Mr. Burgess made a motion to approve the amended minutes. Ms.
Peacock seconded. Motion passed unanimously.
3. Continue site plan application of S.S.L. Corporation for a change
in parking layout and circulation at the Gaynes/Price Chopper
Shopping Complex, Williston Road.
Mr. Burgess stated that the last time this was discussed, there was
some debate about this between the applicant, Mr. Senesac, and his
consultant and no one on the Commission was clear about wh�--t was
being recommended.
Mr. Weith presented the plan for Mr. Senesac. Mr. Hart had
recommended certain changes to the previous week's plans; the main
thing dealing with appropriate turning space for tractor trailers.
The applicant had done most of the improvements: they did bring the
curb back somewhat, and they are going to keep the pole where it is,
and keep the jersey barriers in line with the light pole to better
define the entrance. One thing recommended by Mr. Hart which was not
shown is that the exit curb should be scaled back a little bit more
to allow the turning radius. Mr. Weith recommended that that should
be done. Also, a double row of parking was shown near the Mobil
station, and Mr. Weith recommended against that because it would be
too tight. Mr. Weith also recommended against relocating the pole.
Mr. Burgess asked if the curb cuts would stop tractor trailers from
going across the curbs. Mr. Senesac said that tractor trailers would
not be able to go across them.
Ms. Peacock asked who is going to do the painting in the road. Mr.
Senesac said that he had been dealing with the City Manager, Sonny
Audette, and the State Highway Department, and he is trying to get
them to do it. The suggestion was that they would contract it out,
and that he (Mr. Senesac) would try to get the same contractor for
his work.
Mr. Senesac also stated that he would be responsible for paying for
the work on his property, and that he thought the state or the city
should be responsible for the work done on the road. He said that
Mr. Audette seemed to think that Mr. Senesac should pay for it all,
and that the City Manager and the State said that they don't care who
pays for it as long as they don't have to. Mr. Senesac said that the
situation needs to be resolved.

4. PUBLIC HEARING: Revised Preliminary Plat application of John
Larkin and Gerald Milot for construction of a planned commercial
development consisting of 150 multi -family residential units, a
40-room hotel, 60,000 square feet of office use and 40,000 square
feet of retail use on a 33 acre parcel located on Shelburne Road.
The changes that were made from the last Preliminary Plat hearing
were explained by Mr. Milot. In the original plan, there was a
townhouse and apartment configuration in the residential area; in the
new plans, the townhouse style apartments have been deleted and only
the three-story structures will be there. The reason for this was
because at the state level a problem occurred in regard to a new
ordinance from the Department of Water Resources, regarding
wetlands. There were several wetland issues and redesign was the
only alternative. Only one acre of wetland is allowed to be impacted
upon, and that is done by the.roads in this development. It was not
possible to put any buildings in the wetland areas. The definition
of wetlands has become much more severe under the new regulations.
Basically, any wet areas are now considered wetlands, and draining
them is not allowed anymore. Mr. Milot has designed around this
issue, giving his plan more open space, also adding amenities such as
a pool, tennis court and community building. The redesign consists
of fewer buildings, greater green space, and more amenities, still
allowing for the same number of units.

We represent The Merchants Bank, which holds leasehold
mortgages from Gaynes Plaza Partners, successor to SSL
Corporation, on Staples Plaza.
We saw a copy of your letter to Joseph Senesac, dated March
23, 1993, regarding violations of the site plan approval.
The Merchants Bank commenced a foreclosure suit against
Gaynes Plaza Partners in the Chittenden Superior Court on March
5, 1993. During the pendency of this suit, Merchants does not
own and cannot control the property. Merchants is seeking to
expedite the Court process so that possession and control of the
property would be transferred to it as soon as possible, but that
process is likely to take several months. In the interim, we
would appreciate copies of notices of violations and would like
to be kept apprised of any enforcement proceedings.

Dear Mr. Senesac:
This letter is to inform you that the above referenced property is
still in violation of the site plan approval granted by the South
Burlington Planning Commission on 3/24/92 (see enclosed letter
dated November 20, 1992). If you remember, in an effort to correct
the violation, you submitted an application to the City in December
1992 to obtain approval for the parking and circulation changes
that were actually installed on the site. This application was
subsequently withdrawn in order to give you more time to prepare
an accurate "as -built" site plan of the site (see enclosed letter
from Robert Roesler dated 1/21/93) Mr. Roesler indicated in his
letter of 1/21/93 that you planned to re -submit your application
during the week of January 25, 1993.
To date, the City has not received a re -submitted application.
Please be informed that a new, accurate site plan and application
form must be submitted to this office by April 9, 1993, or the City
will be forced to resume enforcement proceedings.

The applicant was not present, and members discussed how to
proceed. Members decided that since the applicant did not appear
and since the application was not complete, the Commission would
consider the application withdrawn.
5. Site plan application of Randy Berard for conversion of 2100
sq. ft. of unused space within an existing office/barn building
to general office use, 75 Ethan Allen Drive:
Mr. Berard said the area to be converted is the second floor of
the barn.
Mr. Craig noted the applicant is asking for credit for existing
landscaping as the plan is short. Mr. Weith said he felt there
was adequate existing landscaping. Members had no problem with
the $300.00 credit.
Mr. Craig asked if the lighting is all downcasting. Mr. Berard
said it was.
Mr. Austin moved the Planning Commission approve the site plan

This use would have less impact on the character of the
neighborhood if the parking lot could be constructed behind the
house. However, this would require razing the existing garage.
Parking: The day care use requires seven (7) parking spaces and
the one (1) dwelling unit requires two (2) spaces for a total of
nine (9) spaces required and nine (9) spaces are being provided.
The spaces for the residential unit will be inside the two (2) car
garage. The plan should show at least one (1) handicapped space.
The existing structures and the proposed addition meet the setback
requirements.
Lighting: Exterior lighting consists of four (4) 150 watt spot
lights and three (3) 100 watt porch lights.
Sewer: Sewer allocation needed for this project is 135 gpd. The
applicant will be required to pay the per gallon fee prior to
permit.
Sidewalk: Staff supports Bill Szymanski's position that a sidewalk
should be constructed. A sidewalk currently exists on this side of
Patchen Road from Williston Road to this property. It is logical
that the sidewalk should continue along this side of the street to
provide a safe access to J.C. Park. Also, Patchen Road is a
collector street and the 1991 Comprehensive Plan states that
"sidewalks ... which parallel roadways should be constructed on ...
one or both sides of collector streets...
Other: The dumpster will be screened by a fence.
4) STAPLES -PLAZA - PARKING/CIRCULATION CHANGES - SITE PLAN
This project consists of parking, circulation, exterior lighting,
landscaping and coverage changes made by the applicant since this
project was last approved by the Planning Commission on 3/24/92
(minutes enclosed). Staff discovered changes made to the approved
site plan in early November and has since been trying to get the
applicant to submit an accurate revised plan. Plan being reviewed
at the meeting is still not "as -built" and the applicant is aware
that a more accurate plan must be submitted (see enclosed letter
from applicant's attorney). Staff decided to leave this
application on Tuesday's agenda in order to get this issue resolved
in the near future.

Also part of this application is a request for 836 square feet of
additional office space. There currently exists 1600 square feet
of office space and with the addition there would be a total of
2436 square feet. This office space would be constructed on the
second floor and would be within the existing structure. It would
be used by the operators of the plaza and not leased out.
This property located at 861 Williston Road lies within the
Commercial 1 District. It is bounded on the south by undeveloped
property which is part of the Quarry Hill Club and Burlington
Tennis Club, on the east by I-89, on the west by the Chittenden
Bank and Spillane's Mobil station and on the north by Williston
Road.
Access/circulation: Access for the property will not change.
Access is currently provided by a 65 foot wide signalized curb cut
at the west end of the property which has two (2) lanes for ingress
and three (3) lanes for egress. Also existing is a 20 foot curb
cut which is located 220 feet east of the main access. This
smaller curb cut provides for egress only for those vehicles
proceeding in an easterly direction (i.e., right turn only).
The applicant has eliminated concrete curbing at the :westerly end
of the westerly access drive.
The double rows of parking located between Williston Road and the
building was not striped as previously approved (further discussed
below). This results in vehicles protruding into the two (2) one-
way lanes making them too narrow. The 3/24/92 plan called for
longer spaces with only one (1) lane (see enclosed parking lot
detail). This design results in safer traffic circulation and s
staff recommends that the previous parking layout between the p
center island and the building be implemented. St
Parking: The 3/24/92 plan showed a total of 340 parking spaces and
the plan being submitted shows 400 spaces. Staff recommends that
the parallel parking spaces in back of the building together with
the 12 spaces along the west end of the building be eliminated.
The parallel spaces would interfere with traffic circulation of
large trucks. The spaces at the west end of the building do not
allow for adequate aisle width between the two (2) rows of parking.
The elimination of these spaces would reduce the number of spaces
available to 366 spaces. Q

As briefly discussed above, the parking layout between Williston
Road and the building is different than was approved. The 3/24/92
plan showed these spaces being 20 feet long on either side with a
17 foot aisle. Instead, 16 foot spaces were striped leaving a 28
foot aisle with two (2) lanes. The approved design should be
implemented (see enclosed parking lot detail).
Traffic: No additional traffic will be generated by the office
expansion. Traffic generation for a shopping center according to
ITE is based on gross leasable area and since the office will be
used by the operators of the shopping center and not leased, no
additional trip ends will be generated.
Coverage/setbacks: Building coverage is now 35.6% (maximum allowed
is 30%). Building coverage, by staff calculations, has increased
by 2.9% since the last application. Overall coverage is now 93.2%
(maximum allowed is 90%). Overall coverage, by staff calculations,
has increased by 3.2%.
Plan does not accurately depict property lines, especially along
the southerly boundary. Apparently, there is little if any green
space between the edge of pavement and the property boundary. If
this is the case, the current plan has a higher overall coverage
percentage than the previously approved plan. If the current plan
is inaccurate then so was the previous plan which makes comparison
of overall coverage between the two (2) plans difficult.
Setback requirements are met.
Landscaping: Landscaping schedule and plan do not accurately
depict the existing plantings. Plan must accurately show number,
size, type and location of all existing and proposed plantings.
During discussions with the applicant on the site, it was learned
that the new landscaping along the southerly property line is not
on the applicant's property but is on the adjoining DesLauriers
property. Since this landscaping is not on the applicant's
property, it could all be removed without the applicant's and
Planning Commission's permission since the adjoining property is
not part of this site plan.

5) RANDY BERARD - OFFICE EXPANSION - SITE PLAN
This project consists of the conversion of 2,100 square feet of
unused space on the second floor in an existing barn to office
space. The Planning Commission approved office space on the first
floor on 2/6/90 and reapproved the project on 9/18/90 (minutes
enclosed).
This property located at 75 Ethan Allen Drive lies within the Mixed
Industrial Commercial District. There is presently a contracting
business, offices and a residence on the site. It is bounded on
the east by a vacant industrial lot, on the west by a contracting
business, on the north by Ethan Allen Drive and on the south by
Commerce Avenue.
Access/circulation: Access to the office space and contracting
business is via a 22 foot curb cut on Ethan Allen Drive and a 20
foot curb cut on Commerce Drive. The access drive extends between
the two (2) curb cuts. There is a separate curb cut on Ethan Allen
Drive for the residence.
Circulation is adequate.
Coverage/setbacks: Building coverage is 11.5% (maximum allowed is
30%). Overall coverage is 32.6% (maximum allowed is 70%).
All setback requirements are met except the front setback for the
house.

I called you on Monday, January 11th, in relation to the
Planning Commission meeting on Tuesday, January 12th. You did
not call me back. My message was simply that the applicant was
not ready to proceed and could not respond to the items raised in
your staff notes. This message, I believe, had also been
communicated to you by Mr. Senesac.
Furthermore, I fortuitously saw David Austin, one of the
commissioners, on Tuesday at noon. I also informed him that no
one would be in attendance since our information was incomplete
at this time.
As soon as the surveyor has completed his work, we will send
you an up to date plan and make the appropriate requests to
modify the existing permit. I must point out to you that there
is an error in your staff notes. Those notes imply that an
additional office would be added. It would increase the total
square footage of the office to 2400 square feet. It is my
understanding that the previously existing office is proposed to
be relocated and that there would be no additional square
footage. I will, however, confirm this with my client.

Your violation consists of laying out the parking lot in a
different manner and with different dimensions than is shown on the
approved site plan. Your violation also consists of making
exterior lighting changes without prior approval from the City
Planner.
Pursuant to 24 VSA 4444 you have seven ( 7 ) days in which to -correct
this violation or be subject to legal action by the City of South
Burlington and fines of up to $50 per day for each day the
violation continues. You will not be entitled to an additional
warning notice for a violation occurring after the seven (7) days.

Thank you for your letter of December 23. I apologize for
not getting back to you sooner, but it has been a busy holiday
season. Mr. Senesac is prepared to respond to the issues raised
in your letter of the 23rd and will be filing a revised plot
plan. It will, however, take some time for the surveyor to
complete the work so that we can adequately describe the basis
for these changes and the actual boundary lines as they have now
been found to exist on the ground.
Specifically, in regards to the landscaping, it was my
understanding that what was installed was considerably more
extensive and more expensive than that which was required by the
Commission. Hopefully, the revised plan will demonstrate that to
the Commission sufficiently. The as -built plan will certainly
will show the lot lines, drainage and sewer improvements.
Finally, I am sure that Mr. Senesac will, in fact, have
discussions with the Fire Department concerning the parking
spaces on the west side of Gaynes, near Price Chopper.
We will be in touch as soon as this information is complete.
I would hope to be on the Planning Commission schedule sometime
in January.

I received a copy of a letter dated November 5th, 1992 from
Ray Belair, South Burlington's zoning and planning assistant. In
it he references the changes that you found necessary to make in
the parking lot as the project developed. However, as we are
both aware, these changes are not exactly in conformance with the
plan that was approved by the South Burlington Planning
Commission.
I am, by copy of this letter, notifying Paul Wamsganz that
we need to update the site plan. I am sure that he will need
approval from you before he commences any work. Would you please
contact him and give him that approval. Please note that the
request for a modification of the site plan must be made by the
19th of November. I am sure that Paul can perform the work in
that time if you give him proper notification.

This letter is a follow up to my letter of the 18th of
January. Mr. Senesac is willing to withdraw the existing
application and re -submit it when the survey of the property
boundaries has been completed. We anticipate that the completion
of this survey will be done by the end of this week, the week of
the 18th. If, in fact, that occurs as planned we will re -submit
the application the week of the 25th. The only reason that we
will be delayed is because of the surveyor.
I understand that you have agreed that if we withdraw this
current application and re -submit it, it will be re -submitted at
no cost. If I misunderstand our agreement, I would appreciate it
if you would get back to me promptly. I am not authorized to
withdraw this application if, in fact, it will cost an additional
filing fee.

sq. ft. of existing office space, Gaynes Shopping Center, 861
Williston Rd.:
Mr. Roessler reviewed the landscaping plan which will replace the
Jersey barriers. There will be a raised asphalt strip with small
plantings. Circulation will be the same. They will eliminate
the "cage" on the outside of the building and will increase
parking spaces. There will be some landscaping to screen the
building from I-89 and will agree to use the species recommended
by Planning staff.
Elgin Smith, representing Price Chopper, said they are concerned
about safety and about operating their business. They are
looking for something that will be convenient for shoppers and
feel they should be part of the process. They want to be able to
submit a proposal. Mr. Roessler noted that this plan was in
place when Price Chopper got their lease. Mr. Senesac said the
traffic flow works. There have been no accidents and no one hurt
because of it. To put in a cut would hurt circulation and
stacking capability. Sam Bloomberg, representing the property
owner, said they approve and support the application.

Mr. Craig noted the property is in Traffic Overlay District #1
and is already 400 over the trip limit now. He noted the cur-
rent proposal would increase the trips by three and he didn't
want to go over the number now there. Ms. Peacock agreed. Mr.
Roessler said this would mean they couldn't increase the size of

the office. It was noted that Section 17.5 of the Ordinance says
you can't increase traffic without some mitigation. Mr. Craig
noted the Commission has been very diligent in applying this
standard to the neighboring property.
Mr. Burgess then polled the Commission on the traffic issue.
Mr. Sheahan said the Commission should hold firm on the 560. Mr.
Craig, Ms. Peacock, Mrs. Maher and Mr. Burgess agreed. Mr.
Austin said he .had no problem with the three trip ends but would
have a big problem with putting a restaurant on the property that
would add significantly more trip ends. Ms. Pugh agreed with Mr.
Austin.
Mr. Burgess offered the applicant the opportunity to withdraw.
Mr. Gars, who is doing leasing for the 80,000 sq. ft., said they
feel the restaurant will generate walk-in traffic from UVM and
Price Chopper. It would not be a destination restaurant but a
pizza -salad place. He felt their peak hour wouldn't coincide
with the Williston Rd. peak hour. He said the proposed facility
would peak from 6:30 pm on and between 12-2 pm. Mr. Burgess
noted 12-2pm is the peak hour on Williston Rd.
M.!�, Burgess said the Commission would accept only a traffic study
that will show that the applicant will not increase traffic above
560 on the Williston Rd. peak traffic hours.
The applicant then said they would withdraw the next application
which is for the Bertucci restaurant and asked the Commission to
consider approval of the circulation plan without the office.
Ms. Peacock suggested relocating the handicapped spot. Mr. Weith
asked that Jersey barriers on the west side of the entrance be
shown. Mr Roessler said they will put in curbs there. Mr. Weith
also suggested some deciduous trees in the 4-1/2 foot green
space. The applicant agreed to provide these.
Ms. Pugh said that when the applicant comes back, she will need
to be convinced that the 26% shortfall on parking is acceptable.
Mr. Austin moved the Planning, Commission approve the site plan
application of SSL Corporation for Chan e in parking, and circu-
lation as depicted on a plan entitled "Ga nes Sho p "p y peers World,
Williston Road, South Burlington) Vermont, "Site Plan (Proposed)"
prepared by Graphic/Construction Management Services, Inc, and
dated 8/29/90, last revised 2/10/92, with the following,stipula-
tions:

STAPLES PLAZA - PARKING/CIRCULATION CHANGES - SITE PLAN
--- applicant needs to demonstrate that there has been a change in
conditions to justify the requested changes and to justify the
Planning Commission's reconsideration. This issue should be
addressed in writing and submitted to staff.
--- parking aisle serving the double row of parking along the
westerly side of the building is only 16 feet wide, Section
4 19.254(a) requires a minimum of 24 feet.
--- details on exterior lighting should be provided including
height of poles, types and wattage of lights, and illumination
levels in foot candles.
--- Burlington Tennis Club is an abutter but is not shown as such
on the plan.
--- plan shows proposed second floor offices but applicant does
not describe this as being requested, please clarify.

recommended that the applicant have the accuracy of this plan
checked by a land surveyor.

application by staff calculations. The previous application
had a building coverage of 32.7% (which exceeded the limit by
2.7%) and the current application has a coverage of 35.6%.
This increase is not indicated on the plan in the lot coverage
section.
--- overall coverage has increased from 90% to 93.2% by staff's
calculation.. Since the previous coverage exceeded the maximum
allowed, additional coverage can not be permitted without a
variance from the Zoning Board of Adjustment.
--- planting schedule does not accurately reflect the sizes of the
plantings used. The schedule indicates that 30 foot Norway
Maples were planted when in fact only 10 - 12 foot trees were
planted, the Blue Spruce are supposed to be 10 - 12 feet and
are only 5 - 6 feet, the Red Maples are supposed to be 3 - 3
1/2 inch caliper and are only 1 - 1 1/2 inch caliper and the
Crabapples are supposed to be 2 - 2 1/2 inch caliper and are
only 1 - 1 1/2 inch caliper. The planting schedule must
accurately reflect the sizes and quantities of plant material
used.

Dear Mr. Senesac:
A recent inspection of your property at 861 Williston Road revealed
that you have not complied with the site plan approved by the
Planning Commission on 3/24/92. Parking stall dimensions, aisle
widths, parking layout, landscaping and drainage are not as shown
on the approved plan.
It is also apparent that you plan on making exterior lighting
changes. Condition #4 of the 3/24/92 approval requires that "any
new exterior lighting shall be approved by the City Planner".
City Planner Joe Weith informs me that he has not approved nor been
asked to approve any exterior lighting changes.
You are hereby requested to either conform to all aspects of the
approved site plan or make application to the Planning Commission
for an amendment to the approved plan which incorporates the
changes made on the site.
You have two (2) weeks in which to comply with the above request.
Failure to do so will be deemed a zoning violation and you will be
subject to legal action and fines of up to $50.00 per day for each
day the violation continues.

:) BAYNES - OFFICE RELOCATION AND PARKING IMPROVEMENTS
This project consists of the relocation of an existing 160o
square foot office to the -Front of the building, expandinq it by
900 square feet and revising parking and circulation. Applicant
came before the Planning Commission in October, 1990 for other
parking changes (minutes enclosed) .
This property is located at 861 Williston Road and is within the
Commerciai l Dis tr is u . It is bounded on the south by undeveloped
property which is part of the Quarry Hill Club, on the east by I-
89T on the west by the Chittenden bank and Spillane's Mobil and
on the north by Williston Read.
_Access/circulation: Access to the property will not be changing.
Access is currently being provided by a 65 foot wide signalized
c"rb cut at the west end of the property which has two (2) lanes
for ingress and three (3) lanes for egress. Also existing is a
20 foot curb cut which is located 220 feet east of the main
access. This smaller curb cut provides des for egress o :s

vehicles proceeding in an easterly direction ti.e., right turn only).
The October 1990 plan used temporary jersey barriers to separate
traffic in the parking lot while this plan uses permanent islands
and planters. Circulation pattern is acceptable.
Price Chopper, who is a tenant in the 6aynes building, has
submitted a request for a break: in the parking lot island which
runs parallel. with Williston Road ( see enclosed sketch) . This
island break: would allow Price Chopper customers to exit the
Property without having to travel the length of the parking lot.

This break would result in the loss of six (6) parking spaces.
The applicant is opposed to this break. He is concerned that
with this arrangement cars stacking up to use the right -turn only
curb cut, the flow of traffic from the east side of the parking
lot would cut off access to the main exit at the west end of the
property. Staff concurs.
Traffic: This property is located in Traffic Overlay Zone 1'
which would allow this property to generate a maximum of 114
vehicle trip ends (vte's) during the P.M. peak hour. I.T.E.
estimates that this shopping center generates 560 vte's and the
900 square foot office expansion will add three (3) vte's for a
total of 563 vte's. It is staff's opinion that an increase of 3
trip ends is negligible. However, the applicant will be required
to contribute $433 to the Williston Road Improvement Fund (Area
1) based on the 3 additional trip ends.
Coverage/setbacks: Building coverage is 32.7% (maximum allowed
is 30%). Overall coverage is 90.0% (maximum allowed is 70%).
These are existing conditions which are not made worse by this
application.

Landscaping: The landscapings
requirement for this proposal is
$2250 and it is being met. Plantings will include Norway Maple,
Blue Spruce, Juniper and Potentilla. Because the site exceeds
lot coverage, staff recommends the 3" - 3 1/2" deciduous trees be
planted in the parking lot median at 20 foot intervals. These �s
trees will reduce the impact of the excessive coverage and en-
hance the appearance of the property.
Parking: This site currently has 328 parking spaces and the
proposed improvements will add 13 spaces for a total of 341
spaces. The existing uses by standard require a total of 449
spaces and the proposed office expansion will bring the total
number ^� o�„" o,� s„a�AG to 454nat_es = _Even with the office
of r
expansion taken into account, there will be a net gain of 8
spaces. The total number represents a shortfall of 113 spaces or
24 . 9%.
The access drive located south of the parking island is only 17
feet in width. This is too narrow for two (2) lanes of traffic '
as proposed. The pained centerline should be eliminated between
the island and the building.
Parking stall dimensions and aisle widths meet the requirements
of the October, 1990 approval. Eight (8) handicapped spaces are
required by standard and this is being met.

Lighting: No additional exterior lighting proposed. Lighting
consists of 12 high pressure sodium lights on poles in the park-
ing area and recessed soffit lighting along building walkway.
Any changes to the existing lighting system shall be approved by
the Planning Commission.
Dumpsters: Dumpsters are shown in the rear of the building. Due
to their location not being visible to the general public, staff
sees no need to have them screened.
Sewer: The office expansion requires a sewer allocation of 45
gpd. The applicant will be required to pay the $2.50 per gallon O
fee prior to permit.
Other: Pavement marking should be painted at least once a year.
8) GAYNES - RESTAURANT - 861 WILLISTON ROAD
This project consists of the installation of a 148 seat restau-
rant within the existing Gaynes building. The restaurant will be
located at the northeast corner of the building.
Access/circulation: Same as for the Gaynes office application.
Traffic: This property being in Traffic Overlay Zone 1 allows
the lot to generate a maximum of 114 vehicle trip ends (vte's)
during the P.M. peak hour. The current shopping center design
plus the expanded office is estimated to generate 563 vte's.
This proposal which will reduce retail space by 7461 square feet
and add a 148 seat restaurant will in crease trip generation by
57 vte's for a total of 620 vte's or 10.1%.
The applicant will be required to contribute $8,225 to the Wil-
liston Road Improvement Fund (Area 1) based on 57 additional trip
ends.
Coveragefsetbacks: Same as for the Gaynes office application.
Landscaping: The landscaping requirement for this proposal is
$16,500 and when the office landscaping requirement and the
proposed landscaping is calculated, the requirement is short
$13,394. The planting of 19 Littleleaf Linden trees 3" - 3/12"
in the center island as suggested with the office application
would reduce the shortfall to $3,149. Staff recommends that this
shortfall be made up by planting a row of pines along the south-
erly boundary line to screen the rear of the building from I-89.
Parking The current shopping center plus the expanded office
requires by standard 454 parking spaces. The site currently has
328 spaces and 341 spaces are proposed. This proposal will

The South Burlington Planning and Zoning staff has reviewed the
site plan entitled "Gaynes Shoppers World", dated 8/29/89, last
revised 10/10/91. Staff also reviewed the earlier site plan
dated 8/29/90, which was approved by the Planning Commission on
October 2, 1990. The .1-ec:ently submitted site plan dated last.
revised 10/10/91 represents a change from the plan approved in
October of last year in terms of circulation and parking layout,
and therefore, mist be approved by the Planning Commission.
The recent.-L s,.,,bmitted plan appears to include the following
changes:
1. A number of parking spaces in the front of Gaynes are pro-
posed to be converted to striped pedestrian/shopping cart open-
ings.
2. Eight (8) spacer are proposed to be added in front of th
entry to Gaynes in an area shown on the approved plan as "No `
Parking".
3. The existing fenced storage area on the east side of the
building is proposed to be removed and replaced by parking

Gaynes Department Store in South '
Burlington will become a plaza of more
than a dozen stores, a company official
said Monday.
The store, which is displaying a sign
that reads, "temporarily closed for con-
struction," will begin in 10 days to
prepare to accommodate new tenants, i
said landlord Maurice Senesac. l
"Gaynes Department Store will
cease," Senesac said. "We had a series of
local tenants, but the economy being
down, many of them couldn't hang in
there."
The 80,000-square-foot store, which
was known as a popular spot for Canadi-
an shoppers, was founded in 1959. It
changed owners several times, closed in
July 1989 and was reopened by Senesac
and a partner in November 1989.
More than 150 workers have been
idled by the latest transition, Senesac
said.
"We were at a peak of 170 in the
spring of 1990," he said. "Now we're
down to nothing, just a few here."
City Manager Charles Hafter said the
new operation could have a higher em-
ployment. F
"An active mini -mall ... will certainly e
have more jobs than the current
Gaynes," he said.
Sensesac said the new plaza will
include a Barnes & Noble bookstore,
Staples office supplies, and 10 to 12
other "national tenants."
The store comprised regional compa-
nies that rented space within the large
store, he said.
Hafter said the new plan would un-
dergo development review and was a
positive concept.
"We would like to see the property
use maximized," he said. "The current
Gaynes store was not doing that. We like
to see a -healthy commercial sector in the
town."
Senesac said the change in Gaynes'
form was planned. "This has been antic-
ipated since two years ago."
The new stores will be called Gaynes
Plaza, he said.
"We have tenants to fill the whole
thing twice over," he said. "The problem 3
is picking the ones that will be able to

Mrs. Maher said she voted against the plan because of the unsafe
left turn conditions which will be made worse, because of what she
felt was an excessive waiving of parking spaces, and because she
felt the hotel coverage was too dense.

Mr. Senesac said he had 2 engineering firms do a study on the
parking lot. He noted the State designed the traffic flow and the
problem is a very short turning radius in front of Price Chopper.
He said the only thing he has done is to put in the barriers to
maintain the traffic flow.
Mrs. Maher asked what will be done so people don't go in the exit
and out of the entrance. Mr. Senesac said that's why they called
in Tyler Hart to figure out how to widen the aisles and make the
parking diagonal.
Mr, Hart said the situation at the lot is total confusion now.
People don't know what way to go. Signs have been knocked down.
People want to park at the jersey barriers because it's close to
the store entrance.

The new plan will have all parking at a 60 degree diagonal.
Pavement marking and arrows are suggested. There are now two 5-
foot sections of curb that trucks drive over because there is not
enough truning radius. Mr. Hart said he recommends these be taken
out. Instead, he recommends an island near the barriers where
there will be no parking.
Mr. Hart noted that trucks making a left turn into the lot knock
down the signs because of a little island that serves no purpose.
He proposes removing this island.
Pavement markings on Williston Rd, have to be repainted.
There shouldn't be a problem with exiting trucks at the exit only
location, but some of them hit the signs. Mr. Hart recommends
moving the sign 8 or 10 feet further away.
Mrs. Maher asked if painting the barriers would make them more
obvious. Mr. Hart said he didn't know. He recommended an island
with concrete curbs instead of the jersey barriers.
Mrs. Maher suggested the Commission take no action but instead
have the City Planner, City Engineer and Mr. Audette work out a
final plan that all can be satisfied with.
Mrs. -Maher -moved -to -continue - the -application until -2.October.-and
delegate -the City Engineer, -city-Planner,-and_City,Highway_Depart-
ment_Head to -review -the - lans_with_the_develo er-and-his _ex erts�
Ms,. Peacock -seconded.,-Motion _passed unanimously.
Ms. Pugh left the meeting at this point.
5, _Comprehensive -Plan __Update
a. Review Draft #1, Transportation Section:
Mr. Weith said the section still needs work and the City Engineer
and Sonny Audette still want to review it.
Mr. Weith then posed some questions to the members.
1. Is the South Burlington,Southern Connector still a priority?
Mrs. Maher, Ms. Peacock, Mr. Austin and Mr. Burgess felt it should
be in the plan. Mr. Craig felt the right-of-way should be pre-
served but didn't think it was a priority.
2. What about the extended Airport Drive and Williston Rd/Patchen

3) GAYNES PARKING LOT
A revised plan was submitted which incorporated most of the
modifications recommended by Tyler Hart. A couple of recommended
modifications which were not made, but which I feel should be,
include the following:
1. The curb near the main exit should be scaled back to allow
for a proper turning radius for tractor trailers.
2. The jersey barrier median dividing the main access should be
placed so that it is more squared as recommended by Tyler. This
will better define the entrance.
Other: A double row of parking was added near the Mobil Station
as recommended by Tyler. The area is tight, however, and results
in a parking aisle width of 18' to 201, the standard is 24 feet.
I recommend that 2 parallel parking spaces be provided along the
west side of the jersey barriers rather than four 90 degree
parking spaces.
I feel these improvements should benefit circulation and safety
and should be implemented as soon as possible.
Minutes from the last discussion on this project (9/4/90) are
enclosed. Also enclosed are staff memos for the previous meet-
ing. The plan has not been revised since the last meeting. A
draft motion of approval is enclosed.

Louis Mazel and Joe Sussman, I am the third partner in 89-2 Realty
Co. which owns the Gaynes property. Inasmuch as both Louis and
Joe fly south when the snows arrive, while I spend most of the

Enclosed are copies of all correspondence regarding the change in
circulation at the Gaynes/Price Shopper property on Williston
Road. This information was requested by Mr. Joe Sesman.
As is explained in the letter to Mr. Louis Mazel dated 4/24/90,
the placement of "Jersey Barriers" last spring resulted in a
change of circulation. Any change in circulation requires site
plan approval by the South Burlington Planning Commission. In
addition, the City has received a number of complaints from
citizens regarding the confusing layout and unsafe conditions
caused by customers exiting via the entrance and vice versa.
Mr. Joseph Senesac has submitted a site plan application for the
change in circulation. The review by the Planning Commission is
scheduled for 10/2/90 at 7:30 P.M.

The South Burlington Planning Commission noticed the placement of
"Jersey Barriers" in your parking lot which significantly alters
circulation on your site. Any change in circulation, access
parking, landscaping and other items such as drainage and light-
ing requires site plan approval by the Planning Commission.
Therefore, the Planning Commission must approve the change of
circulation caused by the placement of these barriers.
I have scheduled a meeting for you or a representative to discuss
this issue with the Planning Commission. The meeting is sched-
uled for May 22, 1990 at 7:30 P.M. I will call you soon to

Setbacks/Coverage: The structure does not meet the 80 foot
building envelope setback. Coverage requirements are met.
Density (F.A.R.) requirements are met.
Parking: The applicant informed me that they have 350 fixed
seats. The 350 fixed seats, 500 square foot lobby area and one
unit apartment requires a total of 119 parking spaces. 133 park-
ing spaces are shown.
Sewer: The new unit will require an additional 450 gpd sewer
allocation. The $2.50 per gallon fee will be required prior to
permit.
Landscaping: $1500 in new landscaping is required. No new
landscaping is proposed. I will visit the site again before the
meeting to see whether more landscaping is needed.
5) GAYNES/P & C CIRCULATION. WILLISTON ROAD
Joseph Senesac will be in to discuss the relatively recent change
in circulation patterns on the Gaynes/P & C property. The change
in circulation was caused by the placement of "jersey barriers"
in the parking lot.
I decided to treat this issue as a discussion. Mr. Senesac will
explain what was done, why and how it has changed circulation.
If the Planning Commission feels site plan approval is wain.-ai;tcd,
then we can warn a site plan review in the middle of June.
There have been several complaints about cars exiting via the
entrance lane and cars entering via the exit lane. Some sort of
site maps, sketches, etc. will be available at the meeting.
Please observe the site prior to Tuesday's meeting.

Mrs. Maher said if a new application is submitted, she would like
the seats in China Lite counted.
4. Discussion with Joseph Senesac regarding the change in
circulation pattern at the Gaynes/P&C Shopping Center com lex
Williston Road
Mr. Senesac said when Williston Rd. was widened an island was put
in between the "in" and "out" lanes of the complex. He said he
had had the Jersey barriers installed because of the number of
accidents resulting from people trying to make a U-turn around
that island. There is also a problem with people coming out of
Spillane's. He said the barriers have relieved congestion though
he is not pleased with the appearance. He would like to remove
the barriers and put in an island down the entire lot and also
change the angle of parking along the building to go with the flow
of traffic. He acknowledged signage is poor but said tractor
trailers knock the signs down.
Mr. Craig asked how one circulates in the lot from Gaynes back to
P & C if the lot is crowded. Mr. Senesac said you can't. Mr.
Craig felt this was a substantial change requiring a new site
plan. Other members agreed. Mr. Craig felt an engineer should
study the lot and make recommendations. Mrs. Maher suggested
having Craig Leiner look at it.
6. Public Hearing: Continue revised finalplat application of
Homer Dubois to construct a connector road (Adirondack Street)
between Butler Farms and Oak Creek Village and treat this con-
nection as a second access to the Butler Farms residential
development for purposes of constructing more than 50 units,
Hinesburq Road
Mr. Burgess reviewed the history of this request noting the
Commission had approved 7 additional units with a gravel base to
be paved on the Dubois side. The Council reviewed this but the
application to the Council asked them to approve construction of
the access road for 36 more units. The Council denied this and
sent it back to the Commission. He noted the applicant wants to
use this access in lieu of a second Hinesburg Rd. access as orig-
inally approved by the Commission but denied by Act 250.
Ms. Kehoe, attorney representing Mr. Dubois, said with the plan
proposed now, Mr. Dubois would be obliged to build a road to city
standards and approved by the city, with a sidewalk. They would
then be allowed 36 more lots, 7 of which would be permitted im-
mediately (she noted there are threatened lawsuits because of
existing contracts on those lots). The Dubois would commit them-

It has come to my attention that there is a problem with traffic
entering the Gaynes Shopping Center from Williston Road. Vehi-
cles have been observed entering your property and instead of
keeping to the right of the island, they enter to the left, which
is supposed to be used for exiting.
One of the reasons for this problem is that there are no signs
directing vehicles to the right of the island. Enclosed you will
find a copy of a page from the Manual on Uniform Traffic Control
Devices showing some signs. It is strongly recommended that you
place sign R4-7 and sign R4-7a above it on a post in the island
adjacent to Williston Road. The cost estimate for these two (2)
signs and post is $150. I believe these signs will solve the
problem.
The other alternative to erecting the signs, would be to remove
the "jersey" barricade. Shoppers wishing to go to Gaynes and not
Price Shopper tend to go to the left causing the problem.

The City wishes to see you implement one of these two measures as
soon as possible. In addition, the Planning Commission at a
meeting held in May of this year requested that you submit a site
plan of the entire site so that they can review the change in
traffic circulation. Unless this site plan is submitted within
the very near future, the City will be forced to require you to
return the circulation pattern to its original design.

inches prescribed for use on freeways. A smaller size of 18 x 24 inches
is permissible for use on narrow medians and at median openings to
serve entering cross traffic and to remind through traffic of the regula-
tion.
A certain amount of flexibility must be allowed in the mounting
height for Keep Right signs. Where the obstruction is in or so near the
lane of traffic that the sign at a normal minimum height may be ob-
scured by vehicles, a second sign of the same design may be mounted
directly above the standard sign with its bottom edge at a height of 8 to
10 feet above the pavement. In this case the lower sign may be placed
somewhat below the normal minimum height.
On a median, the Keep Right sign should be mounted not more than
50 feet beyond the approach end of the island. On a pedestrian island or
intersection channelizing island it should be mounted at the approach
end or as close thereto as practicable. The sign should be mounted on the
face of or just in front of a pier or other obstruction in the center of the
roadway. Where appropriate, a Keep Left sign (R4-8) may be used (sec.
5E-2).

GOALS
In this activity, the group will develop goal statements for the
highest ranked issues.
* The facilitator will write each issue statement on a sepa-
rate sheet of newsprint. The group may want to rework the state-
ment before starting work on the goal statement.
* Work together as a group, and don't hesitate to write
several drafts of a goal statement until the group is comfortable
with the wording. The facilitator will record your ideas.
What is a Goal?
In a broad sense, goals are statements of the self-image of
the community. They are general of intent. Goals
should not be too specific, and should be realistic. A goal is a
"result." toward which effort is directed; goals are usually
expressed in terms of one or more objectives.
Examples (borrowed from another community's plan):
* To preserve and protect the quality and vitality of
existing residential neighborhoods.
* To preserve the Town's natural features, conservation
areas, and unique or fragile areas.
* To provide safe and efficient mobility by a variety of
travel modes, including, automobiles, trucks, buses, bicycles, as
well as for pedestrian movements.
How-to Suggestions:
Below are questions to ask while writing and reviewing your
goal statements:
1) Is the goal an image the community envisions for itself in
the future?
Is the statement a statement of future intention - an event
or situation that would take place in the future?
2) Does it allow for the development of specific and measurable
objectives?
Is the statement made in terms of what someone/thing will
do? A statement in terms of what will be done is probably a
strategy for achieving some goal. Ask what you want to be accom-
plished.
3) Is the statement clear enough that you will be able to tell
when you have reached the goal?
The goal statement needs to describe an observable situation
or event. It should be derived from knowledge (i.e. your obser-
vations).
4) Is the group committed to the goal?
Does it generate excitement? Does the goal fall within t.ie
purpose of the group's activity and subject?

The Commission had several questions regarding coverage calcula-
tion and how to handle the merging of the Lewis lots. Lot
coverage is as follows:

Maximum permitted coverage is 30% for building and 70% for total
lot coverage.
In :regards to the Lewis lots, Steve Stitzel feels the City should
not be concerned with mortgage deeds. He also advised that the
merging of lots does not require a rewrite of the deeds. He
recommends that the survey plat. show 3 lots: the fire station
lot, the Lakewood Commons lot (including the hotel), and one
Alexander Lewis lot.. Existing property lines should not be
shown. The new survey plat approved by the Commission becomes
the legal lot. configuration.
Enclosed is a draft motion of approval.

Joseph Senesac modified, the circulation on the Gaynes/Price
Chopper property last spring by the placement of jersey barriers.

including angling the parking spaces, more curbing to improve
flow and signage.

Access/Circulation: Due to the scarcity of space in front of the
building, there is insufficient space to provide adequate stack-
ing. The purpose of the .jersey barriers area to prevent uncon-
trolled stacking in front of the Price Chopper. Cars are now
required to travel to the eastern portion of the lot and then
back to the signal. The aisle acts as a stacking lane. I feel
this arrangement is an improvement over what existed prior to
last spring.

lane. Several improvements are proposed to discourage this
practice:
1. Better signage and pavement markings. I suggest a "do not
enter" sign or "entrance only" sign be placed near the relocated
light pole. This would make it more clear to vehicles parked in
the western portion of the property and those vehicles exiting
the Mobil Station that they should not exit via the entrance
lanes.
2. Jersey curbs are to be placed along the western side of the
entrance to better define the entrance lanes.
3. parking spaces are to be angled thereby directing exiting
cars in -the proper direction.
Parkin, spaces: The parking space sizes and aisles widths cannot
meet. the City's standards due to the shortage of space in front:
of the building. The plan does meet, however, typical standards
recommended by most design manuals (i.e. see enclosed standards).
The City's standards are conservative. I recommend the stall
depth be increased to 20 feet (they are proposed to be 18 feet).
With this modification, I feel the parking space sizes and aisle
widths will be adequate.
