HomeMy WebLinkAboutSP-23-029 - Decision - 0833 Queen City Park Road#SP-23-029 - 1 - CITY OF SOUTH BURLINGTON DEPARTMENT OF PLANNING AND ZONING THE VERTERRE GROUP – 833 QUEEN CITY PARK ROAD SITE PLAN APPLICATION #SP-23-029 FINDINGS OF FACT AND DECISION The Verterre Group, hereinafter referred to as the applicant, is seeking approval to amend a previously approved plan for a 30-unit multi-family building. The amendment consists of modifications to a previously approved environmental remediation system to collect contaminated ground water. The modifications include installing a temporary access road to the Hannaford property, excavation and backfill of approximately 2,000 yards of dirt from parking lot for offsite disposal, installing a treatment shed, and installing an interception trench/drain to collect contaminated groundwater, 833 Queen City Park Road. Based on the plans and materials contained in the document file for this application, the Administrative Officer finds, concludes, and decides the following: FINDINGS OF FACT 1. The applicant is seeking approval to amend a previously approved plan for a 30-unit multi- family building. The amendment consists of modifications to a previously approved environmental remediation system to collect contaminated ground water. The modifications include installing a temporary access road to the Hannaford property, excavation and backfill of approximately 2,000 yards of dirt from parking lot for offsite disposal, installing a treatment shed, and installing an interception trench/drain to collect contaminated groundwater, 833 Queen City Park Road. 2. The remedial equipment will be temporary, and the shed and any associated above ground piping will be removed at the end of the project. The interception trench/ditch will remain. 3. The owner of record of the subject property is Limoge Properties. 4. The subject property is located in the Commercial 1-Residential 15 (C1-R15) Zoning District, Traffic Overlay District (Major Intersections-Zone 1), and the Transit Overlay District. 5. Building Coverage will be increased from 5,760 sq.ft t. to 5,824 sq. ft. Overall coverage will be increasing from 20,260 sq. ft. to 20,324 sq. ft. The Administrative Officer finds that coverage requirements are being met. 8. Setback requirements are being met. SITE PLAN REVIEW STANDARDS Only the standards below are affected by this application. All other standards will continue to be met. Relationship of the proposed development to the City of South Burlington Comprehensive Plan 9. Pursuant to Section 14.06 (A), the applicant must give due attention to the goals and objectives and the stated land use policies for the City of South Burlington as set forth in the Comprehensive Plan. For this project, the stated goal of emphasizing sustainability for long- term viability of a green and clean South Burlington is applicable. The project will collect contaminated groundwater and remediate a polluted site. The Administrative Officer finds this criterion met. Combined Review 10. Pursuant to Section 14.09(E), the applicant has requested a combined administrative site plan and zoning permit review. The Administrative Officer finds the criteria for combined review to be met. DECISION Based on the above Findings of Fact, the Administrative Officer hereby approves site plan application #SP-23-029 of The Verterre Group, subject to the following conditions: 1. All previous approvals and stipulations which are not superseded by this approval shall remain in effect. 2. This project shall be completed as shown on the plan and shall be on file in the South Burlington Department of Planning and Zoning. 3. The Administrative Officer issued Zoning Permit #ZP-23-260 concurrently with this approval. 4. Any exterior lighting shall be downcast and shielded per Section 13.07 of the Land Development Regulations. 5. The proposed project shall adhere to standards for erosion control as set forth in Section 16.03 of the South Burlington Land Development Regulations. #SP-23-029 - 3 - 6. The applicant shall obtain a Certificate of Occupancy from the Administrative Officer prior to use of the project. 7. Any change to the site plan shall require approval by the South Burlington Administrative Officer or the Development Review Board, as allowed under the Land Development Regulations.
