Hi Roger,
We have reviewed the attached plan “Shelburne & Swift – Overall Site Plan” by TCE dated 1/20/23, last revised 2/16/23,
and we approve the concept.
VTrans intends to issue a 19 VSA S1111 permit after receiving a completed application and a more thorough plan review,
which may entail plan revisions.
This email is in lieu of a Letter of Intent as per 24 VSA 4416(b).

Plans received, thank you.
VTrans Permitting no longer issues a letter of intent commitment prior to issuing a permit. A permit will be issued or
denied when the application is complete. If needed for the municipal approval process, we can provide an email stating
we approve the concept in lieu of an LOI.
This development is classified as a major commercial application with a $2500 fee because it will generate more than 75
peak hour trips and a traffic impact study is required, which you have already done. It’s understood that the project is
not expected to create additional trips above the existing condition, but the classification is based upon the number of
trips post-development.

Marla Keene of the South Burlington P & Z Dept. has requested that we provide an LOI per 24 V.S.A. § 4416 paragraph
(b) for the DRB’s review of the proposed redevelopment of the Bourne properties at the corner of Shelburne Rd & Swift
St.
Enclosed is a site plan and traffic impact assessment memorandum for your review. Please note that this Project is not
projected to increase the peak hour trips which were previously generated by the convenience store and automobile
repair facilities on this site. It will also reduce the number of curb cuts and relocate the remaining ones further from the
Shelburne Rd / Swift St intersection.
I am working on getting the 1111 application form filled out and signed, and will submit that shortly. Would you please
confirm that this application will be classified as a “Minor Commercial Development”?
