1. Per Section 12.04.F of the Land Development Regulations the following is prohibited in the Habitat
Block area of 1505 Dorset Street.
a) The clearing of trees and understory vegetation is prohibited.
b) The creation of new lawn areas is prohibited.
c) Snow storage areas are prohibited.
2. The address of the new single family home is 1503 Dorset Street. The existing structure (ADU) will
retain its 1505 Dorset Street address.
3. Performance standards. If ledge is discovered during the course of work,, the permit holder will
provide the Administrative Officer with the following information as outlined in Section 3.13(E)
prior to commencing any ledge and/or blasting work. Evidence of application for state and/or
federal permits for the handling of potentially hazardous conditions, and/or the following
information, at minimum, may be required for determination of compliance with performance
standards or for conditional use review of potentially hazardous conditions:
i. Description of proposed machinery, operations, and products.
ii. Amount and nature of materials to be used.
iii. Mechanisms and techniques to be used in restricting the emission of any
hazardous and objectionable elements, as well as projected or actual emission
levels.
iv. Method of delivery and disposal of any hazardous elements.
v. Other information as may be necessary.
4. In addition to the specific standards listed above, all other performance standards listed in the
Land Development Regulations remain in effect.
5. The City’s Public Nuisance Ordinance is applicable.

New home to be constructed will be the primary home and the existing structure will become
the ADU. Wastewater permit has been approved by the state and is on file with the city of South
Burlington. The existing home will be clearly subordinate to the new home in two main ways.
The new home will be at a higher elevation on the property and larger and more visible. Second,
the new home will be the first home reached when driving up the driveway from Dorset street.

Below are the South Burlington Land Development Regulations relevant to ADU’s:
Section 3.11 Accessory Dwelling Units
A. One (1) accessory dwelling unit that is clearly subordinate to a single-family dwelling shall be
permitted within or appurtenant to a single-family dwelling on the same lot, provided there
is compliance with all the following:
(1) The lot is owner-occupied.
(2) The accessory unit does not exceed thirty percent (30%) of the total habitable area of
the single-family dwelling or 900 square feet, whichever is greater.
(3) Adequate wastewater capacity is available to service the accessory unit, as
demonstrated by issuance of a Wastewater Allocation or on-site wastewater permit
pursuant to the South Burlington Ordinance Regulating the use of Public and Private
Sanitary Sewerage and Stormwater Systems.
(4) The accessory unit meets all dimensional requirements applicable to a single-family
home on that same parcel.
(5) The Accessory Dwelling Unit and associated coverage shall be included in the
computation of building and lot coverage.
(6) A zoning permit shall be required for each accessory residential unit
B. Supplemental allowance as a Conditional Use. An Accessory Dwelling Unit (ADU), or portion
thereof that is proposed to be within the required setback applicable to a singlefamily home
may be approved as a Conditional Use, in accordance with Section 14.11.
Section 14.11 H Accessory Dwelling Units Supplemental Allowance
An Accessory Dwelling Unit (ADU), or portion thereof that is proposed to be within the required
setback applicable to a single-family home may be approved as a Conditional Use, subject to the
following:
(1) The ADU must comply with all provisions of Section 3.11 (Accessory Dwelling Units) except
setback standards;
(2) The ADU shall only be situated where an accessory structure on the lot may be placed;
(3) The ADU, and any portion thereof, must not exceed 15’ in height;
(4) The ADU must not exceed 600 s.f. gross floor area;
(5) The principal entry to the ADU must not be oriented a side or rear lot line; and, (6) The
proposed encroachment of the ADU must not have an undue adverse affect on:
(a) views of adjoining and/or nearby properties;
(b) access to sunlight of adjoining and/or nearby properties; and, (c) privacy of
adjoining and/or nearby properties.

This application, consisting of the construction of a four (4) bedroom single family residence utilizing a proposed on-site wastewater disposal system and a proposed on-site drilled well water supply on an existing 44.00-acre parcel with an existing two (2) bedroom single family residence utilizing an existing on-site
wastewater disposal system and an existing municipal water system connection located at 1505 Dorset Street in the City of South Burlington, Vermont, is hereby approved under the requirements of the regulations named above subject to the following conditions. Any person aggrieved by this permit may
appeal to the Environmental Court within 30 days of the date of issuance of this permit in accordance with 10 V.S.A. Chapter 220 and the Vermont Rules of Environmental Court Proceedings. 1. GENERAL
1.1 The permittee is responsible for recording this permit in the City of South Burlington Land Records within 30 days of issuance of this permit and prior to the conveyance of any lot subject to the jurisdiction
of this permit.
1.2 The permittee is responsible for recording the design and installation certifications and other documents that are required to be filed under these Rules or under a permit condition in the City of South
Burlington Land Records.
1.3 Each assign or successor in interest shall be shown a copy of the Wastewater System and Potable Water Supply Permit and the stamped plan(s) prior to the conveyance of a lot.
1.4 The landowner is responsible for establishing any easement(s) shown on the approved plans. The land deeds that establish and transfer ownership of the approved lot(s) shall allow future owner(s) the right to construct, maintain, and repair the wastewater and/or potable water supply systems approved herein. If the landowner does not properly execute said easement(s), this permit becomes null and void for any subject lot conveyed without easement(s).
1.5 By acceptance of this permit, the permittee agrees to allow representatives of the State of Vermont access to the property covered by the permit, at reasonable times, for the purpose of ascertaining compliance with the Vermont environmental and health statutes and regulations, and permit conditions.
1.6 This permit does not relieve the landowner from obtaining all other approvals and permits from other State Agencies or Departments, or local officials prior to construction.
2. CONSTRUCTION
2.1 Construction shall be completed as shown on the plans and/or documents prepared by O’Leary – Burke Civil Associates, PLC (David Burke, Licensed Designer and Bryan W. Currier, P.E.) with the stamped plans listed as follows:

2.2 Construction of wastewater systems or potable water supplies, or buildings or structures (as defined by
the Wastewater System and Potable Water Supply Rules), or campgrounds, not depicted on the stamped plans, or identified in this permit, is not allowed without prior approval by the Drinking Water and Groundwater Protection Division.
2.3 No buildings, roads, water pipes, sewer services, earthwork, re-grading, excavation, or other construction that might interfere with the operation of a wastewater system or a potable water supply are allowed on or near the site-specific wastewater system, wastewater replacement area, or potable
water supply depicted on the stamped plans. Adherence to all isolation distances that are set forth in the Wastewater System and Potable Water Supply Rules is required.
3. INSPECTIONS
3.1 No permit issued by the Secretary shall be valid for a substantially completed potable water supply and wastewater system until the Secretary receives a signed and dated certification from a qualified Vermont Licensed Designer (or where allowed, the installer) on a Secretary-approved form that states:
“I hereby certify that, in the exercise of my reasonable professional judgment, the installation-related information submitted is true and correct and the potable water supply and wastewater system were installed in accordance with the permitted design and all permit conditions, were inspected, were
properly tested, and have successfully met those performance tests.”
or which satisfies the requirements of §1-311 of the referenced rules.
3.2 Prior to the use of the potable water supply, the permittee shall test the water for Arsenic, Escherichia coli (E. coli), Fluoride, Lead, Manganese, Nitrate as N, Nitrite as N, Total Coliform Bacteria, Uranium, Adjusted Gross Alpha Particle Activity, Chloride, Sodium, Iron, Odor and pH. The Lead sample shall
be a first-draw. All water quality tests shall be conducted at a laboratory certified by the Vermont Department of Health (a list of which can be found on the VDH website). Results of the water tests shall be submitted to the Vermont Department of Health prior to use or within 60 days of the submission
of the Installation Certification required in Condition 3.1, whichever comes first.
4. DESIGN FLOW
4.1 Lot use and design flows (gpd) shall correspond to the following:

5. WASTEWATER SYSTEM
5.1 The existing two (2) bedroom single family residence is approved with an existing wastewater system. No changes shall be made to the existing wastewater system unless otherwise exempt without prior
approval from the Drinking Water and Groundwater Protection Division.
5.2 A future replacement wastewater area for the existing two (2) bedroom single family residence is identified on the stamped plan(s). There shall be no construction or other activities that will affect the suitability of this area for the design and construction of a wastewater system.
5.3 Prior to the construction of a replacement wastewater system for the existing two (2) bedroom single family residence in the replacement area, the landowner shall file an application with the Drinking Water and Groundwater Protection Division pursuant to the Wastewater System and Potable Water Supply Rules.

maintain the flags until commencement of construction of the system.
5.5 Should a wastewater system fail and not qualify as a minor repair or for an exemption, the landowner shall engage a qualified Licensed Designer to evaluate the cause of the failure and submit an application to the Drinking Water and Groundwater Protection Division, and obtain approval thereof, prior to correcting the failure.
5.6 This permit does not relieve the permittee of the obligations of Title 10, Chapter 48, Subchapter 4, for the protection of groundwater.
6. POTABLE WATER SUPPLY
6.1 The existing two (2) bedroom single family residence is approved with an existing municipal water system connection.
6.2 Prior to construction or site work, a designer shall flag the center of the proposed potable water source
and the owner shall maintain the flag until commencement of construction of the source.
6.3 Should the potable water supply fail and not qualify as a minor repair or for an exemption, the landowner shall engage a qualified Licensed Designer to evaluate the cause of the failure and submit
an application to the Drinking Water and Groundwater Protection Division, and obtain approval thereof, prior to correcting the failure.
