Section 4416 and the applicability of 19 V.S.A. Section 1111 jurisdiction over the proposed site redevelopment as described in the attached request and as shown on the attached plan “Proposed Site Plan – Phoenix2 LLC – 793 Shelburne Road” by Ruggiano Engineering dated 3/16/23. This analysis is based on your jurisdictional opinion request submittals and files in our office. For the reasons set forth below, it is determined that a Section 1111 permit is required for the proposed redevelopment:
• Work is proposed in the state highway right-of-way.
• The existing access proposed to be utilized for this further development was constructed under State Highway Access and Work Permit # 2591 issued on April 30, 1992.
• This Jurisdictional Opinion takes the place of a Letter of Intent (LOI) for the purpose of 24 V.S.A. § 4416. Hi Ed,
Please find enclosed a site plan to convert the existing repair garage and gas station in South Burlington to a
Convenience store. There is no change to the existing curb cuts on Rt 7 regarding this project. And the City requires
an acknowledgement or judicial opinion from your office that you are aware that this project is being reviewed for the
approval process. And this remains as one of the requirements to approve.
Can you please respond back to us and send us the letter we seek so we can move this project forward?
