Site plan application of Technology Park Associates, Inc, to place sculpture (whales tails) and landscaping within the C.O. District along 1-89 on lot # 10, Community Drive: Mr. Illick explained there is a requirement for the rec path to continue on Kimball Avenue and also one to run along Muddy Brook. The applicant is willing to develop and extend the Muddy Brook path. This is an aerobics trail now (built by Digital) and is well used. The whales tails sculpture is thirteen (13) feet high. Mr. Illick showed where they want to put it. It is important for the display that it not be surrounded by landscaping, and this will require removal of several good trees. There is an alternate site possible that would not require removal of trees, but they prefer the former location. Members had no problem with the removal of the trees. Mr. O'Rourke moved the Planning Commission approve the site plan application of Technology Park Associates, Inc, to place sculpture (whales tails) and landscaping within the C.O. District along I-89 on lot #10, Community Drive, as depicted on a two (2) page set of plans, page one entitled "Technology Park Kimball Avenue So. INC. - LANDSCAPING & SCULPTURE - SITE PLAN This project consists of placing sculpture (whales tails) and landscaping within the C.O. District along 1-89 on lot # 10 of the Technology Park subdivision. Staff interprets the regulations such that the term "landscaping element" includes sculpture. Section 26.105(c) of the zoning regulations allows the Planning Commission to require additional landscaping along I-89 to screen development. Staff has no issues with the proposal. The plan should be revised to provide details of the proposed plants in the form of a planting schedule. 9) GARY BOURNE - SERVICE STATION TO CONVENIENCE STORE - SITE PLAN This project consists of converting 675 square feet of a 2100 square foot building from service station use to convenience store use. The last review of this property by the Planning Commission was on 2/8/94 (minutes enclosed). The Zoning Board of Adjustment on 6/14/99 granted the applicant a conditional use permit for the proposed conversion. This property located at 760 Shelburne Road lies within the C l District. It is bounded on the north by Swift Street, on the east by a mixed use commercial building owned by the applicant, on the south by Pizza Hut, and on the west by Shelburne Road. Access/circulation: Access is provided by a 40 foot curb cut on Shelburne Road and a 40 foot curb cut on Swift Street. Circulation on the site is adequate. Parking: A total of 15 spaces are required and 15 spaces including one (1) handicapped space is being proposed. The plan should be revised to show a bike rack. Landscaping. The minimum landscaping requirement, based on building costs, is $600 which is being met. Proposed plantings include Arborvitae, Yew, Rhodendendron, and Andromeda. Traffic: No additional traffic is expected to be generated based on ITE. Traffic for a convenience store with gas sales is determined by fueling positions. MEMORANDUM To: South Burlington Planning Commission From: Joe Weith, Director, Planning & Zoning Subject: Sculpture within the I-89 CO District Date: May 18, 1999 You may have read recently that the owners of Technology Park (former Digital property) purchased the famous Randolph Whales Tails sculpture. The owner and sculptor have chosen a location on the property to display the sculpture, however, this location lies within the CO District along I-89. A question has arisen as to whether placing a sculpture within the CO District is allowed under the zoning. The ordinance does not specifically identify sculpture as a permissible use or land development activity in the CO District. However, after reading other related sections in the ordinance, it is my opinion that placing sculpture in the CO District is allowable if approved by the Planning Commission under site plan review. My reasoning is explained below. The zoning ordinance is silent in regards to sculpture. There are a couple of examples in the City where sculpture has been erected (e.g., large cement balls in front of Technology Park and wooden lobster in front of Net Result). When these sculptures were erected, it was ignored by the City because they were seen as landscaping elements, rather than structures. This inteTpretation of sculpture as a landscaping element is supported by Section 26.105(a) of the zoning regulations. This section states that a landscaping credit may be granted for "existing trees or for site improvements other than tree planting as long as the objectives of this section are not reduced." The question of whether or not landscaping (or sculpture) is allowed in the CO District is addressed in Section 26.105(c) which reads as follows: "additional landscaping .... may be required for the purpose of adding a buffer strip along I-89 to properly screen development from the highway". Based on the above language, and the City's past interpretations of treating sculpture as a landscaping element, I believe the applicant's request to erect a sculpture within the I-89 CO District is permissible. This request should be reviewed by the Planning Commission under site plan review since it technically represents a change to the existing landscaping plan on the property. I would like an opinion from the Commission as to whether or not they concur with this staff interpretation.
