Due to the lack of prior wastewater allocation paperwork, the property would be subject to the “clean slate” provision in the wastewater rules. Whatever the use of the property on 1/1/07 is what we use to calculate the existing, approved allocation for that property. If the use changed after 1/1/07 then there should have been an allocation. The property would be in violation for not obtaining the new allocation, so no new allocations would be honored (section 1-303, page 21 of the rules). The City has a decision from just prior to 1/1/07 (SP-06-45, August 2006) which indicates the following uses: 1881 Williston Road: 13,216 s.f. health club & 400 s.f. medical use 1879 Williston Road: 3,896 General Use & 4,130 light manufacturing The applicant’s description of the property’s use on 1/1/07 (included in a 11/20/23 letter from Tyler Barnes) is generally consistent with the approved use we have on record. Based on this, I am comfortable establishing a 560 GPD wastewater allocation for the building at 1879 Williston Road.
