By acceptance of this permit, the permittee agrees to allow representatives of the State of Vermont access to the property subject to this permit, at reasonable times, for the purpose of ascertaining compliance with Vermont environmental/health statutes and regulations. Sketch plan review was on 11/15/94 (minutes not available). This property located at 861 Williston Road lies within the Commercial 1 District. It is bounded on the south by undeveloped property which is part of the Quarry Hill Club and Burlington Tennis Club, on the east by I-89, on the west by the Chittenden Bank and Spillane's Mobil station and on the north by Williston Road. Access/circulation: Access for the property will not change. City of South Burlington Dear Bob: In response to our recent telephone conversation, I have reviewed the above matter with the City to determine the maximum number of seats which would be allowed in a 9,000 square foot restaurant located within the 101,688 square foot Gaynes Plaza facility. It is my understanding that The Brentwood Corporation still wishes to put a 148-150 seat restaurant within a 9,000 square foot area. Under the City of South Burlington's Zoning Regulations as they currently exist, the maximum number of seats allowable in a 9,000 square foot restaurant is 64. This number is based upon total allowable trip ends for the entire plaza of 663. Of those 663 trip ends, 625 trip ends are accounted for by the 92,688 square feet of retail space. Thus, 38 trip ends remain for a 9,000 square foot restaurant use. Based upon a calculation of .59 trip ends per seat, a total of 64 seats is the maximum allowable with the remaining 38 trip ends. With regard to parking, there are currently enough parking spaces available to accommodate a 150 seat restaurant. Therefore, in the event that your client wishes to consider a 64 seat restaurant, parking will not be an issue. Finally, you mentioned that there is a 15,000 square foot area available in the Gaynes Plaza facility at the present time. In the event that The Brentwood Corporation wishes to propose to the City a restaurant which will use 15,000 square feet instead Robert Soesler, Esq. Enclosed are five copies and one reduced copy of the revised sketch plan showing: (a) name and address of owner of record and applicant; (b) name of new owner of Chittenden Bank property (Timber Lake Associates); (c) location of, type, and approximate size of the existing water and sewer lines; (d) graphic scale (one inch equals 40 feet); (e) better quality prints; (f) indication of lot size (6.6 acres, more or less); (g) the correct number of spaces on the site (total parking spaces is 368); (h) depiction of addition on the southwest corner of the second floor of the building (Request No. 1 of Szymanski memo). The proposed addition will be 2,436 square feet. (b) The estimated cost of the addition will be $30,000. (c) No additional employees will result from the addition because it will provide workspace for the manager of the shopping center and his staff of two to three persons, who currently work at the shopping center. (d) A level of service analysis for the Williston Road/Project Main Access Intersection for the 1992 and 1997 design hours traffic volumes is enclosed. The analysis was prepared by Resource Systems Group of Norwich, Vermont in connection with the applicant's earlier request for a change of use approval to lease a portion of the building to Bertucci's Brick Oven Pizzeria. It concludes, on Page 5, that the level of service at the intersection is "acceptable" and the addition of even 59 trips would have only a "negligible" impact on the intersection and traffic. (e) Analysis of the p.u.d. criteria under Section 21.151 of the zoning ordinance A. Undue Water and Air Pollution. (i) The shopping center will utilize the City of South Burlington's wastewater collection and treatment facilities and existing sewage lines to the building. According to the Environmental Protection Rules of the Agency of Environmental Conservation, Division of Protection, Chapter 7, Sewage Disposal, Appendix 7-A, the number of gallons of wastewater produced by the facility per day will be 15 gallons per day per employee. (ii) The second floor addition is not in a flood plain. (iii) Because the addition is on the second floor of an existing building, with no modifications being made to the site, it will have no impact on ground and surface water. Robert J. Blair November 4, 1994 Page 3 of 8 (iv) The addition will comply with all regulations of the Vermont Department of Health, Vermont Department of Labor and Industry, and other State agencies. B. Water Supply. The project will access water from the Champlain Water District through the City of South Burlington water lines and the existing lines to the building. Approximately 45-60 gallons of water per day will be used. C. Soil Erosion. Because the addition is to the second floor of an existing building and no modifications will be made to the site, it will not cause unreasonable soil erosion or reduction in the capacity of the land to hold the water so that a dangerous or unhealthy condition may result. D. Traffic. The project will not cause unreasonable highway congestion or unsafe conditions with respect to the use of highways, existing or proposed, because it will not add any traffic to the existing number of trip ends in that the occupants of the addition are currently working at the site. Any incidental addition to traffic would not cause unreasonable highway congestion or unsafe conditions with respect to using the highways. The above - referenced traffic study prepared by the Resource Systems Group, Inc. found that current levels of service are acceptable and that the addition of even 59 trip ends to the shopping center would have "only negligible impact on the project's intersection with Williston Road." E. Education. This is a commercial project which will produce no additional school children, but will increase the tax base for the school budgets in the City. Robert J. Blair November 4, 1994 Page 4 of 8 F. Municipal Services. There will be no measurable increase in demand for municipal or governmental services or facilities. Please see the above paragraphs with respect to traffic, education, water, and sewerage. The addition will comply with all building safety codes and other requirements of the City of South Burlington Fire Department. The applicant has requested Fire Department and Police Department review of the proposal. G. Natural Resources. Because the project consists only of an addition to the second floor with no modifications to the site, it will have no impact on the natural resources, including streams, wetlands, scenic views, wildlife habitats, or other special features, such as mature maple groves or unique geological features. The facility will not interfere with any scenic view. H. (1) Rare and Irreplaceable Natural Areas and Historic Sites. Because the project consists only of an addition to the second floor with no modifications to the site, it will have no impact on rare and irreplaceable natural areas or historic sites. There are no such areas or sites within the immediate proximity of the addition that would be impacted. (2) Aesthetics; Scenic and Natural Beauty. The addition is compatible with surrounding developed properties in the area. The addition will be used as a small office for the manager of the 100,000 square foot shopping center to which it will be attached. It is located in the center of the Business Zone. Across the street from the shopping center is the Sheraton Hotel and Conference Center complex, portions of which are approximately twice as high. The design, style, materials, and color of the addition will match the existing building. The addition will expand Robert J. The addition will be perceived architecturally and aesthetically as an improvement to the current flat -roofed structure. The addition will be visible from Williston Road. However, it is set back approximately 135 feet from the edge of the roadway. The site is adjacent to the access to eastbound lane of Interstate 89, and drivers on that ramp would not normally look backwards to see the addition. There is no scenic or natural beauty in the immediate area. The addition will not block any views of the mountains to the east from Williston Road or adjoining properties. The project is compatible with and does not violate any clear written community standards intended to preserve aesthetics or scenic and natural beauty in the area. There are no near or distant views that will be blocked by the addition. The site is landscaped as depicted on the plan and in accordance with the previously -approved renovations to the site. Any adverse impact that might result from the construction of the project has been mitigated by the minimalization of its size, the architectural style, colors, materials to match the surrounding building, the landscaping, and screening which have recently been added to the site in connection with earlier approvals. I. Open Space; Recreation Plan. The addition will have no negative impact on the allocation or distribution of open space and will tend to preserve open space because it is constructed as an addition to the second floor of an already existing building, with no additional site work being required. The addition will benefit the recreation facilities by providing additional property taxes to the City. J. Public Streets, Facilities, and Utilities. The addition will have no impact on the layout, installation, construction, or maintenance of public streets and facilities or utilities because it will use the existing lines and facilities currently serving the building. K. Extension of Roadways, Drainage Facilities, and Utility Lines. Because the addition is to the second floor of an existing building, there will be no additions to, impact on, or changes to roadways, drainage facilities, or utility lines. L. Comprehensive Plan. The addition will comply with the 1991 Comprehensive Plan for the City of South Burlington. In particular, it complies with the Comprehensive Plan Goals with respect to Quality Environment in that the project will have virtually no impact on the natural environment; Land Use Distribution, in that it is located in the zoning district designated by the City for business uses; Economic Development, in that it promotes stable and orderly growth and management of existing business; Agricultural Lands, in that they will not be impacted. With respect to Future Land Use, it is located within a Commercial Center along the Williston Road Corridor in which "the City encourages mixed use development . . . e.g. . . . mixed retail/office/restaurant uses to encourage pedestrian movement, use of public transportation services, and shared parking opportunities." The addition complies with the Transportation Goals of the Comprehensive Plan as set forth in Chapter X by providing mixed -use development, and by congregating services and facilites within walking distance of each other. The addition will meet the Economic Development goals set forth in Chapter XI by adding economic development to an area that is already developed. It will meet the goals of Chapter XII, Education, by providing additional taxes for the school budget, without adding additional costs. It will meet the Public Utilities and Services goals of Chapter XIII by the fact that no extensions of any utility lines will be required. The addition will comply with Energy Conservation requirements of Chapter XIV. (f) Use of the addition is for the management of the shopping center. (g) The total number of parking spaces is 368. The staff, which will use the addition, is currently parking in the existing spaces. Even if the addition is not constructed, it will still be necessary for the employees to park at the facility from time to time during the day. No additional spaces will be required. Even if three or four more spaces are needed off and on during the day, that would constitute only a one percent increase and would fall during the morning and early afternoon hours when the parking spaces are not in peak demand. As managers of the property who are on site daily, we have not encountered any shortage of parking spaces and none has been complained of by any of our tenants. Staff is concerned that once all the space in the building is occupied, there may not be enough spaces to serve the entire development. Landscaping: The minimum landscaping requirement, based on construction costs, is $900 which is not being met. The preliminary plat should show additional landscaping meeting the requirement. Other comments: --- provide gross leasable area of entire shopping center with and without proposed office addition. --- provide estimated cost of expansion. --- provide number of additional employees. --- provide better quality prints of site plan, plan submitted is of poor quality and many parking spaces are not shown. --- indicate size of lot. --- the preliminary plat application should be accompanied by: 1) a level of service analysis for the Williston Road/Project main access intersection and 2) a report addressing the PUD criteria under Section 26.151 of the zoning regulations. --- what is the proposed use of the expansion and will it be leased? --- the existing shopping center requires a total of 508 parking spaces. The plan submitted provides 365 spaces which is a 143 space or 28.1% shortfall of the number of spaces required. If the expansion area is leasable, there is a 156 space or 29.9% shortfall in the number of spaces required. --- plan does not accurately depict the number of spaces on the site. Plan indicates that 368 spaces are available and staff counted 365 spaces (see Findings of Fact for 10/26/93 approval).
