Martin Subdivision - Lots 2,3 and 4 off White Street, South Burlington, Vermont Dear Mr. Christianson: In. accordance with Condition 7 and Condition 9 ofthe Subdivision Penmit to construct the three lot subdivision referenced above, we certify that the water line extension, sanitary sewer pump station and force main were constructed in general conformance to the approved plans. This certification is based on the following: 1. A hydrostatic pressure test was performed on the new 4 inch PVC force main on December 7, 1999. The test pressure was 50 psi. The test was conducted for 2 hours with no loss of pressure. R-M. Bouffard conducted the test under our direction and in accordance with standard practice. Based on the results, the sewage force main passed the leakage test requirements. 2. A hydrostatic pressure test was performed on the new I '/Z inch copper water service serving the three new lots on December 7, 1999. The test pressure was 95 psi. The test was oonducted for 2 hours and the final pressure was 93 psi. R.M. Bouffard conducted the test under our direction. Although the test pressure was less than tine required 200 ps4we believe the results were adequate for the size and type of water line installed. Based on the results, the common water service passed the leakage test requirements. 3. Included with this certification are the results ofthe bacteriological examination for the water line extension. 4. The sanitary sewage pump station was installed in accordance with the approved plan. An inspection was conducted on December 10,1999 and the pumps were installed and operating as specified on the approved plan. This certification does not cover any items not specifically addressed above. This certification does not relieve the contractor from minor start up items that may be required nor does it relieve the homeowner(s) from proper use and maintenance ofthe system. They would try to get as much parking as possible in attached garages. Ornamental fences would be used to secure the site from the cliff edges. The project would require 12,450 gpd of sewer. Mr. Dinklage expressed concern with the mass of the buildings. He said that he would expect the applicant to commit to a final approved design. Mr. Weith noted that the Natural Resources Committee felt the parking lot was large and out of context with the area. He said he agreed with them. Mr. Rabideau also agreed, but said that a change might require having some of the parking on the other side of the road. Mr. Dinklage said the area is not served by public transportation, so they will need as much parking as possible. Mr. Weith asked the applicant to be sure their traffic study looks at sight distances, especially from the northern access. Mr. Rabideau said they could limit use of that access to emergency vehicles. / 3 Y- Mr. O'Rourke said he is not sold on the density 6f parking. He wanted to see the traffic study focus on present conditions as well as conditions in 5 years or more. Mr. Burgess raised the possibility of getting an approval only when the road is completed. Mr. Burgess said he did not want anything said at this meeting to be construed in any way as encouraging the Zoning Board to grant a variance. Mr. Bresee of the Rec Path Committee noted that the area along Airport Parkway has been in the plan for the rec path. Mr. Burgess also noted receipt of a letter from the Winooski Park District stating their interest in a park on the west side of the road. 7. Public Hearing: Final Plat application of Eric & Suzanne Martin for subdivision of a 1.26 acre parcel of land into four lots of 15,443 sq. ft., 15,463 sq. ft., 12,027 sq. ft. and 12,011 sq. ft., 380 White Street: Ms. Martin said they had removed the automatic alarm, and there is now a flashing light. Mr. Weith said they will need a profile of the base of the driveway. Ms. Martin said all the units will be single family. Mr. Burgess read a letter from Richard Douse, a neighbor, ex- pressing disapplintment that there will be houses built in this location. He also raised the issue of water running off the road onto his land since there is now water on the road area. Ms. Martin said that is why sump pumps are being put in. She said the situation will be better than it is now. Mr. Martin said their property is lower than the other 2 properties. Mr. Dinklage noted that the road would prevent water from running off the Douse property. Mr. Martin suggested putting in a culvert to address that. Members felt this should be required. No other issues were raised. It appears we are not going to be able to attend this meeting due to circumstances beyond our control. Naturally we are very disappointed in having four houses on such a tiny lot. All the adjacent property owners (being 4) objected with good reasons why this development should not be permitted. It almost appears none of us can do a thing to prevent this. We are wondering why we were even notified in the first place, wasting our time when our efforts were useless. A few days ago I was out in my back yard and noticed a buildup of water on property at 38U White St. The area about 35 feet where they plan the driveway. I am sure they will have to build the driveway up to prevent water from covering same. When this is done the water will run off onto my property where I have a grape arbor, flower beds, garden and shed where I keep my lawn furniture. When this happens I will not know which of the four lot owners will be responsible. No doubt I will have no alternative but to appeal. The amendment is to eliminate condition #3(a) of the 3/11/97 approval which requires the plan to be revised to include the tent in the building coverage calculations. APPROVED. No questions were raised by the Commission or the audience. 4. Public Hearing: Preliminary plat application of Eric & Suzanne Martin to subdivide a 1.32 acre parcel into four parcels of 17,766 sq. ft., 15,680 sq. ft., 12,000 sq. ft. and 12,000 sq. ft., 380 White Street: The Martins showed the location of the existing house on the lot. They also showed locations of proposed driveways. The exact locations of the houses will depend on the purchasers. The Martins then addressed comments by the City Engineer and Fire Department: PLANNING COMMISSION 9 September 1997 page 2 They have no problem with the City Engineer's request for a T connection and two pumps. They also have no problems having the City Attorney approve the agreement for maintenance of the sewer pump. Mr. Burgess noted receipt of two letters from neighbors opposing this subdivision. The letters cite water problems and concern that tree cutting and additional building will add to the problem; also concern for wildlife,. traffic and maintenance of the driveway and catch basin. They also express a concern for privacy and for depreciation of their property values. The Fire Department is concerned with the turnaround on lot #4 which they feel is not of sufficient dimension to allow parking and turn -around for emergency vehicles. Mr. Martin said he has asked the Fire Chief what he wants but hasn't yet gotten an answer. Mrs. Martin added that they don't yet know the final configuration of houses. Mr. Dinklage replied that whatever is approved by the Commission is what will have to be built. Mr. Burgess said that the Fire Department concerns will have to be addressed by Final Plat. Mr. Crow asked about having 4 homes served by a private drive. Mr. Weith said the applicant will be closing one curb cut, and the circulation will be improved under this plan. Dear Mr. Weith: We would like to express some concerns to the South Buritngton Planning Commission about Item No. 4, the preliminary plot application of Eric and Susanne Martin to subdivide a 1.32 acre, parcel into four (4) parcels of 17,766 square feet, 15,680 square feet, 12,000 square feet and 12,000 square feet, 380 White .Street at the September 9, 1997, public hearing. --The proposed subdivisions will have an impact on all property around the urea, including White Street, Dumont Avenue and l ienry Street --We think the property at 370 White Street is the lowest lot in the east end of White Street. We have a water problem opt the lot as evidenced by pictures of standing water_ There is concern that with tree cutting and building ofhouses at 380 will disrupt the water absorption rate and create more of a water problem. The proposed catch basin on 380 will pump out their excess water, but it won't keep it from running off into other property. --The property at 370 White Street was purchased three years ago with the intention of building a single; -family home. We bought the property because of the character of the property with its quiet, natural woodland setting, --We fear that if the Martin's are allowed to subdivide this property, a precedent would be set. There are five or six adjacent properties with deep footage, which could conceivably be subdivided, and houses built, creating a hodgepodge of houses and driveways without a cohesive plan. Within this woodland live a multitude of wildlife, squirrels, mice, skunks, woodchucks, raccoons, etc., (an occasional deer and moose have even been spotted over the years); flocks of birds live amongst the variety of trees and plants, downy woodpeckers, bluejays, cardinals, chickadees, sparrows, mourning doves, crows, and robins are some of the residents; wildflowers, woodland plants, insects, frogs, toads, etc., all belong to this important environment. --There is concern with additional traffic. F.ach home will probably have two cars, at least. White Street already has an existing traffic problem which worsens each year. This is a walking district for the elementary school and more traffic; makes it more dangerous for children to cross the street. --There are concerns with the enforcement of any stipulations made regarding this property. Who will maintain the driveway and clear' the catch basin? We have personal experience with stipulations made by the South Burlington Zoning Board on an adjacent property not being enforced. We wish to ensure adjoining; property owners will not have to pursue ent'orcing stipulations in the future. They originally proposed a condo building, but once the property was surveyed, they felt they could keep the integrity of the lot and also some of the bigger trees by building single family homes. There will be a turnaround on lot #4 in order to address the Fire Department concern. They will comply with the dimensions requested by the new Fire Chief. The Martins are willing to do the connections in the road (move the hydrant, connect sewer, gas, water and storm drain,) and do the curb cut in time for them to be incorporated into the White Street work. They will also provide appropriate drainage for houses on lots 2, 3, and 4. PLANNING COMMISSION 10 JUNE 1997 PAGE 2 Mr. Weith also requested some sort of site drainage. The Martins said they plan to remove the existing overhead line and install a new pole. Everything from the new pole will go underground. The question of requiring a street light was raised. The Commission questioned whether a private light is a good idea. They agreed to go with staff decision on this. Mr. Dinklage said his main concern will be excess run-off of water onto the neighboring properties. 4. Sketch plan application of Francis Von Turkovich & Patrice Stratmann to subdivide a 9.7 acre parcel into 3 lots, 2 lots of approximately 2 acres and one lot of approximately 5.7 acres, 300 Swift Street: Mr. Von Turkovich said they will construct a new private access drive to serve the new lots and the house now occupied by the Gardner family. The Gardners have agreed to hook into this drive. Mr. Von Turkovich said they would like a road narrower than city standard to keep with the look of other private drives in the area. Mr. Burgess noted the City engineer suggests 20 feet. Mr. Von Turkovich said they could do that. Mr. O'Rourke raised the issue of sight distances from the proposed new drive. Mr. Weith said a major issue is the right-of-way to land now owned by UVM. The right-of-way is not now defined and this will have to be done. Mr. Burgess stressed that this right-of-way is for the benefit of the city if UVM ever decides to develop the parcel. Mr. Von Turkovich said there will be covenant that the lots created in this subdivision will never again be subdivided. This includes the lot with the existing house. Mr. O'Rourke said that makes the right-of-way issue even more important. Mr. Burgess reviewed the major issues: Location/width of right-of-way to adjacent property (staff will be asked to come back with a recommendation on this) Access road width (members are comfortable with 20 ft.) Lot #1 is currently developed with a single family dwelling. Lots #2-4 will not have any frontage. A sketch plan for a proposed multi -family dwelling on this property was held on 1/28/97 (minutes enclosed). This property located at 380 White Street lies within the R4 District. It is bounded on the north, east and west by residences, and on the south by Williston Road. Access: Access to all four (4) lots is proposed to be provided by a 20 foot wide access drive located within a r.o.w. of unknown width. The preliminary plat plan should clearly show the width of the r.o.w. Section 401.1(k)(1)(a) of the subdivision regulations limits a private roadway to serving three (3) or less separate residential lots. The proposed private roadway will serve four (4) separate residential lots because the curb cut serving the existing residence will be eliminated in favor of using the private roadway. Due to this circumstance, staff recommends approval of the proposed private roadway. Lot size/frontage: The minimum lot size requirement of 9500 square feet will be met by all lots. The minimum frontage requirement of 80 feet will be met by lot #1. Lots #2-4 have no road frontage and will be served by a r.o.w. Density: The maximum number of units permitted on this 55,000 square foot lot (1.26 acres) is five (5) units (1.26 x 4). Four (4) dwelling units are proposed. Sewer: The sewer allocation request should be submitted with the preliminary plat submittal. Impact fees: The applicant should be aware that the new residences on lots #2-4 will be subject to road, school and recreation impact fees. The property is currently developed with a single family dwelling. This property located at 300 Swift Street lies within the R2 District. It is bounded on the north by a residence and undeveloped land, on the west by a church, on the east by a multi- family development (Ridgewood), and on the south by Swift Street. Access: Access is provided by a r.o.w. serving a residence to the north which also provides access to the existing dwelling. Access for the two (2) lots to be developed will be provided by a 18 foot wide private roadway which will also provide access to the undeveloped land to the north. Section 401.1(k)(2) of the subdivision regulations requires that all private roadways be a minimum width of 30 feet with parking and 24 feet without parking. The proposed private road is proposed to be 18 feet in width. The Commission has approved 18 foot drives in the past when serving only 2 or 3 lots. The applicant should address the sight line distances at the intersection of the new driveway with Swift Street. Preliminary plat: The preliminary plat plans should include all information required under Section 203.1 of the subdivision regulations. 3 RICK POSTON - INDOOR RECREATION & OFFICE BUILDING - SITE PLAN This project consists of constructing a 2-story 20,000 square foot building consisting of 15,000 square feet of indoor recreation use and 5,000 square feet of office use. the ZBA on 1/13/97 granted the applicant a conditional use permit for the multiple use. This property located at 120 Kimball Avenue lies within the IC District. It is bounded on the north by a single family residence, on the east by Shunpike Road, on the south by Kimball Avenue, and on the west by an undeveloped lot. Access/circulation: Access is proposed to be provided by a 24 foot curb cut on Shunpike Road and a 24 foot curb cut on Kimball Avenue. Staff recommends that the Kimball Avenue access be moved further to the west away from the intersection. Section 26.103(a) of the zoning regulations states that "unless specifically approved by the Planning Commission there shall be a maximum of one driveway per lot accessing a public street." Staff does not see a problem with two (2) curb cuts since this is a corner lot. Circulation on the site is adequate. 10 PUBLIC HEARING SOUTH BURLINGTON PLANNING COMMISSION The South Burlington Planning Commission will hold a public hearing at the South Burlington City Hall, Conference Room, 575 Dorset Street, South Burlington, Vermont on September 9, 1997 at 7:30 P.M. to consider the following: 1) Preliminary plat application to subdivide a 1.32 acre parcel into four (4) parcels of 17,766 square feet, 15,680 square feet, 12,000 square feet and 12,000 square feet, 380 White Street. 2) Preliminary plat application of Norman and Jean Parrow to subdivide a 42,904 square foot parcel into two (2) parcels of 21,452 square feet each, 285 Kirby Road. 3) Preliminary plat application of John Larkin to expand an existing 89 room hotel and 225 seat restaurant facility, One Dorset Street. The expansion consists of adding 71 hotel rooms for a total of 160 rooms. This application will be treated as a planned unit development. Mr. Weith noted that if there are separate buildings, there would have to be a 50 ft. PRD setback. The Planning Commission can waive that. The Martins said they have another plan showing the buildings connected. Mr. Weith said that would be acceptible. Mr. Martin said the buildings would be 2-story and units would be about 1300 sq. ft. with 3 bedrooms. There would be porches and decks. They will try to save as many trees as possible. The question of access for fire vehicles was raised. Mr. Martin said that to widen the access would mean removing more trees and destroying the integrity of the lot. They are proposing a gravel drive. Mr. Dinklage questioned the sub -surface and said he wanted to assure that people can use the road. Mr. Beaudin felt gravel was not a good idea as it needs a lot of attention. Mrs. Martin said it looks nicer. Mr. Martin added that the road would be main- tained by the Homeowner's Assn. Ms. Corin, owner of the land at 370 and 69 Dumont asked what kind of landscaping will abut her property. Mr. Martin said they could add some trees. There is a 15 ft. setback and the back of the building would be about 20 ft. from the Corin property. Ms. Corin said she liked the second plan better. Ms. Barone said she would like the Fire Dept. to review the second plan to see if emergency vehicles can get down there. Mr. Weith noted the Commission recently approved an 18 ft. gravel private drive. Subdivision regulations recommend 24 ft. He felt 22 ft. is adequate. He said he would talk with the Fire Dept. to see what they want. Members favored plan "B" with the one building concept. They wanted the road to be adequate for emergency vehicles. District. Also, part of the pavement area for the townhouse development will not comply with the C.O. District. Other comments: --- 57 parking spaces required including bike rack. --- two (2) driveways are proposed. Section 26.103(a) of the zoning regulations states that "unless specifically approved by the Planning Commission there shall be a maximum of one driveway per lot accessing a public street." Staff does not see a problem with the two accesses since they are to be shared with adjoining properties. --- lots #2 and 3 do not meet the 80 foot frontage requirement and the 9500 square foot lot size requirement. The Planning Commission may modify these requirements under Section 10.404 of the zoning regulations. Staff recommends that lots 2 and 3 be combined into one lot due to the drainageway. Preliminary plat: --- the preliminary plat should comply with all information requirements of Section 26.10 of the zoning regulations and Section 203.1 of the subdivision regulations. --- applicant should submit a report addressing each of the PUD/PRD criterion under Section 26.151 of the zoning regulations. --- provide building elevations. --- submit legal documents for shared access. There exists a newly constructed drain pipe westerly of building on lot 4, it should be shown on the plans. 2. There should be at least a 5 foot sidewalk on Sherry Road. 345 DORSET STREET - 3 LOT SUBDIVISION 1. Lot 3 has a 30 inch drainage pipe across it draining a large area of Dorset Street. An easement across it was purchased by the City. There is very little buildable area on this lot. 2. Lot one also has a 30 inch drainage pipe across it.
