District along I-89 on lot # 10 of the Technology Park subdivision. On the 29' day of June, 1999, the South Burlington Planning Commission approved the site plan application of Technology Park to place sculpture (whales tails) and landscaping within the C.O. District along I-89 on lot # 10 of the Technology Park subdivision under Section 26.10 of the South Burlington Zoning Regulations based on the following findings: 1. This project consists of placing sculpture (whales tails) and landscaping within the C.O. District along I-89 on lot # 10 of the Technology Park subdivision. Staff interprets the regulations such that the term "landscaping element" includes sculpture. Section 26.105(c) of the zoning regulations allows the Planning Commission to require additional landscaping along I-89 to screen development. Staff had no issues with the proposal. The plan should be revised to provide details of the proposed plants in the form of a planting schedule. 2. The owners of record of this property are Technology Park Associates, Inc. Axinn, VT, Inc. and PMF Energy Assoc., Inc. dba Technology Park Partners. DECISION AND CONDITIONS Based on the above Findings of Fact, the South Buriington Pianning Commission approves the site plan application of Technology Park Associates to place sculpture (whales tails) and landscaping within the C.O. District along I-89 on lot # 10 of the Technology Park subdivision with the following stipulations: 1. All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2. The applicant shall obtain a zoning permit within six (6) months pursuant to Section 27.302 of the zoning regulations or this approval is null and void. 3. The applicant shall obtain a Certificate of Occupancy/Compliance from the Administrative Officer upon installation of the sculpture and landscaping. 4. Any changes to the site plan shall require approval by the South Burlington Planning Commission. Chairman or Clerk South Burlington Planning Commission Date
