HomeMy WebLinkAboutMinutes - Development Review Board - 01/27/2014SOUTH BURLINGTON DEVELOPMENT REVIEW BOARD SPECIAL MEETING MINUTES 27 JANUARY 2014 The South Burlington Development Review Board held a special meeting on Monday, 27 January 2014, at 6:30 p.m., in the Conference Room of the Municipal Offices, 575 Dorset Street. MEMBERS PRESENT: T. Barritt, Chair; M. Behr; B. Miller (by phone); D. Parsons; J. Smith; M. Sirotkin (by phone); A. Klugo (by phone) ALSO PRESENT: P. Conner, Director of Planning & Zoning; J. Rabidoux, Director of Public Works 1. Miscellaneous application #MS-14-01 of City of So. Burlington Department of Public Works for after-the-fact approval to remove more than 20 cubic yards of fill to construct a stormwater pond, Twin Oaks Terrace. Mr. Rabidoux explained that the proposed project, a joint effort between the Department of Public Works and Twin Oaks association, had previously been approved by the DRB in 2009. Staff and the consultant failed to acquire a zoning permit. The project was constructed without the zoning permit. Without receipt of the zoning permit, the DRB approval lapsed. The application is back before the DRB to clean this up. The project has been inspected by the Department of Public Works. Mr. Klugo noted that the aerial photo on his computer did not appear to match the plan. Mr. Rabidoux reviewed and stated that the plan submitted to the DRB had been the original site plan; the correct plan should be the “as‐builts” which show a different location for the start of the access road. He submitted a paper copy of this “as‐built.” Members reviewed the “as‐builts” (including a scanned copy sent to those participating by telephone. Mr. Behr asked whether the relevant regulations concerning this project had changed since the project was previously reviewed by the Board. Mr. Conner stated that there had been no changes to the regulations in that time affecting the project. No further issued were raised. Mr. Behr moved to close the public hearing on the application. Ms. Smith seconded. Motion passed 7-0. 2. Other Business: No issues were raised. Belair, Administrative Officer RE: City of South Burlington #MS-14-01 DATE: January 24, 2014 The above referenced application is a request for after-the-fact reapproval of stormwater improvements at the Twin Oaks Condominium complex. The application was previously reviewed and approved by the DRB. The project was built in accordance with the plan, but no zoning permit was ever obtained. As a result, the DRB approval expired. Staff has prepared a draft decision in the place of staff comments as no standards have changed affecting this application. This draft decision is attached. #MS-14-01 1 CITY OF SOUTH BURLINGTON  DEPARTMENT OF PLANNING AND ZONING    CITY OF SOUTH BURLINGTON – TWIN OAKS TERRACE  MISCELLANEOUS APPLICATION #MS‐14‐01  FINDINGS OF FACT AND DECISION    The applicant, City of South Burlington, is seeking miscellaneous approval for removal of more  than 20 cubic yards of fill to construct a stormwater pond, Twin Oaks Terrace.    The Development Review Board held a public hearing on January 27, 2014. Justin Rabidoux  represented the applicant.     Based on testimony provided at the above mentioned public hearing and the plans and  supporting materials contained in the document file for this application, the Development  Review Board finds, concludes, and decides the following:       FINDINGS OF FACT    1. The applicant is seeking miscellaneous approval for removal of more than 20 cubic yards of fill  to construct a stormwater pond, Twin Oaks Terrace.    2. The application was received on January 17, 2014.     3. The owner of record of the subject property is the Twin Oaks Homeowners Association.    4. The subject property is located in the Residential 7 Zoning District.     5. The plan submitted is entitled “Twin Oaks Condominiums South Burlington Vermont  Infrastructure Improvement Plan Proposed Stormwater Basin”, prepared by Llewellyn‐Howley,  Inc., last revised 4/6/2009.    This application shall be reviewed under Section 3.12 of the Land Development Regulations.    The removal from land or the placing on land of fill, gravel, sand, loam, topsoil, or other  similar material in an amount equal to or greater than twenty (20) cubic yards, except when  incidental to or in connection with the construction of a structure on the same lot, shall require  the approval of the Development Review Board. The Development Review Board may grant  such approval where such modification is requested in connection with the approval of a site  plan, planned unit development or subdivision plat. This section does not apply to the removal  of earth products in connection with a resource extraction operation.      Standards and Conditions for Approval:    (1) The Development Review Board shall review a request under this Section for compliance  with the standards contained in this sub‐Section 3.12(B). An application under Section 3.12(A)  #MS-14-01 2 above shall include the submittal of a site plan, planned unit development or subdivision plat  application showing the area to be filled or removed, and the existing grade and proposed  grade created by removal or addition of material.    The applicant submitted a plan, containing one (1) sheet showing the removal of the fill and  subsequent regarding on the subject property.  This plan is sufficient to satisfy this requirement.    (2) The Development Review Board, in granting approval may impose any conditions it deems  necessary, including, but not limited to, the following:    (a) Duration or phasing of the permit for any length of time.    This requirement is not applicable to the subject application.    (b) Submission of an acceptable plan for the rehabilitation of the site at the conclusion of  the operations, including grading, seeding and planting, fencing drainage, and other  appropriate measures.    The applicant is proposing to construct a stormwater management pond. The South  Burlington Stormwater Superintendent has been working with the applicant to review  the plans and has stated that he approves of the plans.     (c) Provision of a suitable bond or other security adequate to assure compliance with the  provisions of this Section.    This requirement will not be necessary for the subject application.    (d) Determination of what shall constitute pre‐construction grade under Section 3.07,  Height of Structures.    The pre‐construction height for future development will be the existing grade.    DECISION    Motion by _______________________, seconded by ______________________, to approve  Miscellaneous Application #MS‐14‐01 of the City of South Burlington subject to the following  conditions:    1. All previous approvals and stipulations which are not superseded by this approval shall  remain in effect.     2. This project shall be completed as shown on the plans submitted by the applicant and on file  in the South Burlington Department of Planning and Zoning.      3. The applicant shall obtain a zoning permit within six (6) months pursuant to Section 17.04 of  the Land Development Regulations or this approval is null and void.     #MS-14-01 3 4. The applicant shall obtain a Certificate of Occupancy from the Administrative Officer prior to  use of the stormwater treatment basin.     5.
