HomeMy WebLinkAboutSP-23-017 - Decision - 0310 Market Street#SP-23-017 - 1 - CITY OF SOUTH BURLINGTON DEPARTMENT OF PLANNING AND ZONING SNYDER BRAVERMAN DEVELOPMENT CO, LLC – 310 MARKET ST SITE PLAN APPLICATION #SP-23-017 FINDINGS OF FACT AND DECISION Dover Place, LP, hereinafter referred to as the applicant, is seeking approval to amend a previously approved plan for a 60-unit multi-family residential building with subsurface parking. The amendment consists of replacing the trash enclosure with a trash building, 310 Market Street. Based on the plans and materials contained in the document file for this application, the Administrative Officer finds, concludes, and decides the following: FINDINGS OF FACT 1. The applicant is seeking approval to amend a previously approved plan for a 60-unit multi- family residential building with subsurface parking. The amendment consists of replacing the trash enclosure with a trash building, 310 Market Street. 2. The owner of record of the subject property is Dover Place, LP. 3. The subject property is located in the FBC T-4 Zoning District and the Transit Overlay District. 4. The application was received on April 27, 2023. 5. The plans consist of a three (3) page set of plans, as follows: • Sheet 1 (Site Plan), prepared and last revised by Lamoureux & Dickinson on 7/24/2020 • Sheet A1.0 (Trash/Recycling/Compost Structure), prepared and last revised by Snyder Homes on 4/11/2023 • Sheet OS1 (Overall Landscaping & Open Space Plan), prepared and last revised by Snyder Homes on 6/19/2023 Only the standards below are affected by this application. All other standards will continue to be met. SITE PLAN STANDARDS Section 14.07 Specific Review Standards C. Disposal of Wastes. All dumpsters and other facilities to handle solid waste, including compliance with any recycling or other requirements, shall be accessible, secure and properly screened with opaque fencing to ensure that trash and debris do not escape the enclosure(s). Small receptacles intended for use by households or the public (ie, non-dumpster, non-large drum) shall not be required to be fenced or screened. The applicant previously obtained approval to build this exact detached accessory building to house the various waste disposal containers as part of Site Plan #SP-18-18, then, prior to construction, received site plan approval via Site Plan #SP-19-33 to replace the approved accessory building with an open-air, fenced waste enclosure. This proposed site plan application would replace the constructed waste enclosure with an approximately 12’ x 38’ detached accessory building that is #SP-23-017 - 2 - identical to the trash structure previously approved as part of #SP-18-18. The proposed detached accessory structure will house trash, recycling, and compost waste receptacles and will serve the residents of both 310 Market Street and 324 Garden Street. The waste receptacles within the proposed structure will be secure and completely screened. As such, the Administrative Officer finds this criterion met. The waste enclosure is adjacent to an existing approved Qualifying Open Space. The Administrative Officer finds that the approved site modification will not result in the modification of the Qualifying Open Space or any approved landscaping features. DECISION Based on the above Findings of Fact, the Administrative Officer herby approves site plan application #SP-23-017 of Dover Place, LP, subject to the following conditions: 1. All previous approvals and stipulations which are not superseded by this approval will remain in effect. 2. This project must be completed as shown on the plans submitted by the applicant and on file in the South Burlington Department of Planning and Zoning. 3. All exterior lighting must be installed or shielded in such a manner as to conceal light sources and reflector surfaces from view beyond the perimeter of the area to be illuminated. 4. The applicant must continue to maintain the approved landscaping in a vigorous growing condition throughout the duration of the use. 5. The Administrative Officer concurrently issues Zoning Permit #ZP-23-147. 6. The applicant must obtain a Certificate of Occupancy from the Administrative Officer prior to use or occupancy of the trash building. 7. Any change to the site plan will require approval by the South Burlington Development Review Board or the Administrative Officer.
