HomeMy WebLinkAboutSP-23-044 - Decision - 0052 Timber Lane#SP-23-044 - 1 - CITY OF SOUTH BURLINGTON DEPARTMENT OF PLANNING AND ZONING FIRST RESPONSE LABOR, LLC – 52 TIMBER LANE SITE PLAN APPLICATION #SP-23-044 FINDINGS OF FACT AND DECISION First Response Labor, LLC, hereinafter referred to as the applicant, is seeking to amend a previously approved plan for a 45,903 sf medical office building. The amendment consists of site modifications to add a 200 sf concrete dumpster pad and associated site improvements, 52 Timber Lane. Based on the plans and materials contained in the document file for this application, the Administrative Officer finds, concludes, and decides the following: FINDINGS OF FACT 1. The applicant is seeking to amend a previously approved plan for a 45,903 sf medical office building. The amendment consists of site modifications to add a 200 sf concrete dumpster pad and associated site improvements, 52 Timber Lane. 2. The owner of record of the subject property is Brian Huber. 3. The subject property is located in the Residential-7 Zoning District and the Transit Overlay District. 4. The application was received on November 8, 2023. 5. The plans submitted consist of one sheet, titled “Site Proposal for Concrete Pad”, prepared and last edited by Andrew Ede on 11/6/2023. Rear Setback 30 ft Not Provided No Change #SP-23-044 - 2 - SITE PLAN REVIEW STANDARDS Only the standards below are affected by this application. All other standards will continue to be met. 14.07 Disposal of Wastes Per Article 14.07.I, dumpsters “shall be accessible, secure and properly screened with opaque fencing to ensure that trash and debris do not escape the enclosure(s)”. The applicant has testified that the proposed dumpster pad will be constructed in conjunction with an opaque, secure dumpster enclosure that includes an opaque gate – this enclosure will be at least as tall as the dumpsters held within. As such, the Administrative Officer finds this criterion met. SUPPLEMENTAL STANDARDS 13.03 Bicycle Parking and Storage Per Table 13-3, this use has a short-term bicycle parking requirement of one space per 5,000 sf GFA and a minimum requirement of nine spaces. The applicant is proposing to meet the minimum requirement with the installation of five ‘inverted U’ bike racks dispersed across the site, including one on the north side of the building, one on the east side of the building, and three on the southwest side of the building. The five ‘inverted U’ bike racks will provide two short-term bicycle parking spaces each, for a total of ten spaces, and will meet the standards of Article 13.03 and Appendix G. Specifically, all five bike racks will be secured to stabilized surfaces and installed in locations that are protected from motor vehicles and in reasonable proximity to building entrances. The two southern-most bike racks are being installed in a location that was formerly a parking space but was recently eliminated in an effort to enhance ADA compliance. The Administrative Officer finds this criterion met. 13.04.B Snow Storage Per Article 13.04B.(7), “snow storage areas must be specified and located in an area that minimizes the potential for erosion and contaminated runoff into any adjacent or nearby surface water.” The snow storage areas are indicated on the site plan. The Administrative Officer finds this criterion met. 13.07 Exterior Lighting Per Article 13.07.A, exterior lighting “shall have such shielding as will direct the light downward and will prevent the source of light from being visible from any adjacent residential property or street.” There are no lighting impacts proposed as part of this application. Vehicle Trip Generation The proposed dumpster pad does not constitute a change of use for this educational facility and will not increase the trip generation of the existing use. As such, the Administrative Officer finds that the proposed project does not represent a vehicle trip generation impact. #SP-23-044 - 3 - Water & Wastewater The proposed dumpster pad does not constitute a change or increase in the estimated water or wastewater allocations for this property. As such, the Administrative Officer finds that the proposed project does not represent a water or wastewater impact. DECISION Based on the above Findings of Fact, the Administrative Officer herby approves site plan application #SP-23-044 of First Response Labor, LLC, subject to the following conditions: 1. All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2. This project shall be completed as shown on the plan(s) and shall be on file in the South Burlington Department of Planning and Zoning. 3. The Administrative Officer concurrently issues Zoning Permit #ZP-23-386. 4. Pursuant to Section 15.13(E) of the Land Development Regulations, any new utility lines, services, and service modifications must be underground. 5. Any new exterior lighting must be installed or shielded in such a manner as to conceal light sources and reflector surfaces from view beyond the perimeter of the area to be illuminated. 6. The proposed project must adhere to standards for erosion control as set forth in Section 16.03 of the South Burlington Land Development Regulations. 7. Bicycle racks must meet the minimum requirements of 13.14 and Appendix G. 8. The applicant must continue to maintain the approved landscaping in a vigorous growing condition throughout the duration of the use. 9. The applicant shall obtain a Certificate of Occupancy from the Administrative Officer prior to occupancy and/or use of the approved dumpster pad. 10. Any change to the site plan shall require approval by the South Burlington Development Review Board or the Administrative Officer, as applicable.
