Conference Room, City Hall, 575 Dorset Street. MEMBERS PRESENT: B. Miller, Chair; J Smith, J. Wilking, F. Kochman, M. Cota, B. Sullivan ALSO PRESENT: D. Hall, Zoning Administrator; M. Keene, Development Planner; A. Torrizo, J. Pease, W. Murray, F. Nesti, J. Anderson, C. Galipeau, O. Hansen 1. Directions on emergency evacuation procedures from conference room: Mr. Miller provided directions on emergency evacuation procedures. 2. Additions, deletions, or changes in order of agenda items: No changes were made to the Agenda. 3. Comments and questions from the public not related to the Agenda: No issues were raised. 4. Announcements: Ms. Keene introduced Delila Hall, the new Zoning Administrator. 5. Continued conditional use application #CU-18-10 of Marcel Beaudin to reconstruct an existing timber retaining wall and add a handrail, 36 Brigham Road: The applicant was not present. Ms. Keene noted that staff had received the landscape plan. The City Arborist has said that there were no concerns. The Board felt no particular erosion control is needed because of the limited amount of disturbance. Mr. Cota moved to close CU-18-10. Mr. Wilking seconded. Motion passed 6-0. 6. Continued miscellaneous permit application #MS-18-04 of Alexandra Fogg for stormwater upgrades within the VELCO property. The upgrades consist of construction of a gravel wetland and pretreatment forebays: Mr. Pease noted there are two properties involved in this application, the VELCO property on the Shelburne/South Burlington town line and the Burlington Self-Storage property in South Burlington. The plan is to construct a gravel wetland stormwater system (similar to the one of Kerri Lane) to treat runoff by managing a one-year, two-inch storm on about 120 acres. Mr. Torrizo said they looked at several options for treatment and arrived at this option as the best in terms of feasibility. Work is scheduled for summer/fall of 2019 and will be funded through several agencies. The State wetland program has reviewed the project. They determined that the wetland involved is small and isolated and of low value and that replacing it outweighs the impact of eliminating what is there now. Mr. Pease said there is supposed to be a rare species of rush in the area, but it has not been located. They have gotten clearance to go ahead with the project. Ms. Keene noted that Staff has seen the e-mail from the State wetlands program relating to this application. Members had no issues. Mr. Miller noted receipt of a letter from Frances Nesti outlining her concerns. Mr. Torrizo said the project will not bring any additional runoff to the area. It is also not feasible to do any work next to Mrs. Nesti’s house. They also looked at bringing the water out to the north. The tech person with the Impaired Watershed Department advised against that because it would increase the flow to an impaired stream that already has too much flow. Mr. Pease added that this project is a benefit to Mrs. Nesti’s property. Although they can’t eliminate what is happening now, they will be providing cleaner water. Mr. Miller noted that Mrs. Nesti says she will not accept the flow, but that the applicant says this project will decrease the flow and make it cleaner. Mr. Pease agreed that is the case. Mr. Torrizo said the rate of flow will be reduced. Mr. Miller said that Mrs. Nesti noted the pipe size will be increased. Mr. Torrizo said that is true, but the flow is being held back. Mrs. Nesti said that while she is pleased the project is being done, she will not accept the discharge flow on the southeast side of her property. She felt it is illegal for impaired water to run into unimpaired water and that this project will be discharging impaired water into Shelburne Bay which is south of an approved area for discharge 800 feet away. She said these problems must be solved before the project proceeds. Mr. Miller noted the DRB has minimal authority regarding the water flow onto the Nesti property and has no control over the discharging of impaired water which is under State control. He added that it sounds like the project will reduce and clean the flow of water to the Nesti property. Mrs. Nesti cited what is being added to the flow from different neighborhoods and from businesses, and she will not let it be discharged onto her property. She said there are additional conduits being directed to her site. Mr. Torrizo said there are other pipes to ensure the flow comes to the treatment practice but no additional flow and only one outlet. The water will go into the wetland where it should be. The culvert under the railroad will not be touched. Mr. Murray said there has always been water in the ravine, probably from either side of the railroad tracks. Mr. Pease said they have been working with Mrs. Nesti for a long time. All the properties with permits upstream have been maintained and they are cleaning up the swale at Burlington Self-Storage. Mr. Cota moved to close MS-18-04. Mr. Wilking seconded. Motion passed 6-0. 7. Continued site plan application #SP-18-43 of Chamberlin Construction to amend a previously approved plan for a 32,000 sq. ft. temperature controlled self-storage and 35,850 sq. ft. of self-storage in eight buildings. The amendment consists of constructing a conveyance swale and pretreatment forebay. The pretreatment forebay discharges to a gravel wetland proposed to be located on the adjacent parcel, 123 Nesti Drive: Mr. Wilking noted he does business with the applicant but did not feel there was a conflict of interest. Mr. Torrizo said this is a similar situation to the previous agenda item. They are creating a system that will remove the “heavier stuff” before it goes into the storage area. There will be a more defined outlet to the main storage area as well. Ms. Keene asked about the flood lights. Mr. Pease said there are none. Ms. Keene said the existing lights need to be downcasting. Mr. Torrizo said the owner will address the lights in question. Regarding the bike rack, Mr. Torrizo said the one they had was hit by the plow and removed. It will be replaced. Ms. Keene said it must meet current criteria. This will be put in the approval motion. Ms. Hall directed attention to the graphic showing what is approvable. Mrs. Nesti felt the plan will not take care of all the debris from other sources. Mr. Pease said it will treat runoff from every location except from the Shelburne Bay Retirement facility which has its own system. VELCO gave the Town of Shelburne a 25-year license to manage the system at no charge. No other issues were raised. Mr. Cota moved to close SP-18-43. Mr. Wilking seconded. Motion passed 6-0. 8. Continued Sketch Plan Application #SD-18-16 of R. L. Vallee, Inc., to demolish an existing hotel and a portion of an existing service station and create a planned unit development consisting of an expanded service station with four additional fueling positions for a total of 12 and associated 9,000 sq. ft. retail sales building, 793 and 907 Shelburne Road: Mr. Sullivan recused himself due to a conflict of interest. Mr. Cota said he knows the applicant but didn’t feel he had a conflict of interest. Mr. Anderson said he thought the purpose of this meeting is to provide Board reaction to the material submitted by the applicant. Mr. Miller said the Board’s reaction to the material is that the proposal is not an acceptable project. Mr. Wilking added that it is a non-conforming use issue, and there is not a good way to get around that. Members are not swayed by the applicant’s arguments. Mr. Kochman said he didn’t feel the project is viable. He said the cases cited by the applicant involve the definition of a non-conforming use. He didn’t think that is the issue. He felt the issue is the enlargement of the structure housing a non-conforming use by adding more pumps. He also did not feel this plan qualifies as a PUD at all. In addition, the proposal to overcome the lot coverage issue is a “non‐starter” for him. He provided the applicant with written comments which he represented were his own and not the opinion of the Board as a whole. Mr. Anderson asked if the Board would share the opinion of the City Attorney. Members felt this was privileged information. Mr. Galipeau asked to continue the application so they can study the information they have been given. Mr. Wilking stressed that Mr. Kochman’s opinions are his own. The Board feels that what the applicant has presented is a non-starter. If the plan is changed so that it conforms, the board will be happy to consider it, but they do not want to re-argue what they have seen before. He summed up by saying there are issues related to non-conformity and the way to make it work is to meet the LDRs, not to find creative ways to get around it. That is not allowed. Ms. Keene noted if the applicant wants to present a different application, it would have to be rewarned. Mr. Galipeau said he didn’t see any harm in continuing. They will let staff know in advance if they are presenting a new application. Mr. Cota then moved to continue SD-18-16 to 6 November 2018. Mr. Wilking seconded. Motion passed 5-0. Mr. Sullivan rejoined the Board. 9. Minutes of 18 September 2018: Mr. Miller noted on p. 2, the sentence that ends “…to retained” should read “to be retained.” Mr. Cota moved to approve the Minutes of 18 September 2018 with the above correction. Ms. Smith seconded. Motion passed 6-0. 10. Other Business: No other business was presented. The Development Review Board held a public hearing on September 13 and October 2, 2018. The applicant represented himself. Based on the plans and materials contained in the document file for this application, the Development Review Board finds, concludes, and decides the following: FINDINGS OF FACT 1. The applicant, Marcel Beaudin, seeks a conditional use permit to reconstruct an existing timber retaining wall and add a handrail, 36 Brigham Road. 2. The owner of record of the subject property is Bernice Bayer. 3. The subject property is located in the Lakeshore Neighborhood Zoning District. 4. The applicant is proposing to reconstruct an existing structure within 150 feet horizontal distance of the high water elevation of Lake Champlain (elevation 102), subjecting the Project to the requirements of Section 12.01D. The requirements of Article 14 pertaining to Conditional Use also apply. 5. The application was received on August 10, 2018. 6. The plans submitted consist of a five (5) page set of plans and renderings with page one (1) entitled, “Proposed Repair of Existing Retaining Wall Bayer Residence 20 July 2018”, prepared by Marcel Beaudin. ZONING DISTRICT AND DIMENSIONAL REQUIREMENTS No changes are proposed to any of the dimensional requirements, therefore the Board finds a detailed review unnecessary. 12.01 D. PRE‐EXISTING STRUCTURES ALONG LAKE CHAMPLAIN AND WITHIN QUEEN CITY PARK (1) Applicability. The provisions of this section shall apply to preexisting structures within the areas defined as follows: (a) All land within one hundred fifty (150) feet horizontal distance of the high water elevation of Lake Champlain, which for purposes of these regulations shall be one hundred #CU‐18‐10 2 two (102) feet above mean sea level datum. Elevation 102 is located at a point located approximately 16 feet east of the existing home, as shown on the provided Existing Conditions plan provided by the applicant. Therefore the applicable area includes all portions of the subject property. (2) Expansion and Construction of pre‐existing structures. Within the areas defined in Section (D)(1) above, the expansion and reconstruction of pre‐existing structures may be approved by the DRB as a conditional use provided the requirements of the underlying zoning district and the following standards are met: (a) The structure to be expanded or reconstructed was originally constructed on or before April 24, 2000. For purposes of these Regulations, expansion may include the construction of detached accessory structures including garages and utility sheds. The applicant has represented the retaining wall to be replaced has been in existence since prior to April 24, 2000. (b) The expanded or reconstructed structure does not extend any closer, measured in terms of horizontal distance, to the applicable high water elevation or stream centerline than the closest point of the existing structure. No expansion in the direction of Lake Champlain is proposed. The Board finds this criterion met. (c) The total building footprint area of the expanded or reconstructed structure shall not be more than fifty percent (50%) larger than the footprint of the structure lawfully existing on April 24, 2000. For purposes of these regulations, reconstruction may include razing the existing structure and/or foundation and constructing a new structure in accordance with the provisions of the underlying zoning district regulations and this section. The applicant is proposing to remove a jog in the existing retaining wall was originally constructed to avoid a tree, which has since been removed. The existing jog to be removed is roughly parallel to the existing deck. The proposed realignment does not expand the existing structure. The Board finds this criterion met. (d) An erosion control plan for construction is submitted by a licensed engineer detailing controls that will be put in place during construction or expansion to protect the associated surface water. The existing retaining wall will remain in place. The applicant will remove existing vegetation to access the existing wall. The applicant has provided a proposed erosion control and landscaping narrative intended to reduce erosion along the base of the retaining wall due to spring stream flows. The applicant is not proposing to remove any vegetation greater than 2‐inches in diameter except for one ash tree which is anticipated to be susceptible to ash borer to prevent it’s spread. Due to the limited earth disturbance, the Board finds no erosion control plan prepared by a licensed engineer is needed. The Board finds this criterion met. (e) A landscaping plan showing plans to preserve, maintain and supplement existing trees #CU‐18‐10 3 and ground cover vegetation is submitted and the DRB finds that the overall plan will provide a visual and vegetative buffer for the lake and/or stream. The City arborist reviewed the proposed landscaping plan on 9/19/2019 and indicated no concerns. The Board finds this criterion met. 14.10 E. CONDITIONAL USE REVIEW Pursuant to Section 12.01D(2) of the South Burlington Land Development Regulations (Expansion and construction of pre‐existing structures), the proposed use shall be reviewed as a conditional use and shall meet the following standards of Section 14.10(E): 14.10E General Review Standards The Development Review Board shall review the proposed conditional use for compliance with all applicable standards as contained in these regulations. The proposed conditional use shall not result in an undue adverse effect on any of the following: (1) The capacity of existing or planned community facilities. This project will have no adverse effect upon community facilities. The Board finds this criterion met. (2) The character of the area affected, as defined by the purpose or purposes of the zoning district within which the project is located, and specifically stated policies and standards of the municipal plan. The Board finds that the proposed project is consistent with the stated purpose of the Lakeshore Neighborhood (LN) district, which is in part “to encourage residential use at densities and setbacks that are compatible with the existing character of the lake shore neighborhoods located in the vicinity of Bartlett Bay Road and Holmes Road. The district is designed to promote the area's historic development pattern of smaller lots and minimal setbacks. This district encourages the conversion of seasonal homes to year round residences.” The Board finds this criterion met. (3) Traffic on roads and highways in the vicinity. This project will have no adverse effect on traffic on roads and highways in the vicinity. The Board finds this criterion met. (4) Bylaws and ordinances then in effect. The Board finds this criterion met. See above for a discussion of compliance with surface water and nonconforming structure standards. (5) Utilization of renewable energy resources. This project will not affect renewable energy resources. The applicant must obtain a zoning permit within six (6) months pursuant to Section 17.04 of the Land Development Regulations or this approval is null and void. 4. Any change to the approved plan shall require approval by the South Burlington Development Review Board or the Administrative Officer. Numbered items for the Board’s attention are in red. CONTEXT The proposed stormwater treatment practice is located on the VELCO property. Pretreatment and conveyance occurs on the subject property as well as on the adjacent properties at 123 Nesti Drive to the North, being reviewed under application #SP‐18‐43, and on the BlueLynx property on Pine Haven Shores Road. The applicant has indicated that runoff from 102 acres, including a portion of Route 7, the self storage facility at 123 Nesti Drive, the Blue Linx property, and a portion of the residential neighborhood on the far side of Route 7 will be treated in this practice. This practice discharges to an unnamed tributary to Lake Champlain. The applicant has indicated the project is grant‐funded with a VTrans match. 3.12 ALTERATION OF EXISTING GRADE DRB approval is needed for the placing or removing of fill on land when the amount is equal to or greater than 20 cubic yards except when incidental to or in connection with the construction of a structure on the same lot. Based on the provided plans, the applicant is proposing to remove existing soils and import engineered material to create the proposed stormwater treatment practices. Quantity estimates are not available at this time but based on submitted plans, it appears that greater than 20 cubic yards of material will be placed. Provided site plans show the soil to be removed and the material to be placed as well as the existing grade and the proposed grade created by removal or addition of material. The Board finds this criterion to be met. SECTION 12.02 WETLAND PROTECTION STANDARDS These standards apply to all lands within 50‐feet of a wetland. (1) Consistent with the purposes of this Section, encroachment into wetlands and buffer areas is generally discouraged. (2) Encroachment into Class II wetlands is permitted by the City only in conjunction with issuance of a Conditional Use Determination (CUD) by the Vermont Department of Environmental Conservation and positive findings by the DRB pursuant to the criteria in (3) below. (3) Encroachment into Class II wetland buffers, Class III wetlands and Class III wetland buffers, may be permitted by the DRB upon finding that the proposed project’s overall development, erosion control, stormwater treatment system, provisions for stream buffering, and landscaping plan achieve the following standards for wetland protection: The applicant is proposing 200 sq. ft. of Class III wetland impacts and approximately 5,000 sq. ft. of Class III wetland buffer impacts. The wetland and buffer is being impacted for the purpose of constructing a gravel maintenance access road to the proposed treatment practice. (a) The encroachment(s) will not adversely affect the ability of the property to carry or store flood waters adequately; The proposed impacts are a small portion of the overall wetland. The Board finds this criterion met. #MS‐18‐04 Staff Comments 3 (b) The encroachment(s) will not adversely affect the ability of the proposed stormwater treatment system to reduce sedimentation according to state standards; The Assistant Stormwater Superintendent reviewed the plans on September 4, 2018 and offers the following comment. We have reviewed the Town of Shelburne Velco Property Gravel Wetland project, prepared by Chenette Associates, P.C., dated 7/11/18. We support this project in providing treatment to previously untreated stormwater runoff and have no further comments. Staff considers this criterion met. (c) The impact of the encroachment(s) on the specific wetland functions and values identified in the field delineation and wetland report is minimized and/or offset by appropriate landscaping, stormwater treatment, stream buffering, and/or other mitigation measures. 1. The applicant has provided documentation that ANR has classified the impacted wetland as Class III. No wetland report was submitted with the application. The applicant has stated they believe the functions and values of the wetland are low. The purpose of the project is to improve stormwater. Staff recommends the Board determine whether to allow the proposed 200 s.q ft. of wetland impacts and 5,000 sq. ft. of wetland buffer impacts. 12.04E(2) Drainage Structures To Accommodate Upstream Development – Culverts or other drainage facilities shall be of sufficient size to accommodate potential runoff from the entire upstream drainage area, whether or not all or part of the upstream area is on the applicant’s lot or the parcel subject to the application. In determining the anticipated amount of upstream runoff for which drainage facilities must be sized, the applicant shall design the stormwater drainage system assuming the total potential development of upstream drainage areas. All drainage structures shall be designed to, at a minimum, safely pass the twenty‐five year, twenty‐four hour (4.0 inch) rain event. The applicant’s engineer shall provide such information as the Stormwater Superintendent or his designee deems necessary to determine the adequacy of all drainage structures. The applicant provided an analysis demonstrating the impacts of the proposed project on the downstream culvert. The Board finds this criterion met. RECOMMENDATION Staff recommends that the Board discuss the Project with the applicant and close the hearing. Prepared By: Reviewed By: Rebecca Treat, EP Jeremy Roberts, PG, EP Project Geologist Environmental Program Manager 2017 Groundwater Monitoring and Soil Stockpile Screening Report Shelburne Road Variety, South Burlington, Vermont 1 1.0 Introduction and Background This report summarizes the quarterly groundwater monitoring and annual soil stockpile screening efforts performed between January 2017 and December 2017 at the Shelburne Road Variety property located at 1855 Shelburne Road in South Burlington, Vermont, (“Site”). A Site location Map is included as Appendix A. KAS, Inc. (KAS) conducted this work for the Champlain Oil Company (COCO), the owner of the Site. The January 2017 monitoring event was conducted in accordance with KAS’ Work Plan/Cost Estimate (WPCE) dated October 20, 2016 (revised October 24, 2016), which was approved by Mr. James Donaldson of the Vermont Department of Environmental Conservation (VTDEC) on October 26, 2017. All subsequent monitoring/screening efforts performed for the remainder of 2017 were conducted in accordance with KAS’ WPCE dated March 20, 2017, which was approved by Mr. James Donaldson of the VTDEC on April 6, 2017. Petroleum impacts were first encountered at the Site during underground storage tank (UST) removal activities conducted in October 2009 and April 2010. Subsequent monitoring of groundwater beneath and in the vicinity of the Site indicated dissolved-phase petroleum-related constituents in excess of applicable Vermont Groundwater Enforcement Standards (VGES). Additionally, non-aqueous phase liquid (NAPL) has been detected in select wells and impacts to nearby surface water and low lying wet areas has been documented. Since June 2015, KAS has intermittently operated a soil vapor extraction/air sparge (SVE/AS) remediation system at the Site. To date, the SVE/AS system has removed approximately 869 gallons of product (weathered gasoline) from the subsurface. The system has undergone periodic shutdowns to increase system efficiency. The most recent system shutdown occurred on January 5, 2017. Per requests made by the VTDEC in a letter to COCO dated February 24, 2017, the system remained off for the remainder of 2017 so an evaluation of groundwater quality temporal data trends could be performed. The current scope of work at the Site includes quarterly groundwater monitoring of fifteen site- related monitoring wells (MW10-2 thru MW10-6, MW11-7 thru MW11-11, MW12-12 thru MW12-15 and MW13-17), annual screening of an on-site soil stockpile and a visual inspection of sensitive receptors (low wet area and drainage area) during each groundwater monitoring event. Data deliverable packages for quarterly groundwater monitoring events performed in January, April and July 2017 were submitted to the VTDEC on February 1, 2017, May 23, 2017 and August 21, 2017, respectively. A summary of the soil stockpile screening efforts performed in July 2017 was included with the July 2017 groundwater data deliverable package. Results of the December 2017 quarterly monitoring event are summarized in this report; however, a discussion of all monitoring/ events performed in 2017 is also included. Previous reports documenting site history, investigative work, groundwater monitoring and remedial activities are on file at the VTDEC offices in Montpelier, Vermont. 2.0 Groundwater Monitoring 2.1 Determination of Groundwater Flow Direction and Gradient Depth-to-liquid measurements were collected from select site-related monitoring wells on four different occasions between January 2017 and December 2017 using a GeotechTM interface probe 2017 Groundwater Monitoring and Soil Stockpile Screening Report Shelburne Road Variety, South Burlington, Vermont 2 (IP). All four gauging events are discussed below. Liquid level monitoring data, both current and historical, are presented in Appendix B. On January 17, 2017, depth to water measured in on-site well locations ranged from 12.15 to 22.21 feet below top of casing (btoc). Depth to water measured in off-site wells ranged from 3.15 to 8.50 feet btoc. NAPL was not detected in any of the wells gauged. These measurements were within range of previous winter season levels and consistent with a seasonally low water table. On April 19, 2017, depth to water measured in on-site wells ranged from 10.75 to 19.82 feet btoc. Depth to water measured in off-site wells ranged from 1.73 to 7.95 feet btoc. NAPL was not detected in any of the wells gauged. Measurements at several locations were the highest reported to date and overall levels were consistent with a seasonally high water table. On July 26, 2017, depth to water measured in on-site wells ranged from 11.41 to 19.56 feet btoc. Depth to water measured in off-site wells ranged from 1.28 to 11.38 feet btoc. NAPL was not detected in any of the wells gauged. A seasonal lowering of the water table was evident at most locations; however, water levels rose at select locations since April 2017 (MW10-5, MW11-9, MW11-11, MW12-12 and MW13-17). Depth to water levels at two locations (MW12-12 and MW13-17) were the highest reported to date. On December 4, 2017, depth to water measured in on-site wells ranged from 11.96 to 21.56 feet btoc. Depth to water measured in off-site wells ranged from 1.56 to 11.11 feet btoc. NAPL was not detected in any of the wells gauged. A further seasonal lowering of the water table was evident at all but two well locations since July 2017 (MW12-15 and MW12-16) and depth to water levels in all wells were within range of historical measurements. For each gauging event, the water level measurements were subtracted from the top of casing to determine the water table elevation at each of the wells. The casing elevations were determined relative to an arbitrary datum of 100 feet established at MW10-2 by KAS in 2010. Groundwater level data are recorded in Appendix B. Groundwater elevation data for each event was used to generate the Groundwater Contour Maps included in Appendix A. The groundwater flow direction for all four events was generally oriented to the northwest at a hydraulic gradient of approximately 7.0%, which is consistent with historic results. 2.2 Groundwater Sample Collection and Analysis On January 17, 2017 quarterly sampling of thirteen site-related monitoring wells (MW10-2, MW10- 4, MW10-5, MW10-6, MW11-7, MW11-8, MW11-9, MW11-10, MW12-13, MW12-14, MW12-15, MW13-17 and MW13-18) was performed. A sample could not be collected from MW10-3 due to an insufficient amount of water in the well column. Monitoring wells MW10-1, MW11-11, MW12- 12, MW12-16 and MW13-19 were not included in the sampling program per VTDEC approval. Per requests made by the VTDEC in a letter to COCO dated February 24, 2017, quarterly monitoring for the remainder of 2017 included fifteen site-related wells: MW10-2, MW10-3, MW10-4, MW10-5, MW10-6, MW11-7, MW11-8, MW11-9, MW11-10, MW11-11, MW12-12, MW12-13, MW12-14, MW12-15 and MW13-17. Monitoring wells MW10-1, MW12-16, MW13-18 and MW13-19 were not included in the sampling program per VTDEC request. Quarterly sampling events occurred on April 19, 2017, July 26, 2017 and December 4, 2017. For the July 2017 event, a sample was not collected from MW11-7 as this well was not located due to thick vegetation. For the December 2017 event, KAS collected a surface water sample from an off-site drainage swale 2017 Groundwater Monitoring and Soil Stockpile Screening Report Shelburne Road Variety, South Burlington, Vermont 3 due to the presence of a visible sheen and odor on the water surface. No other deviations from the quarterly monitoring program requested by the VTDEC occurred. Groundwater and surface water samples collected were chilled and delivered under proper chain- of-custody procedures to Endyne, Inc. of Williston, Vermont. One trip blank and one duplicate sample were collected for quality assurance / quality control (QA/QC). All samples were analyzed for volatile organic compounds (VOCs) by EPA Method 8021B. A tabulation and graphic presentation of current and historical analytical data is provided in Appendix C and compared with the applicable VGES and Vermont Water Quality Standards (VWQS). The laboratory reports and chain-of-custody forms are presented in Appendix D. Analytical Results Results of the January 2017 quarterly sampling event indicated dissolved-phase concentrations in excess of VGES in eight of the thirteen wells sampled: MW10-2, MW10-5, MW10-6, MW11-8, MW11-9, MW12-14, MW13-17 and MW13-18. Select VOCs were reported in the samples collected from MW11-7 and MW12-3 but all concentrations were below VGES. No VOCs were reported above laboratory method detection limits in MW10-4, MW11-10 and MW12-15. Total reported VOC concentrations ranged from 4.8 to 14,399 micrograms per liter (ug/L) (MW10-2). Results of the April 2017 quarterly sampling event indicated dissolved-phase concentrations in excess of VGES in eleven of the fifteen wells sampled: MW10-2, MW10-3, MW10-5, MW10-6, MW11-8, MW11-9, MW11-10, MW12-13, MW12-14, MW12-15 and MW13-17. Select VOCs were reported in the samples collected from MW11-7 and MW11-11 but all concentrations were below VGES. No VOCs were reported above laboratory method detection limits in MW10-4 and MW12- 12. Total reported VOC concentrations ranged from 5.5 to 18,506 ug/L (MW10-6). Results of the July 2017 quarterly sampling event indicated dissolved-phase concentrations in excess of VGES in ten of the fourteen wells sampled: MW10-2, MW10-3, MW10-5, MW10-6, MW11-8, MW11-9, MW12-13, MW12-14, MW12-15 and MW13-17. Select VOCs were reported in the sample collected from MW11-11 but all concentrations were below VGES. No VOCs were reported above laboratory method detection limits in MW10-4, MW11-10 and MW12-12. Total reported VOC concentrations ranged from 3.7 to 17,865 ug/L (MW13-17). Results of the December 2017 quarterly sampling event indicated dissolved-phase concentrations in excess of VGES in nine of the fifteen wells sampled: MW10-2, MW10-3, MW10-5, MW10-6, MW11-8, MW11-9, MW12-13, MW12-14 and MW13-17. Select VOCs were reported in the samples collected from MW11-11 and MW12-15 but all concentrations were below VGES. No VOCs were reported above laboratory method detection limits in MW10-4, MW11-10 and MW12- 12. Total reported VOC concentrations ranged from 2.0 to 19,987 ug/L (MW10-6). Benzene, toluene and ethylbenzene were reported at concentrations above applicable VWQS in the drainage swale surface water sample. A total VOC concentration of 1,518 ug/L was reported for this location. Trend Analysis For the January 2017 monitoring event, a decrease in dissolved-phase VOC concentrations was observed in all but two wells since the previous respective sampling and all concentrations, except at MW10-6, remained below pre-system levels (prior to SVE/AS system). Increases were noted at MW11-8 and MW11-9 since the previous sampling in November 2016; however, concentrations in both wells were within range of post-system levels (after SVE/AS system). Of note, concentrations 2017 Groundwater Monitoring and Soil Stockpile Screening Report Shelburne Road Variety, South Burlington, Vermont 4 reported at MW11-7, MW12-13, MW12-4 and MW13-18 were the lowest reported to date and the levels reported at MW12-3 declined to below VGES for the first time. In April 2017, an increase in dissolved-phase VOC levels was observed at MW10-5, MW10-6, MW10-10, MW12-13, MW12-14, MW12-15 and MW13-17 since January 2017; however, all concentrations remained within range of post-system levels. Of note, concentrations reported at MW10-2, MW11-8, and MW11-11 were the lowest reported to date. In July 2017, dissolved-phase VOC concentrations increased at MW10-2, MW10-5, MW11-8, MW12-15 and MW13-17 since April 2017; however, all concentrations remained within range of post-system levels. Dissolved-phase levels at other locations decreased and concentrations reported at MW11-11 were the lowest reported to date. Dissolved-phase levels increased in December 2017 at MW10-2, MW10-5, MW10-6 and MW11-9 since July 2017; however, all concentrations remained within range of post-system levels. Total VOC concentrations at MW10-3, MW11-7, MW11-8, MW11-11 and MW12-14 are presently the lowest reported to date. Analytical testing of an off-site drainage swale indicates surface water downgradient of the Site continues to be impacted with petroleum constituents as of December 2017; present concentrations at this location are the highest reported to date. Current and historical data indicates dissolved-phase concentrations continue to fluctuate over time at select well locations; however, an overall long-term declining concentration trend has been observed at most well locations since monitoring began. Based on the current data, it appears the SVE/AS system, which began operation in June 2015, has been effective in reducing dissolved- phase concentrations beneath the Site. To date, the SVE/AS system has removed approximately 869 gallons of product (as weathered gasoline) from the subsurface. Percent decreases in wells to date since SVE/AS system operation are listed below. Because seasonal fluctuations in VOC concentrations are observed at most well locations, an average pre-system concentration was used to determine the percent decline to date. A percent decline for MW12-16 is not listed due to a lack of post-system analytical data. MW10-1: 88.4% (95.9 to 11.1 ug/L) – last sampled July 2016 MW10-2: 91.9% (103,724 to 8,400 ug/L) MW10-3: 99.1% (57,021 to 512 ug/L) MW10-4: 100% (242 ug/L to ND) MW10-5: 92.5% (85,981 to 6,421 ug/L) MW10-6: (101%) (9,937 to 19,987 ug/L) MW11-7: 97.0% (100.1 to 3.0 ug/L) MW11-8: 96.1% (837 to 32.8 ug/L) MW11-9: 90.1% (17,725 to 1,638 ug/L) MW11-10: 100% (195 ug/L to ND) MW11-11: 96.4% (82.9 to 3.0 ug/L) MW12-12: 100% (1.1 ug/L to ND) MW12-13: 99.4% (8,918 to 53.8 ug/L) MW12-14: 99.7% (35,449 to 105 ug/L) MW12-15: 99.9% (9,465 to 2.0 ug/L) MW13-17: 49.9% (31,689 to 15,880 ug/L) MW13-18: 96.6% (49,680 to 1,711 ug/L) – last sampled Jan. 2017 MW13-19: 68.8% (8,958 to 2,789 ug/L) – last sampled Nov. 2016 2017 Groundwater Monitoring and Soil Stockpile Screening Report Shelburne Road Variety, South Burlington, Vermont 5 The dissolved-phase levels at MW10-6 remain above the average pre-system concentration; however, similar levels have historically been reported at this location and an overall decline of dissolved-phase constituents in the absence of NAPL has been observed. This is the seventh consecutive sampling round for MW10-6 in the absence of NAPL. It remains unclear if NAPL will reappear in MW10-6 if/when significantly depressed groundwater levels, as observed in 2015, occur again. NAPL previously observed in monitoring wells MW10-2 and MW10-3 appears to have dissipated since system startup and remains absent even in light of the system not operating for the majority of 2017. Dissolved-Phase VOC Distribution The highest levels of on-site dissolved-phase VOCs in 2017 were reported in MW10-2, MW10-6 and MW13-17. These wells are located adjacent to or directly downgradient of the source area (former gasoline and diesel USTs) and have historically contained some of the highest concentrations noted on-site. Two of these wells (MW10-2 and MW10-6) have also previously contained NAPL. Reported concentrations of total targeted VOCs were plotted on the Site Map to create the Groundwater VOC Distribution Maps in Appendix A. Based on these maps, the core of the dissolved-phase plume is located on the northwestern portion of the property adjacent to and directly downgradient of the source area. The January and April 2017 maps show a clear break in the dissolved-phase plumes located off-site and on-site which is consistent with what was seen in November 2016. A noticeable change in the plume configuration can be seen in the July and December 2017 maps primarily due to increasing dissolved-phase VOC concentrations at MW10-5. These maps suggest the on-site and off-site plumes have merged again which could indicate that off-site migration has resumed in the absence of active remedial efforts. Current and historical data indicates the dissolved-phase plume has been mostly defined to the west, north and east where low to non-detectable concentrations have been reported in MW11-7, MW11-10, MW11-11, MW12-12, MW12-16 and upgradient well MW10-1. Quality Assurance and Quality Control No VOCs were detected in the trip blank samples prepared on January 17, 2017, April 19, 2017, July 26, 2017 and December 4, 2017. Relative percent difference (RPD) is defined as one hundred times the difference between the actual sample and the duplicate sample, divided by the mean of the two samples. RPD values are used to determine if adequate quality assurance and control (QA/QC) were maintained during sample collection and analysis. For the January 2017 sampling event, the duplicate sample was collected from monitoring well MW13-17. RPD ranged from 4.3% to 8.8% for the detected compounds indicating adequate precision. For the April 2017 sampling event, the duplicate sample was collected from monitoring well MW10-3. RPD ranged from 1.8% to 30.1% for the detected compounds indicating adequate precision. For the July 2017 sampling event, the duplicate sample was collected from monitoring well MW10-6. RPD ranged from 0.4% to 8.0% for the detected compounds indicating adequate precision. For the December 2017 sampling event, the duplicate sample was collected from monitoring well MW13-17. RPD ranged from 0.0% to 3.2% for the detected compounds indicating adequate precision. A tabular presentation of duplicate sample data and RPD results is included in Appendix C. 3.0 Soil Stockpile Screening On July 26, 2017, a KAS field technician screened the on-site soil stockpile with a photoionization detector (PID). A map showing the screening locations and results is included in Appendix A. Soil stockpile screening efforts are being performed as a means to monitor the expected decline in 2017 Groundwater Monitoring and Soil Stockpile Screening Report Shelburne Road Variety, South Burlington, Vermont 6 levels of VOCs over time. This was the first screening of the stockpile since it was completed in October 2014. PID readings at the time the stockpile was generated ranged from 2.3 to 9.1 parts per million (ppm). Screening conducted in July 2017 indicated a slight reduction in VOC levels with PID readings ranging from 0.2 to 6.0 ppm; however, these results may be biased low as an assessment of soils at the very base of the stockpile (3-4 feet) could not be performed due to significant amounts of coarse gravel encountered during sampling efforts. The stockpile was generated in 2014 as a result of corrective action plan (CAP) activities. Grossly impacted soils (>10 ppm) generated during the CAP activities were transported and disposed off- site while the remaining less impacted soils (<10 ppm) were stockpiled on-site at the request of VTDEC. Management of the stockpile polyethylene cover has proven difficult due to strong wind patterns driven by nearby Lake Champlain. The cover has been replaced and re-secured multiple times over the past 3 years. Despite KAS’ best efforts, securing the cover for a duration longer than 6 months has been unsuccessful. Given the low decline of VOCs over time, the management difficulties of the cover, the limited space available on-site for future thin-spreading and the close proximity of the stockpile to sensitive receptors (surface waters/wet areas), an alternative management plan such as off-site disposal should be considered. 4.0 Sensitive Receptor Risk Assessment A sensitive receptor risk assessment of the area surrounding the Site is provided below, and a determination of the potential risk to identified receptors has been made based on proximity to the dissolved-phase plume, groundwater flow direction, petroleum constituent mobility and volatility, and petroleum constituent concentration levels in subsurface soils and groundwater. Two sensitive receptors (low wet area and drainage swale surface water) other than soil and groundwater (on-site and off-site) have been identified as being impacted from the subsurface petroleum mass originating from the Site. The Site and surrounding properties are serviced by the public water system. According to the Vermont Agency of Natural Resources Atlas online mapping tool (http://anrmaps.vermont.gov/websites/anra/), there are no public supply wells within a half mile of the Site. There are however, six private supply wells within a half mile; the closest of which, is approximately 1,270 feet to the southeast.. Based on distance and direction from the source area, the private supply wells are not considered to be at risk from the subsurface petroleum mass originating from the Site. The closest buried utilities are municipal water and sewer lines located to the east (upgradient) of the source area. At this time the utility corridors are not considered to be at risk of acting as conduits for plume migration based on the depth of groundwater and distance/direction in relation to the source area. One main structure is present on the property, the convenience store building. The building is built on slab and was screened for VOCs with a photoionization detector (PID) during the UST closure assessment; no VOCs were measured above background conditions. Given its construction, the immediate and future risk for a vapor intrusion is considered to be low. The nearest off-site building is located approximately 125 feet south of the Site and is not considered to be at risk for vapor intrusion based on distance/direction of the source area. The closest buildings downgradient of the Site are located approximately 250 feet northwest. These buildings are storage units built on concrete slabs. Given their purpose these buildings are presumed to not be occupied by humans for an extended period of time. There are no buildings located in the 2017 Groundwater Monitoring and Soil Stockpile Screening Report Shelburne Road Variety, South Burlington, Vermont 7 immediate vicinity of the Site to the west or east. No residential buildings are present in the immediate vicinity of the Site. The nearest major surface water is Lake Champlain, located approximately 1,500 west of the source area. This surface water is not believed to be at risk from the subsurface petroleum mass originating from the Site due the significant distance from the source area. A low wet area is present in the immediate vicinity of the Site to the west/northwest where monitoring wells MW11-7 thru MW11-11 were installed. Petroleum sheens have previously been noted on the surface water in this area in addition to gasoline odors. Analytical testing of surface water in 2010 indicated petroleum constituents in excess of VWQS. A visual inspection of this area was performed during the monitoring events performed in 2017. A biological sheen was noted during the April 2017; however, no petroleum sheens or odors were observed. No sheens or odors were observed during the other monitoring events performed in 2017. A drainage swale is located approximately 200 feet northwest of the Site. Petroleum sheens and odors have previously been observed in this area. Previous analytical testing of this area detected petroleum constituents in excess of VQWS. In December 2017, KAS collected a sample from the swale due to the observance of a visible sheen and petroleum odor. Petroleum constituents in excess of VQWS were detected and the present concentrations are the highest reported to date. Previous analytical testing at upstream locations has confirmed that impacts to the surface water also originate from the adjacent Burlington Mitsubishi property (SMS# 99-2633). 5.0 Conclusions Based on the results of the quarterly groundwater monitoring and annual soil stockpile screening efforts performed between January 2017 and December 2017, the following conclusions are offered: 1. Depth to liquid measurements collected in January 2017 were indicative of a seasonally low water table whereas as seasonally high water table was observed in April 2017. An overall seasonal lowering of the water table was observed during subsequent monitoring events performed in July and December 2017; however, water table fluctuations were observed at select locations. The groundwater flow direction for all four events was generally oriented to the northwest at a hydraulic gradient of approximately 7.0%, which is consistent with historic results; 2. Depressed water table conditions in the vicinity of MW10-6 after system startup in June 2015 resulted in the appearance of NAPL in this well. NAPL in this well appears to have since dissipated based on the lack of observable NAPL for seven consecutive sampling rounds. However, groundwater levels have increased at this location therefore it is unclear if NAPL will reappear under future depressed conditions. NAPL previously observed in MW10-2 and MW10-3 appears to have dissipated due to successful remediation efforts in this area; 3. Select dissolved-phase VOCs were reported above VGES in eight of the thirteen wells sampled in January 2017. Total reported VOC concentrations ranged from 4.8 to 14,399 ug/L. Moderate increases in VOC levels were observed in two wells; however all concentrations, except at MW10-6, remained well below average pre-system levels and within range of post- system concentrations; 2017 Groundwater Monitoring and Soil Stockpile Screening Report Shelburne Road Variety, South Burlington, Vermont 8 4. Quarterly sampling in April 2017 indicated dissolved-phase VOCs in excess of VGES in eleven of the fifteen wells sampled. Total reported VOC concentrations ranged from 5.5 to 18,506 ug/L. Moderate increases in VOC levels were observed in seven wells; however all concentrations, except at MW10-6, remained well below average pre-system levels and within range of post-system concentrations; 5. Quarterly sampling in July 2017 indicated dissolved-phase VOCs in excess of VGES in ten of the fourteen wells sampled. Total reported VOC concentrations ranged from 3.7 to 17,865 ug/L. Slight to moderate increases in VOC levels were observed in five wells; however all concentrations, except at MW10-6, remained well below average pre-system levels and within range of post-system concentrations; 6. Quarterly sampling in December 2017 indicated dissolved-phase VOCs in excess of VGES in nine of the fifteen wells sampled. Total reported VOC concentrations ranged from 2.0 to 19,987 ug/L. Slight to moderate increases in VOC levels were observed in four wells; however all concentrations, except at MW10-6, remained well below average pre-system levels and within range of post-system concentrations; 7. Dissolved phase concentrations continue to fluctuate over time at select well locations; however, an overall long-term declining concentration has been observed at most well locations. It appears the SVE/AS system, which began operation in June 2015, has been effective in reducing dissolved-phase VOC concentrations in the vicinity of the Site. Dissolved- phase VOC concentrations in on-site wells, except MW10-6, have declined by more than 45% when compared to average pre-system concentrations. Concentrations in off-site wells have declined by more than 95%. While a percent increase is noted at MW10-6 when compared to an average pre-system startup concentration, the present concentration is within range of levels previously observed and an overall decline of dissolved-phase constituents in the absence of NAPL has been observed; 8. The dissolved-phase plume appears to extend at least 200 feet in a northwesterly direction towards an off-site drainage swale. The January and April 2017 Groundwater VOC Distribution Maps show a clear break in the dissolved-phase plumes located off-site and on-site. A noticeable change in the plume configuration can be seen in the July and December 2017 maps primarily due to increasing dissolved-phase VOC concentrations at MW10-5. These maps suggest the on-site and off-site plumes have merged again which could indicate that off- site migration has resumed in the absence of active remedial efforts. The dissolved-phase plume has been mostly defined to the west, north and east; 9. Screening of the on-site soil stockpile in July 2017 indicated a slight reduction in VOC levels with PID readings ranging from 0.2 to 6.0 ppm; however the results may be biased low due to the presence of coarse gravel which prevented an assessment of soils at the base of the stockpile. Given the low decline of VOCs over time, the management difficulties of the polyethylene cover, the limited space available on-site for future thin-spreading and the close proximity of the stockpile to sensitive receptors (surface waters/wet areas), an alternative management plan such as off-site disposal should be considered; and, 10. Two sensitive receptors (low wet area and drainage swale surface water), other than soil and groundwater (on-site and off-site), have been identified as being impacted from subsurface petroleum impacts during recent or past site investigations. Petroleum constituents in excess of VQWS were detected in the drainage swale surface water sample analyzed in December 2017 and present concentrations are the highest reported to date. Previous analytical testing 2017 Groundwater Monitoring and Soil Stockpile Screening Report Shelburne Road Variety, South Burlington, Vermont 9 at upstream locations has confirmed that impacts to the surface water also originate from the adjacent Burlington Mitsubishi property (SMS# 99-2633). 6.0 Recommendations Based upon the above conclusions, KAS recommends the following actions: 1. Continued quarterly groundwater monitoring of fifteen site-related wells and a visual inspection of sensitive receptors during each monitoring event. The next sampling event should occur in late January/early February 2018. Data deliverable packages should be prepared after each monitoring event and an annual monitoring report should be prepared after the November/December 2018 sampling event. A cost estimate for the 2018 monitoring/reporting activities should be prepared and submitted to the VTDEC; 2. Based on the apparent continued off-site migration of the dissolved-phase plume and the impacts identified in downgradient surface water, the system should be restarted in early February 2018 without the AS component to determine vapor recovery rates with SVE alone. A cost estimate for three months of full system operation should be prepared and submitted to the VTDEC. Recommendations for AS startup should be communicated to the VTDEC after one month of SVE operation. System recovery results and additional recommendations such as long term operation, change out to carbon treatment and/or pulse sparging should be provided as a data deliverable package/email summary after three months of operation; and, 3. Development according to commercial district regulations and multifamily development at the residential density specified for the applicable district shall be subject to site plan review, as set forth in Article 14, the purpose of which shall be to encourage innovation of design and layout, encourage more efficient use of land for commercial development, promote mixed‐use development and shared parking opportunities, reduce stormwater runoff and maximize infiltration, provide coordinated access to and from commercial developments via public roadways, and maintain service levels on public roadways with a minimum of publicly financed roadway improvements. This site plan is for the purpose of providing treatment for stormwater runoff. The Assistant Stormwater Superintendent reviewed the plans on September 4, 2018 and offers the following comment. We have reviewed the Town of Shelburne Velco Property Gravel Wetland project, prepared by Chenette Associates, P.C., dated 7/11/18. We support this project in providing treatment to previously untreated stormwater runoff and have no further comments. Staff considers this criterion met. B. Multiple structures, multiple uses within structures, and multiple uses on a subject site may be allowed, if the Development Review Board determines that the subject site has sufficient frontage, lot size, and lot depth. Area requirements and frontage needs may be met by the consolidation of contiguous lots under separate ownership. Construction of a new public street may serve as the minimum frontage needs. Where multiple structures are proposed, maximum lot coverage shall be the normal maximum for the applicable district. This site plan does not affect the existing structure or uses of the property. Parking, Access, and Internal Circulation (1) Parking requirements may be modified, depending in the extent of shared parking, the presence of sidewalks or recreation paths, and residences lying within walking distance (defined as no further than one‐quarter (¼) mile for purposes of commercial zoning districts). N/A C) SITE PLAN REVIEW STANDARDS Section 14.06 of the South Burlington Land Development Regulations establishes the following general review standards for all site plan applications: A. Relationship of Proposed Development to the City of South Burlington Comprehensive Plan. Due attention by the applicant should be given to the goals and objectives and the stated land use policies for the City of South Burlington as set forth in the Comprehensive Plan. Staff considers the proposed site plan meets the Comprehensive Plan stormwater objective 26 pertaining to improvement of watershed health. B. Relationship of Proposed Structures to the Site. (1) The site shall be planned to accomplish a desirable transition from structure to site, from structure to structure, and to provide for adequate planting, safe pedestrian movement, and adequate parking areas. No changes to the structures are proposed. Staff considers this criterion met. (2) Parking: (a) Parking shall be located to the rear or sides of buildings. Any side of a building facing a public street shall be considered a front side of a building for the purposes of this subsection. Parking is provided farther from the street than the nearest building. No changes to parking are proposed. Staff considers this criterion met. (b) ‐ (d) (not applicable) (3) Without restricting the permissible limits of the applicable zoning district, the height and scale of each building shall be compatible with its site and existing or anticipated adjoining buildings. (1) The Development Review Board shall encourage the use of a combination of common materials and architectural characteristics (e.g., rhythm, color, texture, form or detailing), landscaping, buffers, screens and visual interruptions to create attractive transitions between buildings of different architectural styles. (2) Proposed structures shall be related harmoniously to themselves, the terrain and to existing buildings and roads in the vicinity that have a visual relationship to the proposed structures. No changes to the structures are proposed. Staff considers this criterion met. #SP‐18‐43 Staff Comments 5 In addition to the above general review standards, site plan applications shall meet the following specific standards as set forth in Section 14.07 of the Land Development Regulations: (I) Access to Abutting Properties. The reservation of land may be required on any lot for provision of access to abutting properties whenever such access is deemed necessary to reduce curb cuts onto an arterial or collector street, to provide additional access for emergency or other purposes, or to improve general access and circulation in the area. No changes to access are proposed. The access to the proposed gravel wetland located on the adjacent VELCO property will be via the subject property. Staff considers this criterion met. (II) Utility Services. Electric, telephone and other wire‐served utility lines and service connections shall be underground. Any utility installations remaining above ground shall be located so as to have a harmonious relation to neighboring properties and to the site. No changes are proposed to the existing utilities. Staff considers this criterion met. (III) Disposal of Wastes. All dumpsters and other facilities to handle solid waste, including compliance with any recycling or other requirements, shall be accessible, secure and properly screened with opaque fencing to ensure that trash and debris do not escape the enclosure(s). The Site has an existing dumpster enclosure near the south property line. Staff considers this criterion met. (IV) Landscaping and Screening Requirements. (See Article 13, Section 13.06) Pursuant to Section 13.06(A) of the proposed Land Development Regulations, landscaping and screening shall be required for all projects subject to site plan review. The applicant is not proposing any building improvements therefore no landscaping is required. Staff considers this criterion met. F. Low Impact Development. The use of low impact site design strategies that minimize site disturbance, and that integrate structures, landscaping, natural hydrologic functions, and various other techniques to minimize runoff from impervious surfaces and to infiltrate precipitation into underlying soils and groundwater as close as is reasonable practicable to where it hits the ground, is required pursuant to the standards contained within Article 12. The purpose of this application is to install a forebay for the purpose of pretreatment of stormwater runoff. The project does not trigger the standards of Article 12. Staff considers this criterion met. G. Standards for Roadways, Parking and Circulation. Standards of Section 15.12 Standards for Roadways, Parking, and Circulation shall be met. No changes to roadways, parking and circulation are proposed. Staff considers this criterion met. D) OTHER 1. Lighting #SP‐18‐43 Staff Comments 6 Section 13.07 of the Land Development Regulations addresses exterior lighting as follows. A. General Requirements. All exterior lighting for all uses in all districts except for one‐family and two‐family uses shall be of such a type and location and shall have such shielding as will direct the light downward and will prevent the source of light from being visible from any adjacent residential property or street. Light fixtures that are generally acceptable are illustrated in Appendix D. “Source of light” shall be deemed to include any transparent or translucent lighting that is an integral part of the lighting fixture(s). Site illumination for uncovered areas shall be evenly distributed. Where feasible, energy efficient lighting is encouraged. The provided site plan does not include light fixtures. Staff notes the presence of a number of light fixtures on the property. Some of the existing building mounted light fixtures appear to be flood type fixtures, which are not allowed under this standard. 1. Staff recommends the Board require the applicant to remove any flood type fixtures or other fixtures which are not downcast and shielded. Staff recommends the Board ask the applicant whether they’d prefer to remove or replace the noncompliant fixtures so the condition of approval can be specific and agreeable to the applicant. B. Not applicable. 2. Bicycle Parking The minimum required short‐term bicycle parking for the building is 4 spaces based on 67,850 sq. ft. of warehousing/light industry. Section 13.14B(1)(b) allows existing bicycle racks to be counted towards the minimum requirements if they meet certain standards. At the time of the first site plan application, the applicant must provide at least 50% of the required number of short term bicycle parking spaces. The applicant has not demonstrated whether the existing bicycle parking meets the standards. 2. Based on available information, Staff believes the bicycle rack shown on the previously approved plan may no longer be present on the site. Staff recommends the Board require the applicant to install at least 2 bicycle parking spaces in the location of the previously approved bicycle rack. RECOMMENDATION Staff recommends that the Board discuss the Project with the applicant and close the hearing. Final Plat Application #SD‐18‐27 of JAM Golf, LLC, for re‐approval of a subdivision of a 47.99 acre parcel developed with a golf course into eleven lots ranging in size from 0.37 acres to 45.03 acres, 182 Golf Course Road: Mr. Marshall explained that they missed the deadline for filing legals and are back with the same application. A few things have been cleared up, and the character of the project is the same. DEVELOPMENT REVIEW BOARD 18 SEPTEMBER 2018 PAGE 3 Mr. Marshall referred to a letter from Mr. O’Leary regarding the proximity of the building envelope to his home. The developer has offered vegetative buffering and will continue to work with Mr. O’Leary, including possible improvements on his property. Mr. Marshall showed a landscape plan and indicated vegetation to the retained. He also showed a rock retaining wall built by a previous developer. Mr. O’Leary showed a picture of his property to members and noted there used to be trees on the back of his property. The retaining wall is 10 paces from his deck and doesn’t allow for a buffer. The only option is to do buffering on his property, which is not his favorite option. He felt the building envelope could be moved to allow a 20‐foot setback at the southeast corner. Ms. Keene noted the building envelope meets setback requirements, but the Board could ask the developer to look at that again. They also shouldn’t get too close to existing trees because the trees could be damaged. Mr. Marshall said they did look at changing the building envelope, but the applicant wanted to keep it as it is. Mr. O’Leary asked if it is under the DRB’s purview to ask the Planning Commission to work with a developer. Ms. Keene explained that every subdivision goes through a sketch plan, preliminary and final approval phase. Sketch is where “good,” “bad,” etc., takes place. The DRB did not have that opportunity in this case because it was a Supreme Court case and ruling. Mr. Wilking noted that the Planning Commission and DRB have been asked by the city to have more density in certain areas. Mr. Behr noted this application pre‐dates him and that sketch plan review is when the DRB would consider Mr. O’Leary’s issues. The DRB was given the project as a Supreme Court decision with very few “wiggle areas.” Ms. Keene noted that the Supreme Court does allow the Board to make a determination on compatibility with surrounding developed properties. Ms. Keene said the Supreme Court ruled that the application was complete and had to be heard as submitted. Mr. Sullivan added that decisions of the Vermont Supreme Court are perpetual unless stated otherwise. Mr. Wilking moved to close SD‐18‐27. Mr. Sullivan seconded. Motion passed 5‐0. 9. Final Plat Application #SD‐18‐28 of JJJ South Burlington, LLC, to amend a previously approved 258 unit planned unit development in two phases. The amendment is to Phase II (Cider Mill II) of the project and consists of increasing the number of residential units by 33 units to 142units in Phase II and 291 overall, and conservation of 21.7 acres of land through the purchase of 26 Transfer of Development Rights. The 142 units are proposed DEVELOPMENT REVIEW BOARD 18 SEPTEMBER 2018 PAGE 4 to consist of 66 single family lots, 46 units in 2‐family dwellings, and 30 single‐family units on shared lots, 1580 Dorset Street & 1699 Hinesburg Road: Mr. Sullivan recused himself as his law firm represents a party with a beneficial interest in this development. Mr. Cota noted he is a resident of Cider Mill. Members and the applicant did not feel this was a conflict of interest. Mr. O’Leary said they are currently approved for 109 units and they will be increasing that to 142 units. Changes since preliminary plat approval include a street plan and a little more landscaping. Staff comments were then reviewed as follows: #1 – The applicant agreed to show that single and 2‐family lot coverages are met. #2 – The applicant noted that with regard to lots #18‐34, the Board had agreed they were fine. They are 3‐6 feet above the existing grade to get flow to the pump station. The worst thing would be for someone to buy a house and have water draining toward the house. They have set grading so the house grading is 3‐6 feet above the road. Putting in 6 feet of fill is not an economic thing for a developer to do. Mr. Wilking and Mr. Cota said they had no issue with this. Ms. Keene said the pre‐construction grad is 3‐4 feet higher than the center line of the road. Mr. O’Leary said they can say the pre‐existing grade is no higher than 4 feet higher than the center line of the road. Ms. Keene said staff is concerned that homes will be different heights on opposite sides of the road. Mr. O’Leary explained why this won’t happen. He agreed to indicate the finished construction grade elevation on each lot. #3 – The applicant was OK with the conservation easement. #4 & #5 – The application was OK with water and wastewater permits and with amending of same where needed. #6 – The applicant has agreed to pay $1000 per unit toward the future extension of Cider Mill Drive ($142,000 total). Members felt this was a generous offer. #7 – The applicant was OK with Aurora not being for emergency use only. #8 – The applicant will update the open space management plan. DEVELOPMENT REVIEW BOARD 18 SEPTEMBER 2018 PAGE 5 #9 – Mr. O’Leary said the City Council has to approve “no parking” signs if violators are to be towed. Ms. Keene said the Council only approves retrofit signs and the Fire Chief wants the signs now so City Council doesn’t have to approve them later. The applicant will prepare a plan and have the Fire Chief and Public Works approve it. #10 – State permits will be amended. #11 – The applicant agreed to maintain the stormwater treatment system until the City takes it over. #12 – The applicant agreed to the revised grading request. #13 & 14 – The applicant agreed to both requests. #15 – The applicant noted they will not be grading on the Nadeau parcel. Any indication to the contrary will be corrected. #16 & #17 – The pre‐construction grade will be provided for each. #18 – The plant list will be revised. #19 – The applicant agreed to all the requirements with regard to wetland protection. #20 & #21– The applicant will confirm all delineation features and will add demarcation of side yards. #22 – Ms. Keene noted that staff is still looking for those committee records. #23 – Mr. O’Leary directed attention to sheet L‐6 which shows street trees on Nadeau Crest. #24 – Mr. O’Leary agreed to use whatever language staff wants. #25 – The applicant noted there are 2 culverts that drain from the Nadeau parcel. During a 25‐year storm, water ponds back onto the Nadeau parcel. The applicant will look to resolve that. #26 – Regarding easements, Mr. O’Leary said he believes they’re already recorded. Ms. Keene said staff can’t find these in the Land Records. Mr. O’Leary agreed to get them recorded if they were not already. DEVELOPMENT REVIEW BOARD 18 SEPTEMBER 2018 PAGE 6 #27 – The applicant agreed to correlate lot numbers and addresses. Public comment was then solicited as follows: Ms. Jewett was concerned with drainage onto the Jewett property. There also should be a right‐of‐way onto their property. Ms. Keene said the applicant will add the right‐of‐way. Mr. O’Leary noted there is a wetland between the two parcels. Ms. Keene added that the project is under state and local stormwater regulations and must meet existing flow rate at the property line. A resident was concerned with the increase in units over time. Mr. Wilking noted the applicant is filling in space that was allowed to be built. The density was already approved. The resident also noted the increased cost of city services and wildlife issues that were previously raised. Mr. Wilking noted that every one of the units pays taxes toward those services. Mr. Cota noted that when the road is built, there will not be guardrails to prevent wildlife crossings. Ms. Demaroney asked about an additional traffic study that Justin Rabideau had mentioned with regard to Cider Mill Drive. Ms. Keene showed a memo regarding the extension of the road. She knew of no additional study being planned. The Board confirmed that Ms. Demaroney should continue to coordinate with Justin Rabideau for information on a traffic study for the existing Cider Mill Drive. Ms. Cubino was concerned with the delay in getting the extension of Cider Mill Drive built and with the burden of traffic going onto neighborhood streets. She felt that the anticipated $700,000 cost was small relative to the total cost of the project, and encourages the Board to require the road to be built sooner rather than later. Mr. Darling didn’t feel that $142,000 was “a win” and waiting for the next developer would result in the road being built at an unknown time. He thinks the neighborhood in aggregate wants to see the road to be built, and is concerned that the fees paid by the developer will not actually be used by the road. Ms. Dopp cited 2 100‐year storms south of Vermont in the past 2 years and recommended “erring on the side of building more” protection. She was concerned about the applicant trivializing concerns about flooding. She also questioned whether there is checking after construction to see if there is compliance with all the requirements. Ms. Penar supported putting money aside for Cider Mill Drive but was concerned with cut‐ through traffic and cited the need for bump‐outs on the existing segment. She was also DEVELOPMENT REVIEW BOARD 18 SEPTEMBER 2018 PAGE 7 concerned that the open space was mowed in summer just as things are budding and recommends that mowing happen just before winter. Mr. Groves did not want Cider Mill Road to be extended. He did not feel it was intended to mitigate Cider Mill II. He cited the abundance of wildlife there. Mr. Wilking then moved to continue SD‐18‐28 until 16 October. Ms. Smith seconded. Motion passed 4‐0. 10. Minutes: No minutes were available for review. 11.
